NOTICE IS HEREBY GIVEN of the following matters to be considered by the Windward
Planning Commission of the County of Hawaii in accordance with the provisions of Chapters 91
and 92, Hawaii Revised Statutes, Section 6-7.5(a) of the Charter of the County of Hawaii, and
the Planning Commission's Rules of Practice and Procedure.

STATEMENTS FROM THE PUBLIC — Note that statements from the public regarding
any particular item on this agenda will be taken at the time the particular item is called to
order.
NEW BUSINESS — 9:00 a.m.
1. APPLICANT: KATHRYN TYDLACKA (Amend SPP 14-172)
Request to amend Special Permit No. 14-172 to increase permitted enrollment at the Ka`u
Learning Academy public charter school from 65 students to 100 students and to allow for
related facility improvements to accommodate the increase in enrollment. Special Permit
No. 14-172 was originally approved to allow the establishment of a public charter school and
related uses with a maximum enrollment of 65 students within the former Discovery Harbour
Golf Course clubhouse which is situated on 3.69 acres of land within the State Land Use
Agricultural District. The property is located at 94-1581 Kaulua Circle, Discovery Harbour
Subdivision, Unit I, Ka'u, Hawaii, TMK: 9-4-001:019.
2. APPLICANT: PAUL OGASAWARA (REZ 16-207)
Application for a Change of Zone from a Single -Family Residential —10,000 square feet
(RS -10) to a Village Commercial — 10,000 square feet (CV -10) zoning district for
approximately 29,837 square feet of land. The subject property is located on the south side
of Pahoa Village Road, about 320 feet southeast of Akeakamai Loop, Pahoa Village, Puna,
Hawaii, TMK: 1-5-002:027 and 1-5-114:020 (portion).
3. APPLICANTS: ROBERT S. AND CAROL OSHIRO (Revoke USE 133)
Revocation of Use Permit No. 133, originally approved on March 9, 1995, to allow the
establishment of an adult daycare facility within an existing single-family dwelling located
on approximately one (1) acre of land situated within the Single -Family Residential -10,000
square foot (RS -10) zoning district. The subject parcel is located on the east (makai) side of
Kilauea Avenue, approximately 180 feet north of its intersection with East Kahaopea Street,
Waiakea Homestead Houselots, Waiakea, South Hilo, Hawaii TMK: 2-2-040:004.
4. APPLICANTS: ROBERT S. AND CAROL OSHIRO (REZ 16-208)
Application for a Change of Zone from a Single -Family Residential -10,000 square foot (RS -
10) to a Neighborhood Commercial -10,000 square foot (CN -10) zoning district for
approximately one (1) acre of land. The subject parcel is located on the east (makai) side of
Kilauea Avenue, approximately 180 feet north of its intersection with East Kahaopea Street,
Waiakea Homestead Houselots, Waiakea, South Hilo, Hawaii TMK: 2-2-040:004.

5. APPLICANT: KRISTEN MAHNKE (REZ 16-209)
Application for a Change of Zone from a Single -Family Residential -10,000 square feet
(RS -10) to a Neighborhood Commercial -10,000 square feet (CN -10) zoning district for
16,315 square feet of land. The subject property is located on the east side of Kilauea
Avenue approximately 130 feet south of the Puainako Street- Kilauea Avenue intersection,
Waiakea Homestead Houselots, South Hilo, Hawaii, TMK: 2-2-040:108.
6. APPLICANTS: JOHN K. AND LORI L. KAI (REZ 16-210)
Application for a Change of Zone from an Agricultural -20 acre (A -20a) to a Family
Agricultural -2 acre (FA -2a) zoning district for 9.323 acres of land. The property is located
along the west (makai) side of Akolea Road, approximately 2,700 feet from the Akolea
Road—Kaumana Drive intersection, Ponahawai, South Hilo, Hawaii, TMK: 2-5-047:031.
7. INITIATOR: COUNTY COUNCIL (BILL No. 228, Draft 2)
APPLICANT: HILO MEDICAL CENTER (REZ 14-175)
Referral of Bill 228, Draft 2; an Ordinance amending Section 25-8-33 (City of Hilo Zone
Map), Article 8, Chapter 25 (Zoning Code), of the Hawaii County Code 1983 (2005 Edition,
as amended), by changing the district classification from Single Family Residential -7,500
square feet (RS -7.5) to Neighborhood Commercial -7,500 square feet (CN -7.5) for 9,230
square feet of land. The subject property is located along that portion of Punahele Street
approximately 200 feet east (makai) of its intersection with Komohana Street and directly
across from the Hawaii Community Correctional Facility, Punahoa 2nd, South Hilo, Hawaii,
TMK: 2-3-035:018. The County Council is remanding Bill 228, Draft 2 back to the Planning
Director and the Windward Planning Commission for comment and recommendation to
consider proposed conditions of approval associated with the change of zone requested by
Hilo Medical Center (REZ-14-175) that was heard by the Windward Planning Commission at
its meeting on July 7, 2016 and for which an unfavorable recommendation of the request was
offered to the County Council for its consideration.

The purpose of the public hearings is to afford all interested persons a reasonable
opportunity to be heard on the above matters.
Submitting Testimony According to Rule 1 (General Rules) of the Planning
Commission, a person desiring to submit oral or written testimony shall indicate her/his name;
residence address; and whether the testimony is on her/his behalf or as a representative of an
organization or individual. If testimony is being submitted on behalf of an organization,
documentation showing membership ratification should accompany the testimony. Written
testimony shall be submitted with an original and nine copies prior to testifying. The
Commission would appreciate timely submittal to the Planning Department at least one week
prior to the hearing date to allow for mailing and thorough Commission review. Testimony that
is irrelevant or unduly repetitious may be limited by the Chairperson pursuant to Rule 1.
Pursuant to Rule 4, Contested Case Procedure, of the County of Hawaii Planning
Commission Rules of Practice and Procedure, any person seeking to intervene as a party to a
contested case hearing on Agenda Item No. 1 above is required to file a written request which
must be received in the office of the Planning Department no later than seven (7) calendar days
prior to the Planning Commission's first public meeting on the matter. Such written request shall
be in conformity with Rule 4, in a form as provided by the Planning Department entitled
"Petition for Standing in a Contested Case Hearing." The written petition/request shall be filed
with the Planning Commission at Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii
96720, and accompanied by a filing fee of $200 payable to the Director of Finance. Any party
may retain counsel if that person so desires. Rule 4 may be inspected or purchased ($2.50) at the
above-cited location. Rule 4 may also be viewed at the County of Hawaii website
(http://www.co.Hawaii.hi.us).
Anyone who requires an auxiliary aid or service, other reasonable modification, or
language interpretation to access this meeting, please contact Sarah Hata-Finley (961-8157) or
Daryn Arai (961-8142) of the Planning Department as soon as possible, but no later than five
days prior to the meeting date, to arrange for accommodations. "Other reasonable modification"
refers to communication methods or devices for people with disabilities who are mentally and/or
physically challenged.
