Members Present: Theresa Andreae, Fanny Collins Au Hoy, Cynthia Hope and David Ross, Jr. 2. Absent and Excused: Stephen Herbert and Sally Marone 3. Applicants: Jeffrey Foster 4. Staff Present: Bennett Mark, Rosalind Newlon and Noriko Sauer 5. Public: None The Vice Chair welcomed those in attendance, and the Commissioners introduced themselves. UNFINISHED BUSINESS None. NEW BUSINESS 1. Design review of a proposed fabric canopy to accommodate an existing outdoor dining area for Outback Steakhouse Restaurant. Applicant: Bill Daniel of Outback Steakhouse. Land owner: LRG Real Estate and PFP Anekona LP. TMK: 7-5-009:025. Located at 75-5809 Alii Drive, Kailua-Kona, Hawaii, at the Coconut Grove Marketplace. Staff Presentation Ms. Newlon oriented the Commissioners of the subject and surrounding properties on a location map, and described the proposed canopy over the existing outside dining area. She said that the height of the canopy is 10 feet 8 inches with a slope to the outer edge at 7 feet 6 inches from the ground, that the design appears to meet the architectural design guidelines of the Master Plan for Kailua-Kona, and that the color selected, a forest green, is similar to a green shade of the Benjamin Moore Historic color palate recommended within the Kailua Village Special District. She added that the canopy is made of vinyl- type material, which is not necessarily in line with the Master Plan, however, it offers more durability than fabric does for the purpose. She said that the property is zoned Resort V-.75, and is covered by Special Management Area Use Permit No. 277 approved for the entire Coconut Grove Marketplace project in December 1998. She also mentioned that further research is needed during the Plan Approval process to determine what TMK parcels the Coconut Grove Marketplace 1 consists of, because there is a discrepancy in the parking calculations between the two Plan Approvals issued previously. Applicant Presentation Jeffrey Foster, the proprietor and an equity partner of the Outback Steakhouse restaurant, also representing Bill Daniel, the applicant, introduced himself. He said Ms. Newlon’s presentation was comprehensive, and added that the reason why they are moving forward with canopy is because even though the existing umbrellas cover a large part of the lanai, they lose 32 seats when it rains, which puts on a financial burden on them. Public Testimony There was no one from the public wishing to testify on this agenda item. Commission Discussion Commissioner Andreae asked where the rain would end up with the canopy. Ms. Newlon said there is a slight arch to the canopy, and according to the plan sheets the scalloped edge of the canopy goes outside of the posts, so rainwater should drop outside of the dining area. Mr. Foster confirmed that the canopy extends for 2.5 feet outside of the lanai railing, so the water will run to the bushes. Ms. Newlon clarified for Commissioner Andreae that there is only foliage and no sidewalk in that particular area. In response to Commissioner Andreae’s question about the white umbrellas shown on the rendering, Ms. Newlon said that there are three umbrellas in the outdoor area and they couldn’t eliminate them from the picture, but all will be removed when the canopy is installed. Mr. Foster clarified that they are burgundy-color umbrellas, but they whited them out to create the image rendering. Commissioner Hope queried Mr. Foster about the color quality of the rendering, and he confirmed that the colors are off; the color of the canopy should be dark green instead of blue as shown, and the actual roof color is greener than the photo. Commissioner Hope asked him whether they have considered the turquoise color in the catalogue, if they are trying to match the roof color. He said he confirmed with Mr. Daniel, when Ms. Newlon informed him their plan sheet indicated the color to be blue, that the proposed color is the dark green. Commissioner Hope said the turquoise would be her choice, and expressed her approval of the canopy design. In response to Commissioner Ross’ observation that in words they are trying to match the roof, but in practice they are matching the landscaping, Mr. Foster stated that when Mr. Daniel couldn’t match the roof with any colors in the catalogue, he tried to select a best looking color for the area. He added that he thinks the turquoise looks great, but it may be a little too bright when laid there. In response to Commissioner Hope’s question whether they ever considered the burgundy, Mr. Foster said they are going to try something different from the existing burgundy umbrellas. 2 In response to Commissioner Ross’ inquiry, Mr. Mark stated that the recommended Benjamin Moore Historic color palate is just a sample, and that the Commission has rejected applicants’ colors in the past because they seemed inappropriate for the area. He added that in this case if the proposed dark green looks too bold, the Commission can request a more muted color. Commissioner Au Hoy expressed her concern about runoff from the awning and possible puddles and muddiness on the lawn caused by it, adding that she wasn’t sure whether or not a French drain would be appropriate. Mr. Foster said he thinks the drainage will be better with the awning because the current situation is that the runoff from the umbrellas gathers in the center gutters and shoots on the lawn like a waterfall. In response to Commissioner Ross’ question, Mr. Foster said that they have never experienced ponding. Commissioner Andreae suggested that drainage gutters can be put onto the ground if the problem arises, to which Mr. Foster agreed. Commissioner Ross commented that since the roof color can’t be matched with any of the available colors, they could move away into something different, such as the color in the landscaping, instead of choosing an almost-matching color. Commissioner Andreae said that if it is their preference to match the roof to create some continuity, she would encourage them to look further to do so. Mr. Foster responded that they would have a better chance matching the building color than the roof color. Commissioner Hope commented that a gray color matching the building will make their landscape pop, while a big blotch of green will compete with it. In response to Commissioner Andreae’s question whether a burgundy to complement their logo is an option, Mr. Foster said he doesn’t see the right burgundy in the color samples. Commissioner Ross confirmed the Commissioners’ consensus that the color should match a building element, such as the roof or the walls, as opposed to the landscaping. In supporting Mr. Foster’s idea to match the building, Commissioner Au Hoy suggested he select a gray color that would blend better with the building. Mr. Foster mentioned that neither Mr. Daniel nor he has a problem with getting the color changed, and selected #502-8390 (Gray) from the canopy catalogue to match the walls. Commissioner Andreae recommended him to select another color to match the roof as an alternative, and he selected #502-8611 (Blue-Green) and #502-8552 (Turquoise) being the closest to the roof color. His selection was agreeable to the Commissioners. Action It was moved by Commissioner Andreae and seconded by Commissioner Hope to recommend to the Planning Director the approval of the proposed canopy, with the following recommendation: The canopy shall be either (1) “Precontraint” #502-8390 (Gray) to match the walls of the building, or (2) “Precontraint” #502-8611 (Blue-Green) or #502-8552 (Turquoise) to match the roof. A roll call vote was taken and motion carried with three ayes (Andreae, Hope and Au Hoy). 3 ADMINISTRATIVE MATTERS 1. Minutes of the Meeting of July 24, 2007 – It was moved by Commissioner Hope and seconded by Commissioner Au Hoy that the minutes be approved as circulated. The motion was unanimously carried by a voice vote of all Commissioners in attendance. ANNOUNCEMENT Mr. Mark announced that the Planning Department did not receive any applications for Commission review as of the due date, therefore, the meeting scheduled for September 11, 2007, has been cancelled. Commissioner Au Hoy asked for the status of commissioner recruitment, and Mr. Mark reported that nothing new has come to his attention, but he is still trying various avenues, and will check the status with the Corporation Counsel who is handling this matter. Commissioner Andreae suggested the matter be put on the agenda for the next meeting. ADJOURNMENT There being no further business, at 5:47 p.m., it was moved by Commissioner Hope and seconded by Commissioner Au Hoy that the meeting be adjourned.
