Dear Chair Tokuda and members:
RE: SB 221
Thank you for this opportunity to testify in support of SB 221.
As we understand the intent of this bill, it is to give the counties the option of
implementing a photo red light program. Our attorneys have one concern: that the
language of Section 3 ("There is established the photo red light imaging detector
systems program...") and Section 4 ("Each county may establish and implement...")
might be read to mean that if a county does not exercise its option, someone else could
(perhaps the State, or even some other entity).
If it is made crystal clear that the option is with the county, and only with the
county, we believe this is a good initiative. We would welcome having such choice, and
therefore urge passage of SB 221.
