HomeMy WebLinkAbout2017-01-20 Police Commission Regular Minutes REGULAR SESSION MINUTES JANUARY 20, 2017 WEST HAWA KAILUA-KONA CALL TO ORDER Chair Morioka called the meeting to order at 9:24 a.m. ROLL CALL Present: Keith Morioka, Chair Carl Carlson, Member Wayne De Luz, Member Peter Hendricks, Member Guy Schutte, Member Absent: Arthur Buckman Robert Gomes, Member Jak Hu, Member Paul Paiva, Member A quorum was present. Also present: Paul Ferreira, Police Chief Kenneth Bugado, Deputy Chief Marshall Kanehailua, Assistant Chief Mitchell Kanehailua, Assistant Chief Henry Tavares, Assistant Chief Rio Amon Wilkins, Detective Malia Ho, Deputy Corporation Counsel Josie Pelayo, Secretary APPROVAL OF AGENDA Commissioner Schutte motioned to approve the agenda. Commissioner Hendricks seconded, and it carried unanimously. STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS (None.) APPROVAL OF MINUTES December 8, 2016, regular and executive sessions: Commissioner Schutte pointed out a typo in the executive session minutes. Regular Session Minutes January 20, 2016 Page 2 Commissioner Schutte motioned to approve all the minutes with non-substantive corrections. Commissioner Hendricks seconded, and it carried unanimously. REPORT ON DEPARTMENTAL ACTIVITIES Crime Report: Assistant Chief Tavares reported that up through December 31, 2016, they had 3,623 serious crimes, of which 825 cases were investigated by the Criminal Investigation Units. For the month of December, they had 8,318 calls for service. In the past 3 months, they had increases in motor vehicle thefts. Burglaries were increased in Puna. These are being addressed with increased patrol and public education. had increased burglaries of vacant homes in the Ocean View area. This is being addressed with roving patrols and working with residents. AC Mitchell Kanehailua stated that CPOs are helping Ocean View to organize a neighborhood watch. The community realizes they have a big problem. Commissioner De Luz stated that burglaries seem to be done by a gang of guys who drive around Hawaiian Paradise Park. Detectives have done a great job in helping with his stolen vehicles. Traffic Report: Assistant Chief Mitchell Kanehailua reported that for the fiscal year, up to December 16, they had 709 traffic crashes, 21 traffic fatalities, 11 DUI fatalities, and 565 DUI arrests. For the month of December, 4,331 citations were issued. Punatraffic crashes doubled compared to the last month. Extreme rain has been a factor in the increase. This is being addressed with additional enforcement and public service announcements. Personnel Report: Assistant Chief Marshall Kanehailua reported losing members of the recruit class. Two recruits are intergovernmental movements from Oahu and Maui; they are in an accelerated program. They have a good list for the s vacancies. Five individuals passed the captain on down. They have to continue with recruitment because they have a large number of officers with 25 years of service who qualify for retirement. Their training pool is unfunded, and they want it funded. Filing dispatcher vacancies is a big problem. One of their CIP projects is to build a new Puna police station. Finance Report: AC Marshall Kanehailua reported that they are in the beginning stages of submitting a status quo budget with 5% reduction. A draft was given to the commission. They are transitioning to a new firearm, a Glock. Financing the purchase of the remaining 450 Glocks is an issue. The vendor is buying back the old guns but will not allow the one for one trade option if it goes beyond the two-year period. They continue to work on the new radio and cad projects. Regular Session Minutes January 20, 2016 Page 3 Commendations of Sworn and Civilian Employees: Chief Ferreira reported receiving 5 commendations since the last meeting involving 29 personnel. He thanked the commissioners for attending the last held every month in different district. All commissioners are welcome to attend. The next meeting is in February in Kamuela. Other Departmental Activities: Chief Ferreira stated that the Chief does not know who is on the promotions list. The Assessment Board gives him their recommendation. If the Board or Chief believes the list is not suitable, they will not fill the position. They could ask County HR for an additional list. They want to have an ongoing recruit class even if they only have one or two vacancies. At last count, they had 38 officers who now qualify for retirement. The county is on a status quo minus 5% budget. Being creative, they use the COPS grants for some funding. then turned over to the Council, and then it year they request additional staffing. Sworn personnel has increased but not the civilian staff. CORRESPONDENCE Correspondence No. 17-01: From Police Chief Paul Ferreira, Annual Misconduct Report to the State Legislature. Deputy Chief Bugado reported that this report only has suspensions and dismissals. There were no comments. NEW BUSINESS Selection of Vice Chair of the Police Commission for 2017: Chair Morioka stated that Commissioner Gomes stepped down as Vice Chair, so they need to select a new Vice Chair. Commissioner Schutte nominated Commissioner Hendricks as Vice Chair. Commissioner De Luz seconded, and it carried unanimously. COMMITTEE REPORTS (New Assignments) After discussion, it was agreed that committees would be assigned when needed. EXECUTIVE SESSION Commissioner Schutte motioned to meet in executive session to consider discipline and charges against officers or employees o to consider sensitive matters relating to public safety, to review the evaluation of the Police Chief, and may consult with Corporation Counsel on questions and issues pertaining to the to HRS 92- -20 (b). Commissioner Hendricks seconded, and it carried unanimously. Executive session convened at 10:15 a.m. Regular session reconvened at 12:05 p.m. Regular Session Minutes January 20, 2016 Page 4 ACTION ON EXECUTIVE SESSION MATTERS Investigation of Complaints HPC 16-47: Complainant alleged that that while conducting an investigation, an officer responded to her and others in a threatening and intimidating manner. Commissioner Schutte motioned that there was insufficient evidence to prove the ndricks seconded, and it carried unanimously.
