Takaba: Okay, thank you. II. Approval of Minutes (May 4, 2017) Takaba: The May 4, 2017, meeting minutes are still being prepared. III. Approval of Addendum and/or Supplemental Agenda Takaba: Item 3, Approval of Addendum and/or Supplemental Agenda. Pursuant to Section 92-7, Hawaii Revised Statutes, as amended, Item 1 is a proposed amendment to the Agenda, and has been determined not to be of reasonably major significance nor does it affect a significant number of persons, and is proposed for placement on the agenda by two-thirds vote of the Commission. Public Statements on Agenda Items Takaba: Do we have any public statements on any of the Agenda items? Tyler: I could testify now in case it's held up and I'm not here. Good morning Chairman Takaba and members of the Hawaii County Liquor Commission. My name is Curtis Tyler. I'm here to testify this morning on the preliminary hearing on Application 16-36, for the General liquor license, Category B2, application by Ulu Development LLC, at Kona Magics Sands condominium, Ali`i Drive, tax map key: 7-7-008:022-0038. I come this morning as a lifetime resident of Kona and I think most of you know me and know that. I come to testify in favor of this application before you. As most of you know, the space that the applicant, Magics Beach Grill, is going to be located has had quite a few different food and entertainment businesses in the last 20 or 30 years. There are none now and it's been vacant for quite some time. I've had a chance to meet with Mr. Davis and some of the other people involved in this business project. We met in conjunction with the County Park lands that are across the street, in particular, portion of Pahoehoe 2, Pahoehoe 3 and 4; both latitude to which was granted to my 3rd great grandparent and 4th great grandmother by King Kamehameha III, in 1854. The family lived there for an extended period of time, through the turn of the century, that is the 20th century, and JUNE 1, 2017- LIQUOR COMMISSION MINUTES 3 there are many family buried there. It's called, presently, KTpapa Park. That is one of the Hawaiian lines for which I am descended. I am quite familiar with the area. I think the kind of establishment that Mr. Davis and others are proposing for this particular space and the surrounding area is going to be nothing but a positive addition to the beach park and also to the members of the public who would be utilizing that, for perhaps dinner or as a nice relaxing spot. Based on what I know about Ulu Development and some of their other related companies, I have no hesitation whatsoever on giving my full endorsement to this proposal. Public Hearings Takaba: Do we have any other public testimony? There was no reply from the public. Takaba: If none, I'd like to announce that Items 2 through 5, will be continued to July 6th, which is the next meeting of the Commission in Hilo. Does anyone have any testimony on any of Items 2 through 5? Item 2, is Application T16-28, Profectus Commercial Investment Inc., dba Captain Cook Mini Mart, for a sale and transfer of the Retail General liquor license. Application No. T16-29, Keoki's Coffee and Donkey Balls Outlet LLC, dba Keoki's Coffee and Donkey Balls Outlet LLC. Item 4, Application No. T16-33, Waikoloa Village Association, dba Waikoloa Village Golf Course, and Item 5, Application T16-34, Waikoloa Village Lessees, dba Hilton Waikoloa Village. Do we have any testimony on any of those items? There was no reply from the public. Jana Soli, co-owner of the LLC, was present. Takaba: Good morning. JUNE 1, 2017 - LIQUOR COMMISSION MINUTES 4 Soli: Morning. Takaba: Can you identify yourself and your relation to the business? Soli: My name is Jana Soli. I'm one of the LLC owners for Low Store. Takaba: Do you have any changes to you the report? Soli: Nope. Takaba: Can you describe your business? Soli: Yeah, our business is a small general store in Pepe`ekeo. We do food items, we sell gifts, groceries and we have a cold kitchen. Our hours are 6:00 A.M. to 6:00 P.M. We're open 7 days a week and the majority of our clientele would be the local community. Takaba: Thank you. Director Takase, do you have the report? Takase: Yes, Mr. Chairman. The applicant mailed 7 out of 7 notices within 100 feet; 29 out of 29 within 500 feet and there were 28 properties entitled to protest. We did receive 1 protest to this application; 1 protest by a voter within 500 feet. We have copies of the protest letter in your packets and I think copies were provided to the applicant as well. Soli: Yes. Takaba: Do we have any public testimony to this application? There was no reply from the public. Takaba: Hearing none. Commissioners, do we have any questions or anything to discuss to the