Dear Secretary Kelly:
Along with our Hawai'i Congressional leaders, Sen. Mazie Hirono, Sen. Brian Schatz,
Rep. Tutsi Gabbard and Rep. Colleen Hanabusa, I am writing in support of Mr. Andres
Magana Ortiz of Kailua-Kona, Hawai'i in his request for a stay of his removal from the
United States. Mr. Andres Magana Ortiz has received a Final Order of Removal and
has been ordered to report to US ICE in Honolulu for deportation on June 8, 2017.
We ask at this critical time that your Department exercise the use of its prosecutorial
discretion to allow Mr. Magana Ortiz remain in the United States and obtain Legal
Permanent Resident status, based on his US citizen spouse's 1-130 Relative Petition.
His wife's application is pending and currently being adjudicated by your Department.
Mr. Magana Ortiz's case warrants your favorable exercise of prosecutorial discretion as
it is not considered a high priority for enforcement based on the following reasons:
1) he has had a long-term presence in the US, having been here over 28 years
when he arrived as a teenager. He is an upstanding member of our community;
2) he has immediate family members who are all US citizens: his wife and 3 minor
children ages, 12, 14 and 20; and
3) he has established compelling ties and made compelling contributions to the
Unites States as a successful coffee farmer and businessman in his community.
Mr. Magana Ortiz is not a threat to our national security or public safety. His US citizen
spouse and 3 minor children all depend on him especially during this time in their lives.
His coffee farm is thriving and will need to be harvested in a few months. Removing
him from the United States would be devastating and undoubtedly cause extreme
hardship to his family, his Kona coffee business, and his community.

Time is of the essence. We urge you to exercise prosecutorial discretion for Mr.
Magana Ortiz by granting a stay of relief and keeping his family together rather than
tearing them apart. Your immediate attention to this urgent matter is greatly
appreciated.
