The meeting was called to order by Chair William Takaba at 10:00 A.M., in the
Meeting Room, Department of Liquor Control, West Hawaii Civic Center,
74-5044 Ane Keohokalole Highway, Building B, 2nd Floor, Kailua-Kona, Hawaii.

1I. Approval of Minutes (July 6, 2017)
Takaba: We will move on to the approval of minutes. The July 6, 2017, meeting
minutes were circulated via e-mail/mail on July 27, 2017. Do we have a motion?
Taniguchi: So moved.
Onizuka: Second.
Mr. Taniguchi moved that the July 6, 2017, Liquor Commission
minutes be approved as circulated; seconded by Mr. Onizuka.
Takaba: It has been moved and seconded. Is there any discussion?

III. Approval of Addendum and/or Supplemental Agenda
Takaba: We have addendums to the agenda, Items 11 through 15. Pursuant to
Section 92-7, Hawaii Revised Statutes, as amended, Items 11, 12, 13, 14, and 15 are
proposed amendments to the agenda and have been determined not to be of
reasonably major significance, nor does it affect a significant number of persons and are

proposed for placement on the agenda by two-thirds vote of the Commission. Do we

Mr. Onizuka moved that the Liquor Commission amend/add the

V. Public Hearings
Takaba: The first item is Application No. 16-35, O&J LLC, dba Waikoloa Restaurant
and Bar, for an original Restaurant General liquor license, Category B2, located at the
Waikoloa Village Clubhouse.

O&J LLC, dba Waikoloa Restaurant and Bar, for an original Restaurant
General liquor license, Category B2, located at the Waikoloa Village
Clubhouse, 68-1790 Melia Street, Waikoloa, Hawaii, TMK: 6-8-003:008.
Miho Yoneyama, Representative, was present.
Monte Anglin and Pat Shields, Testifiers from the Waikoloa Fairways
Association, were both present.
Takaba: Do we have a representative for O&J LLC? There was one protest letter
submitted. Do all of you have that letter?
Lopez: There are two; they're stapled together.
Takaba: I'm sorry. We have two; one from Henry Albright and the other is from Sylvia
Albright, dated June 21, 2017.
Takase: They're here.
Takaba: Do you want to testify?
Anglin: Yes.
Masuda: Once you get settled, can you please identify yourself?
Anglin: Yes, I am Monte Anglin. I am the owner of Unit #A204, in the Waikoloa
Fairways. This is the complex just below the clubhouse and restaurant. The only thing
separating us from the restaurant is a large gravel parking lot and a few bushes. I am
the President of the Board of Directors of the Waikoloa Fairways Association. The
Board has received a number of complaints on noise in the past. We're not opposed to
the liquor license portion, however, the application for music has been very disruptive to
some owners in the past. To give a frame of reference, the clubhouse and the
restaurant is in the middle of the residential area. There are no other businesses
nearby. The closest business, which is the shopping center, is about a mile away. The
complex and the golf course are surrounded by condominiums and private homes in
other areas. The amount of noise generated by the prior tenant, "Banjy's Restaurant
and Grill" was so loud at times that when the owners tried to complain to the restaurant,
no one in authority could be contacted. Ultimately, there were a few calls to the Liquor
Board for compliance with the loud noise. Someone came out and monitored the noise
level and found it was far too excessive. From what I understand, a warning was
delivered to the restaurant. After a couple of times of this problem occurring, nothing
changed and the owners gave up. I would like to get clarification on the hours of noise
levels. The Village Association has a ten o'clock curfew for loud noise and I understand
the applicant has requested until midnight. Ten o'clock is late enough, even on the