applicant? Lopez: In reference to the letters, it says within 500 feet, but is it directly across the road? Is it over two or three buildings? Soli: The location of the park? Lopez: Relative to your business. Soli: Our business is across the street and the park is across the street. There is also a church in that same vicinity. There are a couple different parking lots and a basketball court. Lopez: Okay, thank you. Takaba: Any more questions for the applicant? Onizuka: You've been at a store for the while; do people congregate to the park other than for using it for sports or get togethers? Do you see people congregating in certain corners? JUNE 1, 2017 - LIQUOR COMMISSION MINUTES 5 Soli: My family lives right next to the store. We live across from the park. It depends. There are groups that come to play basketball. There's a group that come to hang out and there are a few older gentlemen that will drink in the park every night. It's kind of their thing to do every weekend. The church uses it a lot as overflow for when they have activities. There is congregation now and again, but I wouldn't say anything where it's happening every single night or large groups congregating on a regular basis. Greenwell: You say there's some older gentleman that come and drink in the park? Soli: Yes. Greenwell: Does that give these letters merit? Soli: They've been doing it for at least the last 10 years, so I wouldn't say so. The gentlemen buy their beer from a quarter mile up the store, then come down and have a couple of beers just to relax. But they're not partying; they're not getting drunk; and honestly they have access to the liquor store a quarter mile up from our store as well. Taniguchi: You opened the store in 2016, right? Soli: We opened up this LLC in 2016, but my great grandma opened the store in the 30's. Taniguchi: Did they have a liquor license? Soli: No, this would be the first time. Taniguchi: Is there a restriction for a park? Takase: No. The requirements or the changes for when you have a liquor license in close proximity to a park or school is that it lowers the requirements for a protest. In normal cases it's fifty percent, however when they're in 500 feet of a park or school, it's lowered to forty percent. Sometimes there's a misconception that when you're in the vicinity of a park or a school you're automatically prohibited, but that's not the case. Takaba: Any further questions? Lopez: Yeah, I have a question. Some County Parks allow alcohol by permit. Do we know if this one is in that category? Otherwise, it's illegal, correct? Takase: Yes. Some parks prohibit drinking and the rest are by permit. I think this is a permit. Obviously, most people just don't get a permit when they go down there. I think if they have parties or things, they get a permit. That's kind of the situation she's talking about. Are they illegal? Probably, but I think the police don't really bother unless it becomes a problem. Soli: They definitely keep to themselves and they're very calm and quiet. JUNE 1, 2017- LIQUOR COMMISSION MINUTES 6 Greenwell: Back to my question, this letter talks about a problem. I'm a little concerned. Is there a problem with giving her a license if there's already drinking in the park? I need some help here. Takase: From what we can tell, there's not. We did have some other people from the community come to see me and they were in support of her operation and them getting a liquor license, however their concern was people buying liquor from the store and hanging out at the park. Chances are truthfully, there are some people, but nobody seems to think it's really a problem. She closes at 6:00 P.M., so it's not like they're going to be there all night buying beer from her and hanging out. I don't anticipate it being a problem. Other residents in the area are actually in support of her and it's not something that we usually see too often. At this point, as a Department, we are willing to give her a chance to run her operation. Like every other licensee, they are always subject to coming back before the Commission if there are problems. Based on what's here so far, based on her hours, we don't anticipate problems. I think she's looking for mostly the local trade which is what the other residents are happy about, but also, the tourists go to the Old Highway Inn. It would be a natural stop. You do have some facilities on your patio? Soli: We do, but we won't be serving at all. We don't want to serve on premises. We will be very stringent on that. We are always moving back and forth to the patio so it would be easy to monitor. If I might add something also, my family and I have lived in Pepe`ekeo — well my family has always lived in Pepeekeo. The park being