HomeMy WebLinkAbout2016-08-23 BOR Minutes TAX BOARD OF REVIEW MEETING MINUTES Appeal Hearings Tuesday, August 23, 2016 West Hawaii Civic Center Department of Liquor Conference Room Kailua-Kona, Hawaii CALL TO ORDER Chairman Donald David called the meeting to order at 9:00 a.m. Present were: Board Members Donald David, Grace Reinhard, Wesley Takai and Richard Dinges; Deputy Corporation Counsel Belinda Castillo Hall; Real Property Tax Administrator Stanley Sitko, Acting Real Property Tax Assistant Administrator Keita Jo and Real Property Appeals Board Clerk Elizabeth Nina Swain. Absent: Board Member Melvin Ventura STATEMENTS FROM THE PUBLIC There were no statements from the public. TAX APPEAL CASE HEARINGS Note: Prior to the start of the case hearings, Deputy Corporation Counsel Belinda Castillo Hall advised all Appellants and the Department of the procedure the Board would be following for the rendering of their decision, and the Appellants’ further right to appeal to the Tax Appeal Court located in Honolulu within 30 days from the date of the decision letter that the appellant will be receiving via certified mail. For each appeal case, the appraiser submitted a packet of information to the Board, unless there had been a prior settlement with the Appellant or withdrawal. If the Appellant was not present, any information sent in by the Appellant was presented to the Board along with the appraisers’ packet. CASE #25469 – HARMON, GREG TMK 5-4-005-048-0000 Appellant was not present. It was noted for the record that the notice of hearing was delivered to the appellant on July 21, 2016. Present was County appraiser Dionne Costa. Property located on Akoni Pule Highway in Kapaau. Appeal on the land value. County presented their case together with any and all information provided by the appellant. County recommended sustaining the land value at $159,300. A call for questions was made. Mr. Takai moved to sustain the County’s assessment. Seconded by Ms. Reinhard. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25256 – CUNNINGHAM, MATTHEW TMK 7-6-015-001-0000 Appellant was not present. It was noted for the record that the notice of hearing was delivered to the appellant on July 23, 2016. Present was County appraiser Ellsworth Hulihee. Property located east of Banyan Mart on Alii Drive. Appeal on the land value. County presented their case together with any and all information provided by the appellant. County recommended increasing the land value to $78,200. A call for questions was made. Mr. Takai moved to sustain the County’s current assessment of $52,200. Seconded by Ms. Reinhard. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25257 – CUNNINGHAM, MATTHEW TMK 7-6-015-005-0000 Appellant was not present. It was noted for the record that the notice of hearing was delivered to the appellant on July 23, 2016. Present was County appraiser Ellsworth Hulihee. Property located in the Holualoa 1 and 2 Partition Lots off of Alii Drive. Appeal on the land value. County presented their case together with any and all information provided by the appellant. County recommended sustaining the land value at $381,900. A call for questions was made. Mr. Dinges moved to accept the County’s recommendation in sustaining the land value at $381,900. Seconded by Mr. Takai. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25258 – CUNNINGHAM, MATTHEW TMK 7-6-015-006-0000 Appellant was not present. It was noted for the record that the notice of hearing was delivered to the appellant on July 23, 2016. Present was County appraiser Ellsworth Hulihee. Property located in the Holualoa 1 and 2 Partition Lots off of Alii Drive. Appeal on the land value. County presented their case together with any and all information provided by the appellant. County recommended increasing the land value to $89,400. A call for questions was made. 2 Mr. Takai moved to sustain the County’s current assessment of $41,400. Seconded by Ms. Reinhard. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25259 – VOS, LISA TMK 7-6-020-006-0000 Appellant was not present. County presented to the Board an executed settlement agreement between the appellant and the County with a land value of $191,300 and building value of $269,900. A call for questions was made. Mr. Takai moved to accept the County’s settlement with the taxpayer with the land value at $191,300 and building remaining at $269,900. Seconded by Mr. Dinges. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25680 – MCCOMBER, DONALD D / MCCOMBER, ELLA M TMK 9-4-005-009-0000 Appellants were not present. County presented to the Board an executed settlement agreement between the appellant and the County with a land value of $307,300, building value of $151,400 and exemption of $180,000. A call for questions was made. Mr. Takai moved to accept the settlement as read by the County. Seconded by Ms. Reinhard. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25244 – LEWIS, WILLIAM & KIM TMK 8-8-019-001-0000 Appellants were not present. County presented to the Board appellants’ request to withdraw their appeal. A call for questions was made. Mr. Dinges moved to accept the withdrawal. Seconded by Mr. Takai. A call for discussion was made. Motion passed by a vote of 4:0. Recessed: 9:52 a.m. Reconvened: 10:12 a.m. SETTLEMENTS – 9:00A APPEALS AGENDA County presented to the Board a 4-page Appeals Agenda containing information on 22 cases that had reached settlement agreements between the County and the respective appellants. A copy of the agenda is attached hereto as Exhibit A. Mr. David questioned the land value in Case No. 25610. Mr. Jo responded for the County. Mr. David questioned the land value in Case No. 25518. County appraiser Dionne Costa responded. Mr. Takai questioned the highway improvements near properties for Case Nos. 25518 and 25519. Mr. Radmilovic responded. Mr. Takai questioned the building values in Case Nos. 25378 and 25274. Mr. Jo responded for the County. A call for questions was made. Mr. Takai moved to accept the settlements as presented on pages 1 through 4. Seconded by Ms. Reinhard. A call for discussion was made. Motion passed by a vote of 4:0. Recessed: 10:20 a.m. Reconvened: 1:30 p.m. CASE #25504 – GARCIA FAMILY TRUST TMK 7-5-042-004-0000 Present were appellant’s representative, Joseph Garcia, and County appraiser Ellsworth Hulihee. Property located on Hoomama Street in the Pualani Estates subdivision. Appeal on land and building values. Appellant’s representative presented their case. County presented their case and recommended sustaining the building value. A call for questions was made. Mr. Dinges moved to accept the County’s recommendation to sustain the building value at $246,300. Seconded by Mr. Takai. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25483 – GARCIA FAMILY TRUST TMK 7-5-042-068-0000 Present were appellant’s representative, Joseph Garcia, and County appraiser Ellsworth Hulihee. 4 Property located on Piena Place in the Pualani Estates subdivision. Appeal on land and building values. Appellant’s representative presented their case. County presented their case and recommended sustaining the land value at $209,800 and building value at $254,300. A call for questions was made. Mr. Takai moved to sustain the County’s building value of $254,300 and lower the land value to $195,700. Seconded by Mr. David. A call for discussion was made. Motion failed by a vote of 1:3 with Mr. Dinges, Mr. David and Ms. Reinhard voting against the motion. Mr. Dinges moved to accept the County’s recommendation to sustain the land value at $209,800 and building value at $254,300 for a total of $464,100. Seconded by Ms. Reinhard. A call for discussion was made. Motion passed by a vote of 3:1 with Mr. Takai voting against the motion. Recessed: 2:19 p.m. Reconvened: 2:25 p.m. CASE #25403 – PHAM, HANK TMK 7-7-004-094-0000 Present were appellant Hank Pham and County appraiser Ellsworth Hulihee. Property located on Hoomaluhia Drive in the Hoomalu subdivision. Appeal on building value. Appellant presented his case. County presented their case and recommended sustaining the building value at $1,408,600. A call for questions was made. Mr. Takai moved to sustain the County’s building value at $1,408,600. Seconded by Mr. Dinges. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25645 – ABE, NATHAN TMK 7-7-014-021-0000 Present was appellant Nathan Abe. County presented to the Board an executed settlement agreement between the appellant and the County with a building value of $177,700, land value of $89,100 and exemption of $93,400. A call for questions was made. Mr. David moved to accept the settlement as presented. Seconded by Mr. Takai. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25542 – WITTMAN, GREGORY A TMK 6-8-012-029-0000 Appellant was not present. It was noted for the record that the notice of hearing was delivered to the appellant on August 8, 2016. Present for the County was appraiser Mary Ann Todd-Waller. 