I. Call To Order
The meeting was called to order by Chairperson William Takaba at 10:00 a.m., in
the Meeting Room, Department of Liquor Control, Hilo Lagoon Centre, 101 Aupuni
Street, Unit 230, Hilo, Hawaii.
The following members were present and constituted a quorum:

which were circulated via e-mail and mail on April 27, 2017 be approved;

Takaba: Good morning.
Kawano: Good morning Commissioners and staff, my name is Andy Kawano. I'm an
officer of Food Pantry, Ltd. I have with me Dexter Hironaga. He's our District Manager of
Operations.
Takaba: Thank you. Do you have any changes to your report?
Kawano: No, we have no changes to our application.
Takaba: Can you describe your business in general.
Kawano: Yes. Food Pantry, Ltd. is in the business of retail. Most of our business serves
in tourist areas and hotels and resorts where we operate sundries stores. We have some
apparel stores and convenient stores. We have four small, what we call, superettes. We
have two in Waikiki. We have one in Makakilo and one in Apili on Maui. That's essentially
it.
Takaba: Thank you. Director Takase, do you have any report of protest?
Takase: Mr. Chairman, the applicant mailed one out of one notices within one hundred
feet and one out of one within five hundred feet. There were no protests to this
application.
Takaba: Thank you. Is there any public testimony on this matter? If none, do we have

Kawano: We have no changes to our report.
Takaba: Okay thank you. Can you describe Lamonts and what you do at the Sheraton.
Kawano: Lamonts and Accents are essentially in the same type of business, so we're in
the retail business. Both locations serve the traveling public at different hotel properties
in this case.
Takaba: Director Takase, any changes or any protest?
Takase: Mr. Chairman, the applicant mailed two out of two notices within one hundred
feet and eight out of eight within five hundred feet. There were five properties entitled to
protest. There are no protest to this application.

Miyabuchi: No, none.
Takaba: No changes. Can you describe your business?
Takaba: Oh sorry, name please?
Miyabuchi: My name is Jon Miyabuchi, I'm the Vice-President/General Manager for
Minit Stop.
Takaba: Thank you.
Miyabuchi: Basically we have convenience retail with fuel dispenser locations.
Convenience store affair and one of our primary focus is food service. So we have our
signature fried chicken and what not.
Takaba: Director, any protest?
Takase: Mr. Chairman, the applicant mailed two out of two notices within one hundred
feet and five out five notices within five hundred feet. There are five properties entitled to
protest. There were no protests to this application.

Onizuka: Just for the Commission's information, I think this location of this new
application for Minit Stop is something that is really good for Kona, especially for those
that rent cars because there's no gas station close to the airport. This is a great addition
for Kona. Wanted to let you know that this would be a great addition for Kona and I
would support the application.

Miyabuchi: I believe the soft is approximately May 18 and the grand opening will be
June 3. So if you guys are in the area swing on by.

Yoneyama: This is a restaurant operation in the town of Kohala (sic) Pahoa. She had
this establishment for a little while but she needs extra space across the parking lot as a
dining area.
Takaba: Okay. Mr. Director, do we have any protest?
Takase: Mr. Chairman, the applicant mailed seventeen out of seventeen notices within
one hundred feet and seventy out of seventy within five hundred feet. There were
seventy properties entitled to protest. There were no protests to this application.
Takaba: Okay, thank you. Do we have any public testimony?
Takase: No there's no public testimony.
Takaba: Okay. Any discussion from the Commission?
Onizuka: Question, Mr. Chair.
Takaba: Yes?
Onizuka: Looking at this, its two separate building's that's separated by parking lots?
Yoneyama: Yes.
Onizuka: Because it's a licensed premise, would there be bars in both buildings? Or are
they carrying it across?
Takase: I can answer that. Depending on the amount of business on the new side, they
will set up a portable bar. But if it's only a couple they may actually transport it across the
parking lot.
Onizuka: Transported by employees not by patrons?
Takase: Correct.
Takaba: Does that answer your question?

Takaba: Can you identify yourself again?
Yoneyama: This is Miho Yoneyama, here on behalf of Nakoa, Umeke's LLC, dba
Umeke's Kuakini Center.
Takaba: Are there any changes to the report?
Yoneyama: No.
Takaba: Can you generally describe the business?
Yoneyama: This is a restaurant with live music and dancing with hard liquor. Serving
mainly Hawaiian food.
Takaba: Okay, thank you.
Takase: Mr. Chairman, I can explain a little bit more. They are taking over the bay that's
adjacent to the restaurant currently. There seemed to be some kind of confusion last
month. They had to go outside of the property, outside of the building to access this
adjacent area, but that's not the case. There's actually doorways into the current
restaurant right into this area. I don't know how they got the impression that they had to
go through the parking lot to get there but that's not the case. In terms of notices, the
applicant mailed seven out of seven notices within one hundred feet and thirty-five out
of thirty-five within five hundred feet. There were no protests to this application.