in the best condition it can be is definitely a top priority to us. We wouldn't want to do anything to hinder the quality of the neighborhood, especially because we're actually the closest people to the park. We definitely took that into strong consideration when applying for the license and what that would do. I feel like we really understand how that neighborhood works and we're friends with a lot of people in the community so I feel we have a good relationship and understanding. We have a vested interest in the community in being safe and quiet at night. Taniguchi: I move to close public hearing. Greenwell: Second. Aloha everybody, and my apologies for being late. Commissioner Shelby Nahale-a, from Pepe`ekeo. I live on the Mauka side of where you guys are. I'd like to speak in support of their application. I don't go down to the Makai side a whole lot, but I have gone through there and like she mentioned, her family has been there forever. They are literally right there. If there are any problems, they know about it firsthand, right away. From what I've seen, it's just the old timers, doing what they do all the time, hanging out down there. Mattson Davis, Managing member and President, was present. Davis: Good morning! Takaba: Can you identify yourself and your relation to the business? Davis: My name is Mattson Davis and I'm the managing member/president of Ulu Development. Takaba: Have you read the application report? JUNE 1, 2017- LIQUOR COMMISSION MINUTES 10 Davis: I have. Takaba: Do you have any changes to the report? Davis: I don't. Takaba: Can you describe your business? Davis: Yeah, we're really excited. I've watched this place for a long time, around 20 something years. It'II be a casual beach grill environment. We'll actually have a "grab n' go" window as well to service the beach guests next door with sandwiches, gelato and things like that. It encompasses just over 5,000 square feet right by the water. It's been empty for over four years. We're going to be making some major improvements along the way. It will be a casual environment. We'll be closing at ten o'clock at night; keeping the noise down low. I like to go to bed before that any way. It's just a nice place for the locals to hang out. We're really excited that it's right in the middle of a food desert right there, too. A lot of people from Ali`i Heights have been really positively supporting what's to come in that area as well. Takaba: Thank you. We had testimony in favor from Mr. Tyler. Do we have any other testifiers? There was no reply from the public. Takaba: If none, Commissioners, do you have any questions for the applicant or Mr. Tyler? Lopez: I have a question regarding parking. You're statement says here, well the application says, "parking is available within the premises fronting Alii Drive." That Ali`i Drive corner is horrible for parking. I know having gone to Jameson's and Anthony's in the past, there's two or three or four spots in the front— Davis: Actually 25. We have forty-two percent of the parking lot of the Magic Sands Condominium. Lopez: Okay, so as you enter the front door, then there's a fence where they used to be, on the north side of the parking lot? Davis: Yeah, on the north side of the parking lot, there's a set of wheel stops in the middle of the parking lot. Sixty percent of it is for the 32 condominiums that are 95 percent used by vacation by owner, and the other forty percent are limited common area parking called out on our purchase. Lopez: And so, whatever's available in area could be used for parking? Davis: Exactly. Lopez: And is there parking across the street? JUNE 1, 2017- LIQUOR COMMISSION MINUTES 11 Davis: Yes! And in addition to that, about 4 or 5 years ago, the last administration put a very substantial parking lot across the street right there with a nice crosswalk. We're working with the County Public Works Department to put a bike share stop right there and provide helmets to the renters. Lopez: So there is sufficient parking, not parking on AIi`i Drive? Leon Dreimann, Managing Partner, and Jason Ray, Director of Food and Beverage at the Four Seasons Resort Hualalai, both were present. Dreimann: Morning. Takaba: Good morning. Can you identify yourself and your relation to the business? Dreimann: I'm Leon Dreimann and I'm the Managing Partner for the Elevation Wine Fund. Ray: Good morning, I'm the Assistant Director of Food and Beverage at the Four Seasons Resort Hualalai, Jason Ray. Takaba: Have you read the application report? Dreimann: Yes. Takaba: Do you have any changes you'd like to make? Dreimann: No. Takaba: Can you describe your business? Dreimann: The original business was formed in the State of California as an investment