weekends. We would like to request the noise be terminated after 10:00 P.M. There
also has to be some level of measurement on how loud it can be. It's easy to monitor,
but when it's booming into someone's home, it's far too loud. We'd like to have some
level of noise that's permitted and on occasion, monitor to see if they're in compliance.
Thirdly, we'd like to have a way to contact someone in authority at the restaurant. That
way, if there is a problem, we can deal with it as neighbors rather than having to call the
police and issue a complaint. Those are the three conditions. There are also special
occasions such as "St. Patrick's Day" and "Cinco de Mayo," which are celebrated as
drinking days. The prior tenant had special parties that always ran well beyond ten
o'clock. We'd like to keep the music and dancing from Thursday to Sunday, which
seems reasonable. If there is a special event, have it on those four days of the week,
rather than on a Tuesday or Wednesday when people have to wake up the next day to
go to work or want to get some rest. It's just a little inconsiderate for the residents who
live there all the time. If we don't have a way to contact someone in authority to get the
music lowered, what options do we have other than to call the police? They say, "it's
not our job, you better call the Liquor Board." This usually occurs at ten or eleven
o'clock at night and it's very inconvenient for everyone involved. We'd like to have
some method of contacting the people who have the responsibility and authority to tune
it down if it's over the top.
Takaba: Thank you. For the record, are you representing yourself?
Anglin: I'm representing myself. The Board has asked me to represent the Board of
Directors at this hearing as well. The Board represents the owners. I did bring another
Board Member with me who is also a permanent resident owner in the complex. We
have all been challenged on the Board with, "can't you do something about this loud
noise after ten o'clock during the evening hours?"
Takaba: Anybody else?
Shields: I would just like to add one more thing.
Masuda: Ma'am, can you state your name?
Shields: Pat Shields, Board of Directors of the Waikoloa Fairways. I'd like to add one
thing to Monte's comments that even when the noise gets loud, people hear it with their
doors and windows closed. It still goes, "boom, boom, boom, boom." It seems like
there should be some limit to that noise. It is in a residential area. Thank you.
Takaba: Thank you. Gerald, would you like to give us a report?
Takase: I don't see the owner here. Miho, are you representing the owners? Can you
come up?
Yoneyama: This is Miho Yoneyama, speaking on behalf of Ofelia Shively, who has
taken over the restaurant.

Takaba: What's your relationship to the business? Are you representing the owners?
Yoneyama: Yes.
Takase: I have some questions. Miho, are you familiar with what kind of operation they
are going to run?
Yoneyama: Yes.
Takase: Are they going to have live music?
Yoneyama: Yes, they will.
Takase: Until what time?
Yoneyama: She informed me it would be from 6:00 P.M. until 10:00 P.M.
Takase: How many nights?
Yoneyama: She said, "once a week; live music with the guitar and it has a speaker on
it. Friday is karaoke night but music hours are not steady and only for special
occasions."
Takase: Were you ever able to meet with the owner?
Anglin: No, the owner is living in California. This is a fairly new restaurant. I would like
to comment that everyone at the Fairways is pleased that the restaurant is reopening
with the new owner who hopefully will be more accommodating to the neighbors. We
are optimistic but we want to make sure our concerns are at least voiced clearly. We
are not opposed to live music or karaoke but concerned about the volume, the hours of
operation and the days of the week. If the intent is from 6:00 P.M. to 10:00 P.M., that
would certainly satisfy the ten o'clock target "noise abatement program." We would like
to see that complied with by the restaurant. We're not opposed to the Friday night
entertainment. Special events concern us a little, if they occur outside of the weekend.
We'd like to see those "special events" celebrated on a Thursday to Sunday basis and
not necessarily on the actual day of event.
Takaba: Under their license, are they authorized to have live music?
Takase: Well, without any restrictions by the Commission, they could actually have
music until 2:00 A.M.
Takaba: I noticed the previous owners, "Banjy's" had two noise violations. What were
the violations?
Takase: They exceeded their noise level. They weren't exceeding the hour
restrictions, but they were over the volume. They were over the allowable limits.
Takaba: And did this happen before or after 10:00 P.M?

Takase: I don't recall but probably after 10:00 P.M. I think up until 10:00 P.M., the
owners tolerated it.
Anglin: Yeah, people were tolerant up until 10:00 P.M.
Takaba: Was it a resident that made the complaint?
Takase: I can't recall, but I'm pretty sure.
Anglin: I believe it was a resident of the Waikoloa Fairways. We're the ones in the
most direct path from the noise of the restaurant. There are buffers of trees or buildings
between us and the restaurant.
Takase: They've been in operation since about May 1. Have you folks had any
problems since then?
Anglin: We have not, to this juncture, had any issues.
Takase: Miho, do you know if they've had any entertainment since they opened?
Yoneyama: I don't have a clue.
Takase: Mr. Chairman, I'm willing to meet with the owner and the Fairway Villas —
Anglin: Waikoloa Fairways.
Takase: Oh, Waikoloa Fairways and owners, to see if we can come up with an
agreement on terms. We can then come back to the Commission; especially since the
owner is not here. I want their commitment that they're going to do it rather than put
Miho on the spot. They are operating under a temporary license. Maybe if we can
continue this matter in a month or two. This will give us a chance to work with both
sides and reach an agreement.
Takaba: Does anyone have any questions?
Lopez: Not a question, but I think it's an excellent suggestion on getting in contact with
the owner and these folks. I'd like to note one thing he said which I think is critical to
any business. There has got to be somebody on-site when the problem is felt. These
folks need someone they can contact and an absentee owner is not the one. I'd like to
see that part of the discussion.
Takaba: There has got to be a manager on duty?
Takase: Yeah, they do have managers on duty.
Masuda: Gerald, did you want it in Kona or Hilo?
Takase: I was hoping on coming back to Kona. That would be the easiest for all
parties. That may give us time to schedule a meeting. We can continue the public
hearing to two meetings.

