NOVEMBER 2, 2017 - LIQUOR COMMISSION MINUTES 2 Takaba: Pursuant to Section 92-7, Hawaii Revised Statutes, as amended, Items 1 and 2 are proposed amendments to the agenda and have been determined not to be of reasonably major significance nor does it affect a significant number of persons, and are proposed for placement on the agenda by two-thirds vote of the Commission. 1. New Business, Item Nos. 9, 10, 11, 12, and 13 ADD new paragraphs to read: 9. David Puckett, President, Vice President, Director and Treasurer was present. Puckett: My name is David Puckett. I'm the President, Vice President, Director and Treasurer of Big Island Distillers. Takaba: Have you read your report? Puckett: Yes, I have. Takaba: Do you have any changes to the report? Puckett: No, I don't. Takaba: Ok. Can you describe the business? Puckett: Yes, I'm going to open up a small craft distillery and I'll be the only employee and it's a very small operation. I will bottle at the facility and case and sell to wholesalers and retailers. I plan to market it door to door, basically to bars, liquor stores, possibly to larger chain stores also. Takaba: You're applying for a pub liquor license, right? Puckett: Yes, a pub liquor license. Takaba: A pub liquor license allows you to have recorded music and other things, but your lease doesn't allow that. NOVEMBER 2, 2017 - LIQUOR COMMISSION MINUTES 6 Puckett: Right. Takaba: What do you plan to do? Are you not going to have that? Puckett: Well, I was prompted to mark down a category of some type or another so I chose "A" with some help from the Department here, in the event that I may have some tastings later on. That was the only thing I could really say to put it on as a category. felt that the categories were not really explaining what my business was. Takaba: So, right now there's no conflict? Puckett: No, there's no conflict. Takaba: Do we have any public testimony on this application? There was no reply from the public. Takaba: Commissioners, do you have any questions? Arakaki: I have a question. What kind of spirits are you planning to distill? Puckett: I'm planning to make a whiskey, a honey spirit which could be considered a "moonshine," but I want to get away from the name, "moonshine." I'll also have a vodka with a hawaiian purple potato and honey as the base for the vodka. Takaba: Thank you. Onizuka: Is this for wholesale and retail? Puckett: Yes, as it's been explained to me in a Class 18 license, I have the right to sell wholesale and private, don't I? Takase: Yes. The Class 18 Small Craft Producers License allows a licensee to do everything. It can manufacture, it can sell at retail, it can sell at wholesale, and it can also dispense; it's kind of like an "all in one" license. We also pushed him towards the entertainment part even though his lease doesn't allow it, but there are other licensees in the building that do have it. I think if he does get that changed, he won't have to come back for another hearing; he would already have that category. Puckett: And that was the information I received from the Department before. Michael O'Sullivan, Owner and Tom Whalen, Manager were present. Chu: Good morning, Chair Takaba, distinguished members of the Commission, Director Takase and his terrific staff, and Corp. Counsel. I'd be happier if the Dodgers won, but we're here. My name is Newton Chu on behalf of the applicant Last Call NOVEMBER 2, 2017- LIQUOR COMMISSION MINUTES 8 Saloon, LLC, dba Last Call Saloon. To the left of me, the far left, is the owner Mike O'Sullivan, manager Tom Whalen. We have one change to the Report of the Commission. We'd like to amend our application. Currently, there's a condition on the existing license that amplification from Sunday through Thursday ceases at 9 p.m. We'd like to amend it to ask if we could have that extended to 10 p.m. Takaba: Gerald, you have any comments on that? Takase: I think you're going to have to do a notice to the public. Mike O'Sullivan and Counsel conferred. Chu: All right. We'll live with the current condition, so we don't have to go through with notice of publication. Takase: Since it's a transfer application, you're supposed to take subject to all the conditions that exist. Chu: Yes. We could see how it goes and come in later for a change. Takase: Yeah. Chu: Then I withdraw my request. Takaba: You want to describe the business? What kind of business this is? O'Sullivan: We operate a bar and serve food. We're selling about 65-70% food to liquor. It's pretty much a local, family style restaurant with take-out pizza. Pizza is a big thing. Once in a while, on Wednesday nights, we have open mic night. The problem we had with that is that by 9:00 P.M., when people come from Kona just to play there, by the time they get there, it's around 7:30 and 8:00 P.M., and they can play two songs and at 9:00 P.M. we have to shut it down, and people stop coming in. I may do away with it because it costs me $150 and people aren't staying or coming in to warrant it. Or even change the hours. If we only have three hours, I'd like to change it to 7:00 P.M. to 10:00 P.M. If we keep the time to 9:00 P.M., people just don't have time to get here. We're in the middle of nowhere. Anyhow, it's a local restaurant. We don't depend on tourists. It's nice when they come in, when it's tourist season, but we try to cater to the local people. Takase: Mr. Chairman, this is the old Landings location. When they