5 Property located on Lina Poepoe Street in Waikoloa Village. Appeal on building value. County presented their case together with any and all information provided by the appellant. County recommended increasing the land value to $69,100 and decreasing the building value to $503,100. A call for questions was made. Mr. Takai moved to accept the County’s recommendation for the land value increased to $69,100 and building value decreased to $503,100 with the exemption calculated accordingly. Seconded by Mr. Dinges. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25544 – WITTMAN, BETSY L TMK 6-8-012-003-0000 Appellant was not present. It was noted for the record that the notice of hearing was delivered to the appellant on July 28, 2016. Present for the County was appraiser Mary Ann Todd-Waller. Property located on Uala Street in Waikoloa Village. Appeal on land and building values. County presented their case together with any and all information provided by the appellant. County recommended sustaining the land value at $134,800 and building value at $432,600. A call for questions was made. Mr. Takai moved to sustain the County’s land and building values. Seconded by Mr. Dinges. A call for discussion was made. Motion passed by a vote of 4:0. CASE #25543 – WITTMAN, GREGORY A TMK 6-8-026-074-0000 Appellant was not present. It was noted for the record that the notice of hearing was delivered to the appellant on August 8, 2016. Present for the County was appraiser Mary Ann Todd-Waller. Property located on Awamoa Place in Waikoloa Village. Appeal on land and building values. County presented their case together with any and all information provided by the appellant. County recommended sustaining the land value at $114,300 and building value at $323,400. A call for questions was made. Mr. Dinges moved to sustain the County’s assessed values. Seconded by Mr. Takai. A call for discussion was made. Motion passed by a vote of 4:0. Granted by Mr. David. Appellant was not present. It was noted for the record that the notice of hearing was delivered to the appellant on July 25, 2016. Present for the County was appraiser Dionne Costa. Property located on Kona Bay Drive, next door to the King Kamehameha Hotel. Appeal on land and building values. County presented their case together with any and all information provided by the appellant. County recommended sustaining the assessed values. A call for questions was made. Mr. Dinges moved to accept the County’s recommendation to sustain the land and building values. Seconded by Ms. Reinhard. A call for discussion was made. Motion passed by a vote of 3:0 with Mr. Takai recused. CASE #25308 – BARRY, MICHAEL E TMK 7-7-007-079-0000 Appellant was not present. It was noted for the record that the appellant contacted the office to inform that he would not be attending the hearing. Present for the County was appraiser Ellsworth Hulihee. Property located on Ainanani Street in the Makalani subdivision. Appeal on land value. County presented their case together with any and all information provided by the appellant. County recommended increasing the land value to $542,500. A call for questions was made. Mr. Dinges moved to sustain the County’s value of $400,000. Seconded by Mr. David. SETTLEMENTS – 1:30P APPEALS AGENDA County presented to the Board a 5-page Appeals Agenda containing information on 25 cases that had reached settlement agreements between the County and the respective appellants. A copy of the agenda is attached hereto as Exhibit B. Mr. Takai questioned the land and building values for Case No. 25492 as possibly being transposed. Clarification made with the original settlement agreement. Noted for the record that the agreed to building value should read $413,800 and land value as $213,400 with the exemption remaining at $160,000. Correction made to the settlement appeals agenda. Mr. Dinges questioned the building value in Case No. 25355. County appraiser Dionne Costa responded. Mr. David questioned the building value in Case No. 25562. County appraiser Dionne Costa responded. Mr. David questioned the building value in Case No. 25617. County appraiser Matthew Radmilovic responded. Mr. Dinges questioned the exemption amount for Case No. 25307. Mr. Jo responded for the County. Mr. David questioned the building value in Case No. 25248. County appraiser Dionne Costa responded. Mr. Takai moved to accept the settlements as noted on pages 1 through 5 with the correction for Case No. 25492 as noted and the removal of Case No. 25645 as previously ruled on.
