MINUTES
JUNE 1, 2017
The Windward Planning Commission met in regular session at 9:04 a.m. in the County of
Hawaii, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii, with Chairman
Gregory Henkel presiding.
COMMISSIONERS PRESENT: Joseph Clarkson, Gregory Henkel, Donald Ikeda, and Myles
Miyasato.
ABSENT & EXCUSED: Donn Dela Cruz, Thomas Raffipiy.
ALSO PRESENT: Michael Yee (Planning Director), Daryn Arai (Deputy Planning Director,
9:16 a.m. to 10:33 a.m.), Amy Self (Deputy Corporation Counsel for the Planning Director, 9:26
a.m. to 10:41 a.m.), Malia Ho Hall (Deputy Corporation Counsel for the Windward Planning
Commission), Jeff Darrow (Planning Program Manager), April Surprenant (Planning Program
Manager, 9:50 a.m. to 10:33 a.m.), Ron Whitmore (Project Manager for the Ka`u CDP, 9:16 a.m.
to 10:33 a.m.), Maija Jackson (Planner), Christian Kay (Planner), Shancy Watanabe (Planner),
Leana Gloor (Planner, 9:43 a.m. to 10:33 a.m.), Keiko Mercado (Planner, 9:43 a.m. to 10:33
a.m.), and Sarah Hata-Finley (Commission Secretary).
A quorum was present. Chairman Henkel introduced Windward Planning Commissioners and
staff to members of the public and went over the procedures for public testimony.
STATEMENTS FROM THE PUBLIC — No statements were presented under this section of the
agenda.
1. APPLICANT: VERIZON WIRELESS (USE 17-000067)
Application for a Use Permit to allow the construction of a new, non -manned
telecommunication facility, consisting of a 167 -foot tall steel monopole tower and related
facilities within a 900 -square foot portion of a 1 -acre parcel of land situated in the County's
Agricultural 1 -acre (A -la) zoning district. The property is located northeast of the `Ohi`a
Avenue - Alapua Street intersection, in the Eden Roc Estates Subdivision, Kea`au, Puna,
Hawaii, TMK: 1-1-082:031.
At 9:05 a.m., Chair Henkel announced that this item had been rescheduled to the July 6th
Commission meeting.
2. APPLICANT: CELLCO PARTNERSHIP DBA VERIZON WIRELESS (USE 15-
000059)
Application for a Use Permit to allow the construction of a new telecommunication facility,
including a 155 -foot tall steel monopine with 8 -foot tall panel antennas and related facilities
within a 900 -square foot portion of a 5.76 -acre parcel situated in the County's Agricultural 3 -

acre (A -3a) zoning district. The properties are located at 11-3019 Volcano Highway,
approximately 400 feet east of the Kahuale`a Road -Volcano Highway intersection, Fern
Forest Estates Subdivision, Kea`au, Puna, Hawaii,
TMK: 1-1-020: Portions of 085 and 086.
The Commission took this item up at 9:05 a.m. with 4 people from the public in attendance.

Chair Henkel called a recess at 9:21 a.m., and the meeting was reconvened at 9:31 a.m.
3. INITIATOR: PLANNING DIRECTOR
Continued hearing for an ordinance amending Chapter 25 (Zoning), Hawaii County Code
1983 (2016 Edition, as amended), Articles 1, 2, 4, 5 and 7 relating to meeting facilities and
community buildings. The purpose of the proposed amendments is to incorporate the
definitions of meeting facilities and community buildings into a single, comprehensive
definition by maintaining and expanding upon the definition of meeting facilities.
Additionally, the amendments will identify what zoning districts will require a Special
Permit or a Use Permit to allow for a meeting facility.
The Commission took this item up at 9:31 a.m. with 6 people from the public in attendance.

4. KA` J COMMUNITY DEVELOPMENT PLAN:
On October 27, 2015, the Ka`u Community Development Plan (CDP) Steering Committee
recommended approval of the Ka`u CDP. After reviewing agency comment, the Planning
Director is recommending non -substantive amendments to the CDP. Pursuant to Section 2-
28.1 of the Hawaii County Code, within sixty days after receipt of the Planning Director's
recommendation on a draft community development plan or any amendment thereof, the
Windward Planning Commission shall transmit the draft community development plan or
any amendment with its recommendation through the Mayor to the County Council.
Likewise, pursuant to section 15.1 of the General Plan, the County Council may modify or
amend the community development plan before enacting it by ordinance, but it shall give the
Steering Committee and the Windward Planning Commission an opportunity to review and
comment upon substantive amendments and modifications before final adoption of the plan.
The purpose of this meeting and public hearing is to afford all interested persons a reasonable
opportunity to comment on the Ka`u CDP and for the Commission to review the draft Ka`u

Community Development Plan (CDP) submitted by the Ka`u CDP Steering Committee and
the Planning Director and consider its recommendation to the County Council.

MINUTES — The Commission took this item up at 10:32 a.m.
Approval of Minutes of the May 4, 2017 (Windward Planning Commission Meeting,) and
May 10, 2017 (Windward Planning Commission Special Meeting) — It was moved by
Commissioner Miyasato, and seconded by Commissioner Clarkson, that the Minutes of May 4,
2017 and May 10, 2017 be approved as circulated. Motion was unanimously carried by a voice
vote of all Commissioners in attendance.
Chair Henkel called a recess at 10:33 a.m., and the meeting was reconvened at 10:41 a.m.
ADMINISTRATIVE MATTERS - The Commission took up the following at 10:41 a.m.
Training relating to the new Planning Commission Rule 16: Planned Unit Developments (PUD)
and new Planning Commission permit applications for PUD's.
Mr. Kay provided training to the Commission regarding newly adopted Planning Commission
Rule 16 pertaining to PUD's and the new proposed Planning Department applications form.

Upon inquiry by Commissioner Miyasato, Mr. Kay confirmed that the main reason for a PUD
was to allow more flexibility (through a set of variances or exceptions) against the requirements
of the Subdivision and Zoning Codes to meet a certain design concept. Mr. Kay added that the
shifting of the PUD's to the Commission gave the public a greater voice in the process. He
stated that a condition of approval in terms of exceptions [to the Subdivision and Zoning Codes]
in some past PUD's was the submittal of a master plan, and that this practice would continue.
Upon inquiry by Commissioner Miyasato, Mr. Darrow stated that the PUD's were bound to
affordable housing obligations and impact fees only if an applicant needed to first submit a
change of zone application.
Mr. Darrow informed Commissioner Miyasato and Commissioner Clarkson that Ms. Self was
referencing the Missler case during her previous discussion [in Item No. 4], which concerned a
PUD and the Kona CDP. He commented that generally, the community usually assumed that a
PUD was associated with the creation of smaller lots; however, given a certain size of area,

applicants were only permitted the number of lots allowed by the zoning of the parcel. Mr.
Darrow added that the PUD was a unique and comprehensive planning tool.
The presentation ended at 11:06 a.m.
ANNOUNCEMENTS — At 11:06 a.m., Mr. Darrow announced that the next Windward
Planning Commission meeting [on July 6, 2017] tentatively had two items on the agenda.
ADJOURNMENT — There being no further business, it was moved by Commissioner Miyasato
and seconded by Commissioner Ikeda that the meeting be adjourned. Motion was unanimously
carried by a voice vote of all Commissioners in attendance. Chairman Henkel adjourned the
meeting at 11:07 a.m.