Takaba: Can you identify yourself and your relation to the business.
Cook: I'm Nathan Cook, part owner and manager.
Takaba: Thank you. You have any changes to your report?
Cook: No
Takaba: No changes. Can you describe your business?
Cook: It's a retail convenience store/market.
Takaba: Director Takase can we have a report of protest?
Takase: Mr. Chairman, the applicant mailed one hundred ninety-nine out of two
hundred seventeen notices within one hundred feet and two hundred four out of two
hundred twenty-two notices within five hundred feet. There were two hundred twenty
two properties entitled to protest. We did receive one protest which I believe is in your
packet. The applicant also submitted four letters in support.
Takaba: Thank you. Do we have any public testimony? Members are there any
discussion?
Onizuka: Mr. Chair, the letter of protest that I'm reading here is referring to the hours.
They're complaining because of the hours and the businesses in that area. According to
this business, it's going to be open from 6 a.m. — 8 p.m.?
Cook: Yes
Onizuka: I don't think that's an unreasonable hour to be closing a business and I don't
think they'll be drawing the unwanted crowd. I think the letter of protest is for something
for record but I don't think it will affect the community.
Takaba: Anything else?
Nahale-a: Claude, you familiar with the area and you feel comfortable....

Onizuka: It's off of Walua Road. There's no other retail place in that area unless you go
to the hotel.
Nahale-a: right and some of the support letters stated that....
Onizuka: In fact, the condominium that I think this people probably live in is across the
road and it's lower than the road. But 8:00 is. I mean you hear more noise from Huggo's
On The Rocks than from the store.
Nahale-a: Right. Thank you.

Woo: Good morning Commissioners. I'm Min Young Woo on behalf of Profectus
Commercial Investment Inc., dba Captain Cook Mini Mart. On my left is David Young
Park, who is the President. In the investigative report, we just need one question on
page two, the operation time. I just found out that instead of closing at 10 p.m. daily,

is planning to open a store there and I think the community welcomes with open arms. I

Onizuka: The parking lot is now by the credit union. It's across of Bank of Hawaii, but
this one is further south. It was a super market before but it hasn't been in operation for
several years.

Banjy's at Waikoloa Golf Course. They have since gone out and we transferred their
license to Waikoloa Village Association. However we're going to split their operations.

Wehrsig: Ofelia Shively, OJ Waikoloa Restaurant and Bar.
Takase: They're going to split. Previously, Banjy's had both the bar and the golf cart
operation. The license is going to split. Waikoloa Village Association is going to take back
the cart operations and then in turn it's going to be leased out to Ofelia Shively, the
restaurant operation. There's a couple pieces of business, item number 20 under new
business is reduction of the clubhouse to account for the new restaurant and we had
another one but couldn't put it on cause we didn't have two thirds. We were going to
increase their premises to include a cart barn which they will operate out of, for the
beverage cart operations.

Takase: When the licensee is going to allow teens in, in this case it'll be after hours.
Anytime that they have teen events that are open to the public, maybe this one doesn't
qualify but anytime they're going to have teenagers or minors in a licensed premises,
then they need to come to us for approval. This one maybe doesn't necessarily apply
cause we kicked out these school events, cause they are closed events. Not really open
to the public or sponsored by the licensee. In this case they came to us cause they
closing after hours. Usually they are closed by 2 but they are going till morning.
Greenwell: So when they do a teen event permit, it's a layer of protection for them?
Takase: In a sense, yes. They are letting us know they are going to have teens on the
premises....
Greenwell: Okay.
Takase: Typically they are not going to be open otherwise so they are just going to have
teens. We changed our rules so they cannot commingle adults with teens. Since they are
going to be on the premises, they need to let us know.