fund as a wholesaler for premium wines. For the State of Hawaii, the intention is to have a wholesale license for the restaurants that cater to the members of Hualalai, run by the Four Seasons Resort. Currently, the members of the resort attain the beer of the restaurants of the resort. They pay an annual membership fee to which they're allowed to bring their own wines as part of their meals. The Four Seasons is willing to change their mark ups to allow members to acquire wines though the wholesale Elevation Wine Fund, which would be set up on the provided premises under a lease. There would be a service and benefit to the members. Since I'm at the resort and known as somewhat of an expert on wines, I was approached to see how this could be done. That is one purpose. The second purpose, a number of the members are in fact owners of wineries in Australia, Europe and Napa Valley. They too would like to be able to provide access to their members to show off the wines they make because they're neighbors and friends. This gives them the possibility to import their wines through this wholesaler and put it on the wine list of the restaurants catering to their members of the Four Seasons. Takaba: Thank you. Takaba: If none, Commissioners, do you have any questions or anything to discuss with the applicant? Onizuka: Question. So the public has no access to this? Ray: No, Sir. Onizuka: This is just strictly for— Ray: It's only put out for the members' clubhouses that are just member specific restaurants. There's no outside guests allowed and it's not open to the public at all. Dreimann: Unless they're a guest of the member. Taniguchi: I have a question. So it says it's a Foreign Limited Liability, LLC. Are you in the process of filing? Takase: They are registered in Hawaii, but they're incorporated in California. They're foreign, but not foreign in the sense that they're not in the United States. Dreimann: We're foreign outside Hawaii. Taniguchi: I was reading this and it was kind of interesting. So what's in it for your company? Dreimann: It's a good question. It's a great community. Everybody is very social and they are very friendly to each other. I've been living here full time for 11 years, so I'm part of the community. I'm on the Food and Beverage committee for the Four Seasons Hotel. I've had the misfortune of providing this as an idea. Ray: He's doing this as a favor. Dreimann: The idea kind of snapped up by members of the Four Seasons. I'm happy to provide the service. Lopez: Question. Something you said caught me. You said it's for the members or their guests? But yet, I see it's a wholesale? How do you wholesale to a guest of a member? Dreimann: Only the guest of the member can visit the restaurant. Ray: You can't go to the restaurant unless you're a member or the guest of the member. If the member ever had family that was visiting, they're welcome to go to JUNE 1, 2017- LIQUOR COMMISSION MINUTES 14 these places that are member specific areas of the resort. No hotel guests can go. It's in the membership community. Lopez: As a wholesaler, you're providing the wines to that facility? Dreimann: Yes. Ray: Correct. Takase: As I'm sure you folks are all aware now, liquor operates under a three-tier system: Manufacturer, Wholesaler and Retailer. Hualalai is the retailer as a Club license. Mr. Dreimann is going to be the Wholesaler. And we have manufacturers, the wineries. What happens many times, especially for wineries, they don't produce enough to be picked up by a big wholesaler such as Young's Market. You have to produce probably 20,000 cases to be considered by them for distribution. He's reaching to a niche market. They have a group of members there that can afford "better wines," but because there is a limited supply made, they will probably never be picked up by a local wholesaler or a national wholesaler to be sold. It keeps them from reaching the market now. We do have something called Direct Shipper Wine permits, where we go to these wineries and if you like that wine you can order from them; but it doesn't allow them to ship to another commercial entity such as the Hualalai Club. Hualalai is helping to provide him the space. He does have an operation similar to this in California. He's not new to the wine wholesaling business. He will be basically a wholesaler with exclusive clients. If he does well, maybe he will expand and sell off the premises and sell to the other clubs. Takaba: Do we have any other questions? Onizuka: As a wholesaler strictly for the Hualalai Resort, you're limited to just that group? Is this something the Department has confronted before? Takase: We haven't had a wholesaler with a limited clientele. As a wholesaler, you