HEARING TRANSCRIPT
FEBRUARY 1, 2018
A regularly advertised hearing on the consideration and adoption of Proposed Findings of Fact,
Conclusions of Law, and Decision and Order regarding the Windward Planning Commission's
denial of the Special Permit application by CELESTIAL SANCTUM 501(C)3 (SPP 17-
000192) was called to order at 9:48 a.m. in the County of Hawaii Aupuni Center Conference
Room, 101 Pauahi Street, Hilo, Hawaii with Chairman Joseph Clarkson presiding.
COMMISSIONERS PRESENT: Joe Clarkson, Donn Dela Cruz, Gregory Henkel, Donald Ikeda,
Myles Miyasato, Thomas Raffipiy, and John Replogle.
ALSO PRESENT: Michael Yee (Planning Director), Malia Ho Hall (Deputy Corporation
Counsel for the Windward Planning Commission), Jeff Darrow (Planning Program Manager),
Christian Kay (Planner), Shancy Watanabe (Planner), and Sarah Hata-Finley (Commission
Secretary).
And no one from the public in attendance.
APPLICANT: CELESTIAL SANCTUM 501(C)3 (SPP 17-000192)
Consideration and Adoption of Proposed Findings of Fact, Conclusions of Law and Decision and
Order of the Commission for denial of a Special Permit to allow the development of a lodge and
wellness retreat center, including healing workshops, wellness classes, yoga classes, a certified
kitchen, and overnight accommodations for up to 21 guests on an approximately 3.926 -acre
portion of a larger 25 -acre parcel of land situated within the State Land Use Agricultural District.
The subject property is located at 18-4271 Luna Ikena Road, approximately 1.3 miles west
(mauka) of its intersection with Volcano Road (Highway 11), Por. of Olaa, Puna, Hawaii,

CLARKSON: Do we have a staff presentation for Item 3 on the agenda?
KAY: Thank you, Mr. Chair. No, there will be no presentation today as the action has already
been taken at the last meeting. Really today is just a review and approval or for the Commission
to make suggested changes to the draft Findings of Fact, Conclusion of Law, Decision and Order
that was requested at the end of the last meeting, and I'd be happy to answer any questions that
you may have on the draft should there be any.
CLARKSON: Does any Commissioner have any proposed revisions or concerns about the draft
Conclusions of Law and Decision and Order? If not, I'm looking for a motion. Do we need a
motion for approval of this text?
HALL: Adoption, yeah.

KAY: Yes.
MIYASATO: Chair, I'd like to make a motion. I move to approve the proposed Findings of
Fact, Conclusions of Law, and Decision and Order for denial of Special Permit 17-000192 which
shall be adopted.
CLARKSON: Is there a second?
IKEDA: Second.
CLARKSON: It's been moved by Commissioner Miyasato and seconded by Commissioner
Ikeda that these Findings and Conclusions be adopted. Shall we have a roll call?
KAY: Yes, I just had one question for Corporation Counsel and actually maybe for our new
Commissioner on the appropriateness of his voting on this. I wanted to make sure he's had an
opportunity to read the record and the recommended Findings of Facts to make sure that it's
appropriate to have him vote.
REPLOGLE: I shouldn't vote.
KAY: Okay. All right. Yeah, sorry, I'll abstain for asking for Commissioner Replogle's vote
on this one. Okay, thank you. Commissioner Miyasato?
MIYASATO: Aye.
KAY: Commissioner Ikeda?
IKEDA: Aye.
KAY: Commissioner Dela Cruz?
DELA CRUZ: Aye.
KAY: Commissioner Henkel?
HENKEL: Aye.
KAY: Commissioner Raffipiy?
RAFFIPIY: Aye.
KAY: And, Chair Clarkson.
CLARKSON: Aye.
