C • Kailua-Kona, Hawaii 96740 (808)323-4444 9 Fax(808)323-4440 EMERGENCY PROCLAMATION WHEREAS, Chapter 127A Hawai'i Revised Statutes, provides for the establishment of County organizations for emergency management and disaster relief with the Mayor having direct responsibility and authority over emergency management within the County of Hawai'i. WHEREAS, Chapter 127A Hawai'i Revised Statutes and Chapter 7, Articles 1 and 2 of the Hawaii County Code, establishes a Civil Defense Agency within the County of Hawai'i and prescribes its powers, duties, and responsibilities, and Section 13-23 of the Hawai'i County Charter empowers the Mayor of the County to declare emergencies; and WHEREAS, on January 12, 2017 the County of Hawai'i Department of Water Supply ("Department of Water Supply") issued a Notice of Water Restriction for North Kona asking users to reduce consumption by 25% due to four wells being under repairs or offline; and .WHEREAS, on February 17, 2017 the Department of Water Supply issued a Water Restriction Notice Reminder, and also the Keopu Deepwell had failed after being initially repaired; and WHEREAS, on June 26, 2107 and again on August 3, 2017 the Department of Water Supply posted a FAQ's for North Kona Water Restriction on the Department of Water Supply's website which included a warning that should another well source fail that rotating water shut -offs could occur; and WHEREAS, although the Department of Water Supply issued repeated Notices asking for reduction in use and warning of loss of water supply there has not been significant reduction in usage; and WHEREAS, on August 13, 2017 the Honokohau Deepwell failed increasing the lack of available water supply; and County of Hawaii is an Equal Opportunity Provider and Employer. WHEREAS, due to the possibility of imminent disaster due to property damage and/or bodily injury to residents of the District of North Kona, Hawai'i Island, and the need for government agencies and representatives from the private sector to mobilize and provide immediate services to our island residents, a state of emergency is authorized pursuant to Chapter 127A Hawaii Revised Statutes, and Chapter 7, Hawaii County Code. NOW, THEREFORE, I, HARRY KIM, Mayor of the County of Hawaii, do hereby proclaim and declare that a state of emergency exists due threat of imminent disaster in the District of North Kona, Hawaii Island, effective September 6, 2017, and continuing thereon for 60 days or until further act by this office.
