SUBJECT: Administrative Rules for Farmer’s Market Operations at County Parks and
Facilities
Aloha Director Kamaka,
Mahalo for your July 3, 2017 letter in response to our request for specific information regarding
the permitting of Farmer’s Market operations within Department of Parks and Recreation (DPR)
managed sites or facilities. Your answers to our questions and your comments regarding the
challenges that must be considered before permitting such operations were discussed at length by
the Puna Community Development Plan Action Committee (PCDP AC) at our July 11, 2017
meeting.
It was the general consensus of the AC members present that the absence of administrative rules
providing clear guidance to DPR staff and the public on 1) the permit application process, 2)
minimum qualification criteria for both site and applicant approval and 3) operational standards
designed to reasonably mitigate any challenges to the DPR and the general public is problematic
for both DPR (Directors and staff) and the general public, especially potential permit applicants,
towards the goal of establishing Farmer’s Markets at those County parks and facilities managed
by DPR.
Therefore, the PCDP AC encourages DPR to develop and establish administrative rules in
accordance with Chapter 91, HRS, for the purpose of:
1. Defining “Farmer’s Market” consistent with its reference in Chapter 15, HCC;
2. Establishing minimum criteria for County park or other DPR managed facility suitability
for the operation of a Farmer’s Market;
3. Establishing minimum criteria for Farmer’s Market permit applicants to qualify for
approval; and
4. Establishing a Farmer’s Market Permit application and review process that would
minimize the currently confusing and subjective process.

The PCDP AC appreciates your serious consideration of our comments and suggestions
