HomeMy WebLinkAbout2017-05-04 Windward Planning Commission MinutesWINDWARD PLANNING COMMISSION COUNTY OF HAWAII MINUTES MAY 4, 2017 The Windward Planning Commission met in regular session at 9:01 a.m. in the County of Hawaii, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii, with Chairman Gregory Henkel presiding. COMMISSIONERS PRESENT: Joseph Clarkson, Gregory Henkel, Donald Ikeda, and Myles Miyasato. ABSENT & EXCUSED: Donn Dela Cruz. ALSO PRESENT: Michael Yee (Planning Director), Malia Ho Hall (Deputy Corporation Counsel for the Windward Planning Commission), Jeff Darrow (Planning Program Manager), Maija Jackson (Planner), Christian Kay (Planner), Shancy Watanabe (Planner), and Sarah Hata-Finley (Commission Secretary). A quorum was present. Chairman Henkel introduced Windward Planning Commissioners and staff to members of the public and went over the procedures for public testimony. STATEMENTS FROM THE PUBLIC — No statements were presented under this section of the agenda. 1. APPLICANTS: HILO LAGOON CENTRE (SMA 17-067) Application for a Special Management Area (SMA) Use Permit to allow the installation of a solar photovoltaic system on the existing building roof and on four proposed shade structures in the parking lot at the Hilo Lagoon Centre, which is on approximately 4.3625 acres of land situated within the Special Management Area. The parcel is located at 101 Aupuni Street approximately 480 feet from the intersection with Kilauea Avenue, Waiakea, South Hilo, Hawaii, TMK: 2-2-014:010. The Commission took this item up at 9:02 a.m. with 8 people from the public in attendance. (SEE EXHIBIT A) This item ended at 9:19 a.m. 2. APPLICANT: HALE OHI BED AND BREAKFAST LLC (AMEND SPP 966) Request to amend Special Permit No. 966 from a six (6) -room Inn to a five (5) -bedroom Bed & Breakfast and the deletion of Condition Nos. 3 (Final Plan Approval), 4 (Bedroom Limit) & 6 (Final Status Report) related to the previous Inn use. Special Permit No. 966 was originally approved to allow the establishment of a six (6) -room Inn and related improvements on 4.465 acres of land situated within the Agricultural -1 acre (A -la) zoning Pagel of 3 Windward Planning Commission May 4, 2017 Minutes district. The subject properties are located along the north side of Old Volcano Road, approximately 390 feet east of its intersection with Wright Road, Ola`a Summer Lots, Volcano, Puna, Hawaii, TMKs: 1-9-003:010, 020 and 021. The Commission took this item up at 9:19 a.m. with 5 people from the public in attendance. (SEE EXHIBIT B) This item ended at 9:31 a.m. MINUTES — The Commission took this item up at 9:31 a.m. Approval of Minutes of the April 6, 2017 (Windward Planning Commission Meeting,) and April 10, 2017 (Windward Planning Commission and Leeward Planning Commission Joint Meeting) — It was moved by Commissioner Miyasato, and seconded by Commissioner Ikeda, that the minutes of April 6, 2017 and April 10, 2017 be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE MATTERS/ANNOUNCEMENTS - The Commission took up the following at 9:32 a.m. Mr. Darrow reminded the Commissioners that the Windward Planning Commission's Special Meeting regarding the Ka`u Community Development Plan (CDP) will take place on May 10, 2017, in Ka`u. He added that the June 1, 2017, Commission meeting tentatively had four items on the agenda, one of which was the continuation of the Ka`u CDP hearing. Commissioner Miyasato clarified with Mr. Darrow that the purpose of the May 10th meeting in Ka`u was primarily to receive public testimony. Mr. Darrow stated that it was past practice of the Planning Department to first hold a special Commission meeting in the district of the CDP prior to the regularly scheduled session to allow the public greater opportunity to provide testimony to the Commission. Director Yee asked Mr. Darrow to comment on the things in the Ka`u CDP which differ from the other CDP's that the Commission should focus on. Mr. Darrow stated that there was a misunderstanding concerning Discovery Harbour. He explained that the General Plan designation for those parcels was Rural, and that the draft Ka`u CDP recommended that a portion of those parcels be designated Low Density Urban. Mr. Darrow said that there was language in the Discovery Harbour Covenants, Conditions & Restrictions (CC&R's) referring to a "Village Commercial" area. Mr. Darrow stated that the CDP process was separate from the CC&R's. He stated that this confusion will be discussed in greater detail by Ron Whitmore at the May 10th special meeting. Mr. Darrow briefly explained that once the Ka`u CDP was adopted, the General Plan would still need to be amended. Chair Henkel reconfirmed that the May 10th meeting was more informational and that the Commission's action concerning adoption of the draft Ka`u CDP would be at the June 1st meeting. Motion was unanimously carried by a voice vote of all Commissioners in attendance.
