Section10-14.CentralizedPurchasing.
a)Thedepartmentoffinanceshallberesponsiblefortheprocurementofallmaterials,
supplies, equipmentandservicesrequiredbyanyagencyofthecounty, exceptas
otherwiseprovidedbythischarteroranylaw.
b)Thereshallbeastandardizationcommitteecomposedoffivemembers. Themayorshall
appointfourmemberswithoutnecessityofcouncilconfirmation, eachofwhomshallbe
fromaseparatedepartment. Thefifthmembershallbearepresentativeofthedepartment
offinancewhoshallserveaschairpersonofthecommittee. Thecommitteeshallclassify
allmaterials, suppliesandequipmentcommonlyusedbythevariousagenciesofthe
countyandshallprepareandadoptstandardsandspecificationsforsuchmaterial,
suppliesandequipment.
c)Allpurchasesandcontractsformaterials, supplies, equipmentandservicesshallbemade
inaccordancewithHawai‘iRevisedStatutesandrulesandregulationsestablishedbythe
stateprocurementpolicyofficethereto. Anysuchruleorregulationmaybemodifiedby
thedirectoroffinance, inaccordancewithChapter91, Hawai‘iRevisedStatutes,
providedthatsuchmodificationsshallbeconsistentwiththerequirementsofstatelaw.

a)Inadoptingeachfiscalyear’soperatingbudget, thecouncilshallappropriateaminimum
oftwopercentofthecertifiedrealpropertytaxrevenues, includingpenaltyandinterest,
toafundknownasthepublicaccess, openspace, andnaturalresourcespreservation
fund. Depositstothefundshalloccurataminimum, onaquarterlybasis.
b)Fundingshallconsistofaminimumoftwopercentofactualrevenuereceivedinthe
fiscalyear. Additionalrevenuemayconsistofgrantsandprivatecontributionsintended
forthepurposeofthissection, voluntarycontributionsofanyamountasspecifiedonthe
realpropertytaxbill, proceedsfromthesaleofgeneralobligationbondsauthorizedand
issuedforthepurposeofthissection, councilappropriationsforthepurposeofthis

b)Definitions. Forthepurposeofthissection, thefollowingdefinitionsapply:
Maintenance” meanstopreserveandconservelandsandeasementsacquiredby
thepublicaccess, openspace, andnaturalresourcespreservationfundandkeepthemin
goodrepairforpublicsafety.
Maintenancefund” meansaseparatefundthatholdsmoneysdirectedfrom: 1)
thegeneralfundandpropertytaxrevenues; or2) designatedgrants, privatecontributions,
proceedsfromthesaleofgeneralobligationbonds, councilappropriations, andanyother
sourceofrevenue.
c)Thereisestablishedapublicaccess, openspace, andnaturalresourcespreservation
maintenancefund (hereinafter “maintenancefund”). Themaintenancefundshallbe
administeredandmanagedbythedepartmentofparksandrecreation.Thefinancial
aspectsofthemaintenancefundshallbehandledbythedepartmentoffinance.
d) Depositsduetothemaintenancefund.
1)Inadoptingeachfiscalyear’soperatingbudget, thecouncilshallappropriateone-
quarterofonepercentofallrealpropertytaxrevenue (includinginterestand
penalties) tothemaintenancefund. Depositstothemaintenancefundshalloccur
onaquarterlybasisataminimum.
2)Additionalrevenuedepositedinthemaintenancefundmayconsistofgrantsand
privatecontributionsintendedforthepurposeofthissection, proceedsfromthe
saleofgeneralobligationbondsauthorizedandissuedforthepurposeofthis
section, councilappropriationsforthepurposeofthissection, andanyother
sourceofrevenue.
e) Accountingforthemaintenancefund; interestbearingaccounts; reportingbythe
departmentoffinance.
1)Allmoneysinthemaintenancefundshallbedepositedininterestbearing
accountsuntilneeded. Anyinterestshallaccruetothemaintenancefund.
2)Moneysinthemaintenancefundshallbeidentifiedseparatelyfor:
A)Fundingreceivedfromtherealpropertytaxrevenueincludinginterestand
penalties; and
B)Fundingreceivedfromgrantsandprivatecontributions, andanyother
sourceofrevenue, anditsinterestearned, which:
i.Shallbeitemizedandearmarkedforspecificprojectsforthelands
oreasements.
ii.Shallnotbesubjectedtothemaximumaccrualoffundslimit
providedinsubsection (f).
3)Financialstatementsshallbepostedeachmonthonthepublicaccess, openspace,
andnaturalresourcespreservationfundwebsite.
f)Maximumaccruallimitinmaintenancefund; exemptiontofunding.
1)Onlymoneysderivedfromrealpropertytaxrevenue, itsinterest, anditspenalties
shallbeincludedinthecomputationofthemaximumaccruallimitforthe
maintenance fund. Allothermoneysspecificallydirectedtothemaintenance
fundshallbeheldseparatelyfromthosemoneysinthemaintenancefundthat
originatedfromrealpropertytaxrevenues (includinginterestandpenalties), and
shallnotbesubjectedtothemaximumaccruallimit.
2)Themaximumaccruallimitshallnotexceed $3,000,000.

