MINUTES
JULY 6, 2017
The Windward Planning Commission met in regular session at 9:02 a.m. in the County of
Hawaii, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii, with Chairman
Gregory Henkel presiding.
COMMISSIONERS PRESENT: Gregory Henkel, Donald Ikeda, Myles Miyasato, and Thomas
Raffipiy.
ABSENT & EXCUSED: Joseph Clarkson, Donn Dela Cruz.
ALSO PRESENT: Michael Yee (Planning Director), Daryn Arai (Deputy Planning Director, to
10:30 a.m.), Amy Self (Deputy Corporation Counsel for the Planning Director, to 9:51 a.m.),
Mafia Ho Hall (Deputy Corporation Counsel for the Windward Planning Commission), Jeff
Darrow (Planning Program Manager), Maija Jackson (Planner), Christian Kay (Planner), Shancy
Watanabe (Planner), and Sarah Hata-Finley (Commission Secretary).
A quorum was present. Chairman Henkel introduced Windward Planning Commissioners and
staff to members of the public and went over the procedures for public testimony.
STATEMENTS FROM THE PUBLIC — No statements were presented under this section of the
agenda.
1. APPLICANT: VERIZON WIRELESS (USE 17-000067)
Application for a Use Permit to allow the construction of a new, non -manned
telecommunication facility, consisting of a 167 -foot tall steel monopole tower and related
facilities within a 900 -square foot portion of a 1 -acre parcel of land situated in the County's
Agricultural 1 -acre (A -la) zoning district. The property is located northeast of the `Ohi`a
Avenue - Alapua Street intersection, in the Eden Roc Estates Subdivision, Kea`au, Puna,
Hawaii, TMK: 1-1-082:031.
The Commission took this item up at 9:03 a.m. with 25 people from the public in attendance.
At 9:41 a.m., it was moved by Commissioner Ikeda and seconded by Commissioner Miyasato
that the Commission go into executive session to consult with its attorney regarding questions
and issues pertaining to the Commission's power, duties, privileges, immunities, and liabilities,
pursuant to Hawaii Revised Statutes, Section 92-5. A voice vote was taken of all
Commissioners present, and motion carried with four aye votes.

At 9:43 a.m., the Commission went into executive session. At 9:47 a.m., it was moved by
Commissioner Miyasato and seconded by Commissioner Ikeda that the Commission go out of
executive session. A voice vote was taken of all Commissioners present, and motion carried with
four aye votes.
The meeting was reconvened at 9:49 a.m.

2. APPLICANT: COUNTY OF HAWAII, DEPARTMENT OF PUBLIC WORKS (USE
17-000069)
Application for a Use Permit to allow the construction of a 130 -foot tall, steel lattice radio
tower equipped with one microwave dish and two, 2 -way radio antennas and related
structures and improvements on approximately 2,178 square feet of land within the State
Land Use Agricultural District. The project site is situated at 92-6091 Orchid Circle Mauka
which is also the site of the Ocean View Fire Station at the intersection of Orchid Circle
Mauka and Ocean View Parkway, Ocean View, Ka`u, Hawaii, TMK: 9-2-031: Portion of
019.
The Commission took this item up at 9:51 a.m. with 25 people from the public in attendance.

Chair Henkel called a recess at 10: 07 a. m., and the meeting was reconvened at 10:13 a. m.
3. APPLICANT: HAWAII ISLAND DISTILLING, LLC
(SLU 17-000047/REZ 17-000218)
Applications for a State Land Use Boundary Amendment from Agricultural to Urban and a
Change of Zone from Agricultural -20 acres (A -20a) to General Industrial -20,000 square feet
(MG -20) for approximately 6.505 acres of land. The property is located east of Highway 11
(Volcano Highway), west of Railroad Avenue, and north of Highway 130 (Kea`au-Pahoa
Highway), Kea`au, Puna, Hawaii, TMK: 1-6-141:002.

4. APPLICANT: KATHRYN TYDLACKA (Amend SPP 14-172)
Request to amend Special Permit No. 14-172 to increase permitted enrollment at the Ka`u
Learning Academy public charter school from 65 students to 100 students and to allow for
related facility improvements to accommodate the increase in enrollment. Special Permit
No. 14-172 was originally approved to allow the establishment of a public charter school and
related uses with a maximum enrollment of 65 students within the former Discovery Harbour
Golf Course clubhouse which is situated on 3.69 acres of land within the State Land Use
Agricultural District. The property is located at 94-1581 Kaulua Circle, Discovery Harbour
Subdivision, Unit I, Ka'u, Hawaii, TMK: 9-4-001:019.

MINUTES — The Commission took this item up at 10:45 a.m.
Approval of Minutes of the June 1, 2017 Meeting — It was moved by Commissioner Miyasato,
and seconded by Commissioner Ikeda, that the Minutes of June 1, 2017, be approved as
circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance.
ADMINISTRATIVE MATTERS
At 10:45 a.m., Mr. Darrow stated that there were no administrative matters to discuss.
ANNOUNCEMENTS — The Commission took up the following at 10:45 a.m.
Mr. Darrow announced that the State of Hawaii Office of Planning will be conducting Coastal
Zone Management (CZM)/Special Management Area (SMA) training for both the Leeward and
Windward Commissions in the near future.
Mr. Darrow stated that there were two items tentatively scheduled on the next agenda [August 3,
2017] and that the Verizon Wireless Use Permit Application [17-000067] would also probably
be added to that agenda. Upon Commissioner Miyasato's inquiry whether that meeting would be
an action meeting for the Verizon application, Mr. Darrow stated that the status of Verizon's
application concerning the mediation meeting between the parties would be addressed, but he
was not sure if the meeting would include action by the Commission.

ADJOURNMENT — There being no further business, it was moved by Commissioner Miyasato
and seconded by Commissioner Ikeda that the meeting be adjourned. Motion was unanimously
carried by a voice vote of all Commissioners in attendance. Chairman Henkel adjourned the
meeting at 10:47 a.m.