Anglin: Just to summarize, it's a point of contact, the days of music and entertainment,
the hours of operation and a specified level of a loud noise. Those are short of the four
points. I know it's hard to monitor the level, but I also recognize when you're sitting in
your unit, the walls are bouncing and you're 100 yards away. You would think it
shouldn't be quite that loud. I don't know how to monitor it at the restaurant level, but I
certainly know when the owners feel they can't go to sleep with the loud noise that's
occurring.
Onizuka: How is your relationship with the Waikoloa Village Association?
Anglin: We're very strong.
Onizuka: And they're not supporting you?
Anglin: I don't know how to answer that.
Onizuka: They are supposed to be overseeing all the condos, right?
Anglin: They have "CCR's" in terms of what you can and can't do, the hours of
operation and how you must keep your property looking and alike. You need
permission from them to make changes to your property. We work with them on a
regular basis about our landscaping plans and how things are working, in that regard.
But when we talk to them about issues related to individual owners with other things,
they say, "you need to deal with that yourself."
Onizuka: I'm not talking about individual condo owners. This is a restaurant within the
Association.
Anglin: Yes.
Onizuka: I think the Association should be responsible to you, as President of your
Association and resolve this within your community. If your Association is not going to
support you, you can ask for all the support from us but it's not going to work.
Anglin: I will certainly meet with the manager.
Onizuka: I would ask the Director when you go ahead with your process of discussion
that you include the Waikoloa Village Association.
Anglin: That's a great suggestion.
Onizuka: Another point, even if we should set restrictions on this license say at
10:00 P.M., if they exceed that or if the sound is loud, you can file a complaint and we
can investigate that. You can even come back and we can revoke that. We can make
it so there is no amplified music. There are other solutions, but hopefully you folks can
work it out.
Takaba: Isn't the Waikoloa Village Association the landlord?
Anglin: Yes.

Takaba: There might be a conflict.
Takase: Yeah, they are overseeing it but it's their tenant. We will have them come in
and at least be a part of this conversation. They are right there so they will be the
easiest to complain to as well. I'll ask Roger to come in when we do have the meeting.
Anglin: I would just like to add, when a formal complaint is filed, it doesn't build a
strong relationship between the business and the community that filed the complaint.
We would much prefer to deal with this on a one-on-one level rather than involving a
compliance and formal order. If we have a problem, then I agree, that's the solution that
makes sense. I think it's better if we can do that through you folks rather than the
police. People call the police on their neighbors when there's a large party all night, but
we'd rather deal with this directly with the owner. We're not out to get their license
revoked.
Takase: We did talk to this owner previously about "Banjy's" and what had happened.
She wants to be a restaurant first rather than a bar. If she does well as a restaurant,
then usually you don't have to do the late night and other things. From your
perspective, if you tell the Association to support this restaurant and she does well, this
makes things go a lot easier. There is some "give and take" on both sides.
Anglin: Yes.
Takase: I will meet with both of you and make a resolution.
Anglin: Outstanding. I appreciate that.
Takaba: Thank you, Gerald.
Onizuka: Mr. Chair, I move that we continue the public hearing to the October meeting.

Takaba: Do you have any changes to the report?
Davis: No.
Takaba: Can you describe your business?
Davis: It's a casual ocean front dining restaurant with a bar and fresh flavors. We are
doing a full make over to a 1965 building.
Takaba: Director, report of protest?
Takase: Mr. Chairman, the applicant mailed 40 out of 42 notices within 100 feet; 280
out of 286 within 500 feet and 4 notices to condominium of apartment managers. There
were 285 properties entitled to protests and there were no protests to this application.
Takaba: Do we have any public testimony?
There was no reply from the public.