3)Attheendofanyfiscalyearinwhichthemaintenancefundholdsunencumbered
fundsderivedfromrealpropertytaxrevenue (includinginterestandpenalties) of
atleast $3,000,000, anyunencumberedamountinexcessofthat $3,000,000shall
bepermanentlytransferredtothegeneralfundbalance.
4) Exemptiontofunding. Ifthemaintenance fundholds $3,000,000in
unencumberedfundsderivedfromrealpropertytaxrevenue (includinginterest
andpenalties), thenthecouncilandtheexecutivebranchdonotneedtoaddmore
moneytothemaintenancefunduntilthenextbudgetcycle. Thisexemptionshall
notreleasetheadministrationfromitsmandatorydutytomaintainandpreserve
landsandeasementsacquiredbythepublicaccess, openspace, andnatural
resourcespreservationfundingoodrepairforpublicsafetyeachfiscalyear.
g) Themaintenancefundshallbeusedsolelyforpublicsafetymaintenanceandpreservation
ofthoselandsandeasementsacquiredbythepublicaccess, openspace, andnatural
resourcespreservationfund, andmaybeusedonlyforexpendituresdirectlyrelatedtoits
purpose. Expendituresbytheadministrationorstewardshipgrantspresumedtobe
directlyrelatedareasfollows:
1)Reparation (fixing, mending, repairwork, andservicing);
2)Preservation (damagecontrol, salvaging, safekeeping, andsafeguarding);
3)Conservationofsoil, forests, shorelines, nativewildlife, streams, wetlands,
watershed, andfloodways;
4)Restoration (replacement, reclamation, reconditioning, andremediation);
5)Wildfireandfireprevention;
6)Repairofexistingbuildingstomeetthecurrentcoderequirements, ifthebuilding
isdeemedreasonabletosave;
7)Replacingsignstomeetthecurrentcoderequirements;
8)Installation, repair, orreplacementfencingandgateoraccessmechanisms;
9)Installationorrepairofcattleguards;
10)Mitigationoffloodingproblemsincludingrepairorrestorationofexisting
culverts, drainagefeatures, orothersimilarfloodcontrolmitigation;
11)Archeological surveyandbufferingofNativeHawaiianhistoricalorculturalsites
afterappropriate consultationwithNativeHawaiiandescendantsandcultural
practitioners;
12)BiologicalstudiesfortheprotectionofNativeHawaiianspeciesofplantsand
animals; or
13)MitigationofAmericanswithDisabilitiesActcomplianceissuesthatmayarise
duringthecourseofpublicsafetymaintenanceandpreservation.
Moneysinthemaintenancefundshallnotbeusedforplanning, design, development, or
constructionofnewbuildings, facilities, orinfrastructureincludingroads, paths, bridges,
culverts, ramps, ordrainagefeatures. Moneyinthemaintenancefundshallalsonotbeusedfor
mitigationofAmericanswithDisabilitiesActcomplianceissuesforanynewbuildings, facilities,
orinfrastructure. Paymenttoresolvetheseaforementionedissuesshallbefromthecapital
improvementprojectsbudgetorallotmentsderivedfromthegeneralfund.

h) StewardshipGrants. Moneysmayalsobeusedtoprovidegrants-in-aidforprojects,
whichusesarereflectedinsubsection (g).
1)Anawardofastewardshipgrantshallbebycouncilresolution.Stewardship
grantsmaybeawardedonlyuntilmoneysinthemaintenancefundare
extinguished. Grantsshallbeawardedonthebasisofabilityofthestewardship
organizationtocompletetheprojectontimeandwithincostestimates.
2)Only501(c)3nonprofitsoranorganizationthatoperatesundertheumbrellaofa
501(c)3nonprofit, andthatcancompleteaprojectforthegoodofthecommunity,
shallbeconsideredforastewardshipgrant.
3)Publicnoticebythedepartmentoffinanceoftheavailabilityofthestewardship
grantsshallbeplacedintwonewspapersofgeneralcirculation, aswellas
electronicmediaaccessiblebyinternet, byAugust1ofeachfiscalyearprovided
moneyisavailable.Theseadvertisementsshallbepaidforfromthemaintenance
fund.
4)Toapplyforastewardshipgrant, astewardshiporganizationshallprovidetothe
departmentofparksandrecreationthefollowing:
A)Anapplicationformobtainedfromdepartmentofparksandrecreation
whichiscompletedforeachspecificpurposeorproject;
B)Adetailedbusinessplanfortheprojectthatincludesthenameofthe
501(c)3nonprofitorganization, theorganizationthatoperatesunderthe
umbrellaofa501(c)3nonprofitorganization, ifany, acopyofitsletterof
determinationfromtheInternalRevenueService, acopyofitsbylawsand
missionstatement, adescriptionofthespecificproject, timeframesfor
projectgoals, costs, andactivitiestoaccomplishthestatedpurpose, and
anyotherinformationrequestedbythedepartmentofparksandrecreation;
and
C)Asignedagreementtofileawrittenreportoneyearorlessafterreceiptof
fundsthatincludesdetailsastowhathasbeenaccomplishedonthe
project, costs, andhowthemoneywasspent.
5) Noofficer, boardmember, oremployeeofthe501(c)3nonprofitorganizationor
theorganizationthatoperatesundertheumbrellaofa501(c)3nonprofit
organizationshallreceiveasalaryorpaymentforlabororreceiveany
reimbursementforthestewardshipworkontheproject. The501(c)3nonprofit
shallsignanagreementsostatingtheseconditionsandsubmititwiththe
application.
6) Mismanagementofmoneysawardedforastewardshipgrantshallbarthe501(c)3
nonprofitorganizationandtheorganizationthatoperatesundertheumbrellaofa
501(c)3nonprofitorganizationfromreceivingfuturegrantsfromthemaintenance
fund.
7) Thedirectorofthedepartmentofparksandrecreationshallprovideashort
writtenevaluationoftheproposedprojecttothecouncilandincludea
recommendationabouttheapplicant’sabilitytocompletetheprojectaccordingto
theprojectplan.
