HEARING TRANSCRIPT
OCTOBER 6, 2016
A regularly advertised hearing on the revocation of Use Permit No. 133 was called to order at
9:13 a.m. in the County of Hawaii Aupuni Center Conference Room, 101 Pauahi Street, Hilo,
Hawaii with Chairman Gregory Henkel presiding.
COMMISSIONERS PRESENT: Gregory Henkel, Joseph Clarkson, Donald Ikeda, Myles
Miyasato, and Raylene Moses.
ABSENT & EXCUSED: Donn Dela Cruz.
ALSO PRESENT: Duane Kanuha (Planning Director), Molly Stebbins (Corporation Counsel
for the Windward Planning Commission), William Brilhante (Assistant Corporation Counsel for
the Planning Director), Malia Ho (Deputy Corporation Counsel), Jeff Darrow (Staff Planner),
Maija Jackson (Staff Planner), Christian Kay (Staff Planner), and Sarah Hata-Finley
(Commission Secretary).
And 9 members from the public in attendance.
APPLICANTS: ROBERT S. AND CAROL OSHIRO (Revoke USE 133)
Revocation of Use Permit No. 133, originally approved on March 9, 1995, to allow the
establishment of an adult daycare facility within an existing single-family dwelling located on
approximately one (1) acre of land situated within the Single -Family Residential -10,000 square
foot (RS -10) zoning district. The subject parcel is located on the east (makai) side of Kilauea
Avenue, approximately 180 feet north of its intersection with East Kahaopea Street, Waiakea
Homestead Houselots, Waiakea, South Hilo, Hawaii TMK: 2-2-040:004.
HENKEL: Is everybody ready to move on to Item 3 on the agenda? Item 3 is Robert S. and
Carol Oshiro to revoke USE 133, and Christian will be giving the presentation.
KAY: Yes, thank you, Mr. Chair. Good morning. Good morning, Members of the
Commission.
MIYASATO: Good morning.
KAY: Welcome back. So, as the Chair said, this next item is to revoke Use Permit No. 133
which was originally approved on March 9th, 1995 for the establishment of an adult day care
facility within an existing single-family dwelling. The Applicants wrote a letter requesting
revocation because the adult day care facility is no longer in operation.

Just to give you an idea of where this is located, here is the subject parcel outlined in red. Just
for reference, we've got Kilauea Avenue running generally north -south through the slide and
Kahaopea Street running east -west through the slide. The Director is recommending that the
request to revoke Use Permit No. 133 be approved by the Planning Commission. I'll be happy to
answer any questions that you may have.
HENKEL: Commissioners, any questions of staff? Okay, will the Applicant come forward,
please? Good morning. Will you raise your right hand, and repeat—do you swear or affirm to
tell the truth on this matter now before the Planning Commission.
NISHIMURA: Yes, I do.
HENKEL: Thank you. Please state your name, the area you reside, and proceed. Talk directly
into the microphone.
NISHIMURA: Hi. My name is Brian Nishimura representing the Applicants. I'm a planning
consultant residing in Hilo.
HENKEL: You can proceed. Did you get the Planning Director's Background Report and
Recommendation Reports?
NISHIMURA: Yes.
HENKEL: Do you have any further comments?
NISHIMURA: No, I don't. It's pretty straightforward. They no longer utilize the property for
the care facility and in the process of doing their rezoning application, they felt it appropriate to
ask that the Use Permit be eliminated.
HENKEL: Okay, thank you. Commissioners, are there any questions of the Applicant? If not,
you may be seated. Thank you. No one is signed up to testify, so I'll look for a motion to close
the public testimony portion of the hearing.
MOSES: I make a motion to close public testimony.
MIYASATO: Second.
HENKEL: It's been moved by Commissioner Moses and seconded by Commissioner Miyasato
to close the public testimony so all in favor, say "aye?"
COMMISSIONERS: Aye.
HENKEL: Opposed? Okay, that takes care of that. Is there a motion for action?

IKEDA: I'll make the motion. I move that the application to revoke Use Permit No. 133 be
approved based on the Planning Director's recommendations and findings which shall be
adopted.
MIYASATO: Second.
HENKEL: It's been moved by Commissioner Ikeda and seconded by Commissioner Miyasato.
Is there any discussion on the motion? If not, we'll do a roll call vote.
KAY: Thank you, Mr. Chair. Commissioner Ikeda?
IKEDA: Aye.
KAY: Commissioner Miyasato?
MIYASATO: Aye.
KAY: Commissioner Clarkson?
CLARKSON: Aye.
KAY: Commissioner Moses?
MOSES: Aye.
KAY: And Chair Henkel.
HENKEL: Aye.
KAY: Thank you very much. Motion carries, five, nothing.
