HomeMy WebLinkAbout2017-08-11 Police Commission Regular MinutesHAWAII POLICE COMMISSION REGULAR SESSION MINUTES AUGUST 11, 2017 AUPUNI CENTER CONFERENCE ROOM 101 PAUAHI ST., HILO, HAWAII CALL TO ORDER Vice Chair Hendricks called the meeting to order at 9:32 a.m. ROLL CALL Present: Peter Hendricks, Vice Chair Arthur Buckman, Commissioner Carl Carlson, Commissioner Wayne De Luz, Commissioner Colleen Pasco, Commissioner Absent: Keith Morioka, Chair Jak Hu, Commissioner Paul Paiva, Commissioner A quorum was present. Also present: Kenneth Bugado, Deputy Police Chief Marshall Kanehailua, Assistant Chief Mitchell Kanehailua, Assistant Chief Henry Tavares, Assistant Chief Burt Shimabukuro, Captain Craig Masuda, Deputy Corporation Counsel Malia Hall, Deputy Corporation Counsel Josie Pelayo, Secretary APPROVAL OF AGENDA Commissioner Carlson motioned to approve the agenda. Commisioner De Luz seconded, and it carried unanimously. STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS (None) APPROVAL OF MINUTES Commissioner Buckman motioned to approve the minutes of July 21, 2017, regular and executive sessions. Commissioner Carlson seconded, and it carried unanimously. POLICE CHIEF'S REPORT ON DEPARTMENTAL ACTIVITIES • Personnel: Assistant Chief Marshall Kanehailua reported having 7 sworn vacancies. Many officers have shown interest in the FBI recruitment. A Police Officer I test will be administered at the end of the month. The 85th recruit class started with 14; they are now down to 5. The 86th recruit started with 17; they are now down to 14. The Hawaii Police Commission Regular Session Minutes August 11, 2017 Page 2 Detective/Sergeant list was extended. Lieutenant vacancies will be filled by promotions. They recently conducted realistic job interviews for 19 dispatchers, but none submitted an application. All City Management Services expressed interest in providing school crossing guards. Finance: Assistant Chief Marshall Kanehailua reported that they are one month into the fiscal year, and they're already over budget, and no disasters have happened. Their budget was cut, and this was expected. Additionally, the new budget did not account for salary increases. They got approval to transition to the Glock and will be receiving 250 guns, probably at the end of this month. They have a 6 -month deadline to send the guns back for the buyback program, or they will have to pay significantly more. Crime Report: Assistant Chief Tavares reported that up to July 31, there were 735 serious crimes, 114 of which were investigated by the Criminal Investigation Units. In July, they received 7,987 calls for service. In Area II, burglaries in Ka'u were mostly in Ocean View and remained constant. Kona had an increase in auto thefts which are being addressed by Patrol. Area I auto thefts in Hilo and Puna are at concerning levels. Eleven people were arrested for auto thefts across the island; nine are still incarcerated. Commission De Luz commended the police department for their leadership in addressing the auto thefts, especially with their special task force. • Traffic Report: Assistant Chief Mitchell Kanehailua reported that in July, they had 88 traffic crashes, 1 fatality, and 103 DUI arrests. 4,632 citations were issued: 2,925 moving/regulatory, 434 seatbelt, 33 child restraint, 1,240 speeding. 61 cell phone citations were issued. They are trying to curb distracted driving. • Commendations of Sworn and Civilian Employees: Deputy Chief Bugado reported receiving 10 commendations involving 26 personnel since the last meeting. Other Departmental Activities: Deputy Chief Bugado reported that the Chief is still contemplating combining the North Hilo and Hamakua Districts. North Hilo does not have 24/7 supervision, and the Hamakua commander made this proposal. It was presented to the North Hilo community and was met with mixed results. North Hilo officers would report to Hamakua for work. They do not intend on closing the North Hilo station. Vice Chair Hendricks reported that before this meeting, Special Olympics presented their Olympic Torch to Officer Paul Mangus for his work with Special Olympics. Hawaii Police Commission Regular Session Minutes August 11, 2017 Page 3 EXECUTIVE SESSION Commissioner Carlson motioned to meet in executive session to consider discipline and charges against officers or employees of the Hawaii Police Department, to consider sensitive matters relating to public safety, and may consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92-5 (a) (2) (4) (6) and the Hawaii County Charter Section 13-20 (b). Commissioner De Luz seconded, and it carried unanimously. Executive session convened at 10:29 p.m. Regular session reconvened at 12:07 p.m. ACTION ON EXECUTIVE SESSION MATTERS (OPEN SESSION) • Consideration and Investigation of Complaints ✓ HPC 17-18: Complainant alleged that voices telepathically told him of an officer. He also alleged that while he slept, an officer used other officers to harass him and make him move. Commissioner De Luz motioned that there was insufficient evidence to prove the complainant's allegations of misconduct, and that action by police personnel was lawful and proper. ✓ HPC 17-20: Complainant alleged that during his arrest for DUI, officers assaulted him. Commissioner De Luz motioned that there was insufficient evidence to prove the complainant's allegations of misconduct. Commissioner Buckman seconded, and it carried unanimously. ✓ HPC 17-21: Complainant alleged that an officer used force on her when they responded to her phone call threatening suicide. Commissioner De Luz motioned that there was insufficient evidence to prove the complainant's allegations of misconduct, and that actions of police personnel were lawful and proper. ✓ HPC 17-22: Complainant alleged that during her traffic stop for speeding, the officer was aggressive and threatening. Commissioner De Luz motioned that there was insufficient evidence to prove the complainant's allegations of misconduct, and that the officer's actions were lawful and proper. ANNOUNCEMENTS • Vice Chair Hendricks announced that the Police Commission's next monthly meeting will be on Friday, September 15, 2017, at 9:00 a.m. in the West Hawaii Civic Center, Building G Conference Room, Kailua-Kona, Hawaii. • Collection of files and documents.