originally applied for a license, they had quite a bit of dissention in the community. As far as I know, most of the people that were protesting it have left; so it's possible that it came back in. O'Sullivan: I think so. We haven't had any complaints at all. We police it a lot better than the old owners did. NOVEMBER 2, 2017 - LIQUOR COMMISSION MINUTES 9 Takase: It was kind of a front end, "what if" kind of a situation. The Board at that time, imposed a lot of conditions on the licensee. We can work with the Licensee and see what the situation is now. We have allowed other establishments in the area that do have later night entertainment also. O'Sullivan: I think most of the opposition died of old age. Takase: I think they moved away, actually. O'Sullivan: There was one guy who was complaining every night until he finally moved away. We haven't had any complaints at all from anybody. We ask them all the time when they come in, they say everything's fine, and say, "oh yeah—we're great. You guys opened and everything's better." Chu: Ok, we'll come back on that on that issue. Takaba: Do we have any public testimony in this application? If not, we'll go to the motion, because since no one's testifying, we won't be asking any questions. Eric Kim, Property Owner was present. Kim: My name's Eric Kim. I'm a property owner. I'm attending here for Kim & Kang. Sammantha Kang and Jonathan Kim are on the mainland right now. Takaba: Are you the owner of the property? Kim: Yes, sir. They are creating a Korean barbeque restaurant based on 8,000 square feet. The biggest restaurant on the whole island. Their dining room area is around 5,000 square feet, and a patio which is attached to the back area of the dining room is around 2,000 square feet. They are trying to establish the liquor license in the patio area because we have a full bar in the back area. They'll serve in the dining room and the patio areas. The restaurant is currently under construction. We're looking at January for a grand opening. I can also answer any questions on the properties or business wise. Takaba: Have you read the report that was submitted? Kim: Yes, I have. Takaba: Ok. Do you have any changes to the report? Kim: I have one question about their business hours. We signed the lease for hours from 11:00 A.M. to 2:00 A.M., Monday through Sunday, until 2:00 A.M. Does the liquor license allow the business to stay open until 2 A.M.? Takase: Yes. Kim: Ok. Stuart Miller, President was present. Chu: Good morning, Chairman Takaba, members of the Commission and members of the Liquor Control staff. Newton Chu on behalf of the applicant WHR, LLC. To my left, Stuart Miller, President of Tower Development, which is the manager of WHR, LLC, dba Grand Naniloa Hotel, a Doubletree by Hilton. Takaba: Have you read the report? Chu: Yes. Takaba: Any changes? Chu: No changes to make, Mr. Chairman. NOVEMBER 2, 2017 - LIQUOR COMMISSION MINUTES 13 Takaba: Can you describe your business? Miller: WHR, LLC is the ownership group for the Naniloa Hotel. WHR contracts with Grand Restaurant Group, dba Kumu Enterprises to operate the restaurant facilities and also with the hotel management company, Aqua Hospitality. Chu: Aqua Hospitality is headquartered in Honolulu, which adds another layer of communication reports. Stuart and his crew are on ground here in Hilo. The purpose of the transfer is to make it easier to deal with the issues and we're going to legally have the ownership have the license and have direct control. As you know, if you haven't been to the Naniloa, it's a world of difference from the way it was. With the opening of the new restaurant, it looks terrific. I'm not biased, but it looks terrific! We're looking forward to good things for the community. Stuart, why don't you tell them about the plans for the Poly Room? Miller: Through the end of 2017 and early 2018, we'll be doing our engineering and architectural related to the renovation of the Polynesian Room. With the County's support, we'll be renovating the property in 2018. Hopefully by the second or third quarter, we can have our permits in place to allow for the commencement of construction. Takaba: Thank you. Takase: I have a question. Stuart, are all the rooms on the main building renovated now? Miller: Every room is completed and is in service with the exception of two rooms which we're using for our temporary office space. Other than that, all 388 guest rooms are operational and we're near sell-out almost every night. Hilton's doing a wonderful job keeping the project full. Takase: Is the Hamakua side scheduled for renovation, too? Miller: It's complete. Takase: That's done, too? Miller: Correct. We opened at the end of mid-August. Chu: Are they the same rates? Miller: Same rates. Chu: They're really nice. If you have the opportunity, please visit, right? Talk to Stuart to arrange a tour. Takase: Is "Hula Hulas" going to be your only kitchen? NOVEMBER 2, 2017 - LIQUOR COMMISSION MINUTES 14 Miller: There's going to be the three -meal restaurant which is open from 6:30 in the morning til 11:00 at night. It's going to be open 365 days a year and serve three meals, which is our requirement with the Hilton. We have the old banquet kitchen underneath the Kilauea Tower on the Hamakua side. It's on a needs based renovation. If we have enough banquets and catering that are required, we'll move to draw up the plans and start the renovation, end of 2018 or 2019.