can determine clientele, who you will sell and won't sell to. The limitation is coming from where he's located at. He has an exclusive with Hualalai. They're providing him space and he will not become a commercial enterprise for the rest of the island sitting on the resort property. Maybe if he is very successful, he may choose to move it off the resort property and become a full -fledge wholesaler line servicing the rest of the island as well. There are no limitations on them. He doesn't have to sell to everybody, so right now he has the clientele of one. Takaba: What kind of inventory do you carry? How wide is your selection? Dreimann: In California, I carry an inventory of about three and a half million dollars. The average price is probably around in the area of $2,500/bottle. We have wines that are $50,000/bottle. We are world famous for providing wines that are hard to find, impossible to get, extremely highly rated, and on a very short supply. As our Wine Fund says, "that every time someone drinks a bottle, there's less left so therefore the JUNE 1, 2017 - LIQUOR COMMISSION MINUTES 15 value goes up." We sell wines out of California. Over fifty -percent of our sales go to Japan, China, Hong Kong, and Brazil, of all places. It's by collectors all over the world and we would like to have the rarest bottle around. Ray: And that's why he asked me to come on board to help invigorate some of the wine experience for the people, obviously, at the Four Seasons who live there on a full term basis. They were having problems getting wine and he was the key to bringing in wines that they would probably not be able to see on the island themselves. Dreimann: If some of the boutique wineries in Napa Valley sell a bottle for Harlan or Screaming Eagle; they're on allocation. If they do get an allocation, they're usually somewhere around $750 to $1,200/bottle. If there was a wholesaler in Hawaii, which currently there isn't, and you used the normal market of the Four Seasons, you'd have these bottles on the wine list for $3,500 to $4,000/bottle. Somebody who is a collector who knows and appreciates fine wine, they will pay that sort of situation. This is to enable a service to the community and to the members. Takaba: So they can special order though you? Like if they have a special wine that they want? Dreimann: On the Food and Wine Committee, I worked with the chefs and the committee and the chefs put on weekly and monthly special dinners for the members. They don't have the ability to do it as well as they would like to, simply because of the high pricing of the normal wine list. The first time this really was approached was by chefs who were frustrated that they couldn't offer quality wine with the quality food they served. On a couple of vacations, I went to my own cellar and gave it to the chefs. We made up some dinners and it was a huge success. It's a form of education as well. I get invited to talk about wine, where the wines come from and tell stories of historical things to do with many of the wineries around the world. It's fun at the same time. It's not so much about drinking; it's the experience of food and wine and the comradery of the people and getting to know them. I've been fortunate enough to know wineries around the world. We just had Bill Harlan, who is sort of a legend of wine in California, bring his family out and spent time talking about wine while we drank. Ray: There's a hierarchy of the members of Food and Beverage. My job is to take care of the members. They asked if they could come here today and as an amenity to this Board, I stopped. They asked me if they could come here today. I take care of the people who live there, most of them — a lot of them for six out of twelve months of the year. I can tell you whole-heartedly, for the membership community, this is something they have been designing and hoping for in the last thirty-six months. Takaba: Your operation in California is wholesale or retail? Dreimann: It's actually wholesale and partially retail. In California you're allowed to do sales on the web. I can't have a retail open door operation but I can have a web operation at the same time as being a wholesaler. Onizuka: One more question. You know looking at the picture, this cart barn for your storage? Dreimann: Yes. Onizuka: It's already set up for wine, so who does all that wine belong to? Dreimann: It belongs to the restaurant. It's all at the club house. It's the general cart storage area which we'll empty out and put in proper wine coolers. Takase: So for the restaurant at the club house, that's their current liquor storage area. So they're going to clear out and turn it over to Mr. Dreimann. Onizuka: Okay, thank you.