Cynthia Brooks, Protestor, was present.
Takaba: For the record, we are in the process of voting, so if there are no objections,
we are going to cancel the motion.
There were no objections by the Commissioners.
Brooks: First of all, I just want to say I'm not opposed to him getting a liquor license. I
whole-heartedly want him to get a license. My area of concern has to do with the
category of having live music because I own a unit right above. Any time I've lived or
owned a place with live music playing down below, I felt there has always been an issue
in terms of the music. That's my area of concern.
Onizuka: Question.

Takaba: Yes.
Onizuka: How long have you lived there?
Brooks: It's been in my family since 1981.
Onizuka: So the restaurant was always there?
Brooks: Yeah.
Davis: She doesn't live there.
Brooks: It's my residence, but I don't live there full-time.
Takaba: Commissioners, do you have any questions?
Taniguchi: I have a question. What kind of license did the previous owners have?
Takase: Same type of license. I don't know if they had music.
Brooks: I've never heard any music from "Anthony's." I've heard music playing when it
was "Jameson's." They had live music playing which was an acoustic guitar. When my
dad passed, I inherited the condo in 2002 and I've never heard music down there from
any establishment.
Takase: They did have music in the past. It was more dinner music, not really —
Brooks: Not like a band or something like that.
Takase: You can ask Mattson what kind of music he's going to have.
Davis: We had a nice conversation outside. Some of you might remember the famous
and enjoyable, George Na`ope, rolling out of "Lagoons" and down to "Dorians" with
Aunty Betty, I believe it was. If he wanted to pull out his ukulele, we needed a license
for that. My intention is to have the opportunity for a wedding or a gathering to have a
single player of music. I have run businesses like this for some time and it's very
expensive to have live music on a regular basis. That is not our intention. It's a
beautiful place surrounded by beautiful scenery. It's not going to be about the music but
about the community and comradery. I do want to have options so when I do have
Sunday brunch, a wedding party or reunion, if they want to have a little music then its
fine. Cindy had asked me specifically if "Poncho Man" was going to play and I said,
"no." Cindy and I had a nice conversation outside. She now has my business card and
I, of course asked her to call me at any time to have a conversation. It's quiet at ten
o'clock in the condos and we are about those "CCR's" and making sure everything is in
compliance. I go to bed before 10:00 P.M., so I understand what that means. We're
not about that rowdiness and the reputation we have is not about that. We've had
concerts in the back of the brewery and those were very specific events. This is a small
quiet restaurant.

Brooks: I have a question. He said music would be an option for weddings and special
events. Would he be able to apply for special permits?
Takase: He could. It has to come through a process and it has to come through the
Commission. It's a very cumbersome process to do. They would have to know way in
advance. Usually, we like to know up front and to keep issuing notices for special
events is not practical for anybody. We either give them the authority to do it or not.
You can talk to Mattson about it. I don't know if you know him previously.
Brooks: I do.
Takase: I think he's a good business person.
Brooks: I think he's going to do great down there, personally.
Takase: I would say give him a chance and if it does become a problem, you're always
free to come back.

Takase: Oceans had come to us back in February to amend their conditions. Their
previous conditions were they had to close their front -facing windows when there was
entertainment. They came in asking to amend that condition to allow them to keep their
windows open up until ten o'clock. The Commission approved that and set a 6 -month
trial period. We are coming up on the end of their 6 months. The report from the
Department is we had no complaints from the surrounding owners. I think the Licensee
has done a good job in monitoring what they're doing. On behalf of the Department, I
would recommend that we continue their amendment indefinitely. We talked about it.
She knows if there are complaints they will have to go back to their previous conditions.

reading on it. They've done it twice now and haven't had any problems. I think it's good
for the businesses in the area.

Takase: No, they are not serving liquor at all. It is just for entertainment.

Lopez: I'd like to address what I felt was a misunderstanding to the Licensee about the
control of carrying alcohol outside. I realize it's against the law and I realize in the legal
term they can't do it. My question was more orientated towards it being an attractive
nuisance. It's like owning a swimming pool in Hawaii and being required to put a fence
around it. It's an attractive nuisance. It's very easy for somebody inside the lounge to
want to go to the music and even forget that they've got a beer in their hand. It was an
awareness point. I'm not a rubberstamp kind of person. I offered that as awareness,
not because I was challenging the owner.