Takase: Let me explain what the request was. She's not here. She came in to see us
and asked if she could extend her hours. First, she was asking for a cabaret
license but I convinced her that she wasn't going to qualify for a cabaret. Then
she told me the real reason why she wants to try to stay open to serve meals
from 2 — 4. For two reasons, one for her customers and secondly, there's
people that go to Nori's to find out they are closed. She's hoping to capture that
market.
Takaba: What time is Nori's open till?
Takase: I'm not sure. I thought that stayed open late. I want to say 12.
Takaba: But how would that affect?
Takase: She's right next door right.
Takaba: Yeah I know, but from 2 — 4 she opens.
Takase: She's open already anyway from 2, maybe she's getting customers as it is but
she wants to extend that extra two hours. I told her it's out of the ordinary but I
would bring it to the Commission. We do have other licensees that remain open
even though they can't serve. That would be the hotels, also the convenience
stores. They have to shut off serving liquor or selling liquor but they do remain
open. We've also had previous dispenser licensees. I remember Ken's
Pancake House use to have a bar operation. So it's not totally new and not
totally unheard of, but I told her I would bring it to the Commission first. Then
you folks can decide if you want to allow this operation. She would shut down
her bar, as it is now, but what this would do is to allow her to stay open to serve
food between 2 and 4. I don't know how successful it would be but she does
want to try. Told her I'll take it to the Commission and see. That's where we're
at.

incorrect. Because like I said we have hotels right now that are 24-hour
operations but they technically shut off, they need to close their liquor service at
4. Most of them close well prior to that and then also our convenience stores
and super markets. A lot of them are 24-hour operations but they need to stop
selling at 11:00. We do have operations that are a little different, just because
you can't sell doesn't mean you have to stop being open. It's a new one for us
that we have right now. But like I said, we have had previous operations like
that and the best example was Ken's Pancake House.

Nahale-a: I'm not sure.

24. Discussion of Rule 3-8(D), Rules and Regulations of the Liquor Com-
mission of the Department of Liquor Control of the County of Hawaii,
State of Hawai`i, restricting the hours of business for the licensed
premises of manufacturers and wholesalers from 6:00 a.m. to 9:00 p.m.
daily, by letter from Director Gerald Takase dated April 19, 2017.
Wholesaler requests interpretation on the following basis: 1) Request to get
on the road earlier and outside the typical business traffic hours; 2) The
ability to service 24-hour operations, stores and hotels that may have
extended hours; and 3) the ability to use delivery areas without impeding
normal business traffic.
Takaba: Gerald, maybe you can explain.
Takase: I'm not sure if you folks are aware or not but Maui made a change to their rules
as far as hours of operation. They did it for three things: 1) for wholesalers; 2) for
hotel operations; and 3) for retail operations. Glenn Mukai, who's the director for Maui,
called me and talked to me about our thoughts about doing it. The one I agreed with is
number one, which is wholesalers. Wholesale operations really don't deal with the
public, they are strictly between the wholesalers and retail operations. I told them I was
in favor of making that change to our rules as well. There are several reasons for it:
1) they don't deal with the public; 2) we're seeing more and more, especially the big
retail stores, they don't want them delivering during regular store hours. They
want them to come in before 6 a.m. Right now our rule states that the wholesalers
can operate from 6 a.m. — 9 p.m. Brandon and I looked at the rules and our
interpretation of it is they cannot sell between those hours so we have received
inquiries from the wholesalers about making deliveries during the off -hours and
we have allowed them to go forward with that. And really on the interpretation is
that a sale is actually taking place during the day whereas the deliveries are
taking place out of those hours. But I wanted to let you folks know that: 1) that
we've made that interpretation; 2) we will probably come forward with the rule
change in the future. One of the big problems on Maui was that the whole Lahaina
front street won't be allowing any commercial vehicles on there from 6 or 7 in the
morning till midnight so they had to do something for them. I can see their point
and if the wholesalers want to do it, I don't see a problem with us allowing deliver-
ies at any time. With the hotels, I told them if they all came in to request it, we
would consider it because the hotels are self-contained operations. Maui was hav-
ing, well they have a lot more flights than we do. They were having people coming
in either early in the morning or late at night and getting to the hotel and nothing
was opened so they were making that accommodation. I don't see it as a big
problem for us, but I don't see any of our hotels staying open that late either. I
think that most of them are shut down by midnight. I don't know if they are going
to come forward or even request it. Finally the retail store operation. I'm not sure
what they were thinking of and we have no plans to change our retail store hours

at this point in time. Really for discussion, if you folks tell me no crazy idea, then
we will stop it. I wanted to let you folks know what we were doing and we will
come forward with our rule change when we do the next rule changes.

Onizuka: My only concern would be if the delivery is done to stores that's close to
residential areas. I'm not sure if we're going to get complaints early in the morning.
Takase: I'm thinking they are going to be between the store and the neighboring
residents because if they are taking other deliveries, I don't think liquor is the only
delivery that's going to start coming in early or late.
