The meeting was called to order by Chair Art Taniguchi at 9:58 A.M., in the
Meeting Room, Department of Liquor Control, Hilo Lagoon Centre, 101 Aupuni Street,
Unit 230, Hilo, Hawaii.

on behalf of the Applicant. To my left is Mandy Kanaiaupio. She's the Manager of Maui
Tacos in the Prince Kuhio Plaza.

Kanaiaupio: Maui Tacos is a Mexican food restaurant. We serve Mexican food, burritos,
enchiladas, and quesadillas. We also currently serve beer and wine.

Takase: Mr. Chair, the Applicant mailed 2 out of 2 notices within 100 feet and 4 out of 4
within 500 feet. There were 2 properties entitled to protest and there were no protests to
this application.

items that are quick and easy to pick up such as groceries, non -edible items as well,
health and beauty items. We also offer food service items.

Taniyan-Makimoto: Basically, it's the same type of business. Convenience store,
selling fuel as well.

Taniguchi: Good morning.
Roberts: Riley Roberts, Partner in the business.
Voorhees: Kurt Voorhees, also Partner in the business.
Taniguchi: Have you read the report? Any changes to the report?
Voorhees: No.
Taniguchi: Can you briefly describe the business?
Roberts: We have a food truck parked outside a brick and mortar. We're using the
brick and mortar as the restaurant, but all the food is cooked in the food truck. The food
truck is permanently located there; it does not move. Our hours are 11:00 A.M. to
8:00 P.M., seven days a week. We have some seating inside and outside. It's a small
lanai with about eight seats outside and four picnic tables located inside.
Taniguchi: Is there any public testimony?

Lopez: "Taproom" implies there are varieties of beers on tap.
Voorhees: The ultimate goal will be to put more variety as we go. The initial
start-up will be smaller, limited to four or less (inaudible) taps inside.
Lopez: But it will be inside the brick and mortar?
Voorhees: Yes.
Lopez: Thank you.
Onizuka: Where is this location?
Roberts: It's in Captain Cook, across the Pure Kona Green Market, before the Manago
Hotel. There used to be the Tie Dye Hobo Shop there.
Onizuka: That used to be the old potato chip place?
Roberts: Yes. It was a chocolate factory at one point. It was a liquor store at one
point.
Taniguchi: Any other questions?
Raymond: You'll be serving inside, but are you asking as well to allow customers to
drink outside since you'll be cooking food from the wagon?
Roberts: The alcohol will be consumed only in the dining area which is inside the
building and the lanai in the back.
Voorhees: The lanai can only be accessed going through the door. There is one main
front door. If they want to drink outside on the lanai, they could only get to it through the
main door.
Raymond: Thank you.
Taniguchi: Any other questions?
Takase: Commissioners, we're seeing a lot more of these food trucks operating as the
restaurant kitchen itself. I'm not sure that our Planning Department rules are up to
speed, but we're working with them to see what we can do to recognize this. For those
of you who travel across the mainland, you'll see more and more food trucks that are
becoming the restaurant. It's an easier way to get into the market and reduce their cost.

Roberts: We had a different plan originally. If you would like to hear it, it's quite an
interesting idea.
Takase: Sure.
Roberts: Kurt has owned food trucks for quite a while in Oregon. He's been building
them himself and running them in locations that are primarily for serving craft beers. In
Oregon, there's a lot of craft beer culture where everyone's brewing their own beer.
The food trucks will park outside of the brewery. I'm not sure how it is here, but in
Oregon it's required that food must be served in order to have alcohol consumption. Is
that how it is here?
Takase: No.
Taniguchi: Not necessarily. It depends on the kind of license.
Roberts: (In Oregon) you have to have the food trucks parked outside to make it okay
to sell the beer without having a kitchen. We've had food trucks at a place called Wild
Ride, and in the city where we're from there's a place called the Lot who does this. Our
initial plan was to have a space like that where food trucks could park. But now it's just
this food truck and the beer.
Voorhees: Moving forward, coming up with another way to deal with it, may be to have
different permits for what we're doing. In Oregon, a lot of people will set up three or four
food trucks around it. A lot of them have a lease agreement with the food truck being in
a permanent location.
Takase: The County started doing some at the Old Airport. They tried to make a food
truck park. I'm not sure what happened with it.
Voorhees: Yes, I was there. There wasn't enough food trucks there regularly in order
to make it worth it. It became more of a hassle. There was a lot of conflict with parking
because of soccer games. It was doing well for about two months then died down.
Taniguchi: I have a question. The caption under the picture in the report says "Food
truck parked where coconut stand is." Is the coconut stand the food truck?
Roberts: I saw it on Google Maps and I think there used to be a drink stand there.
Taniguchi: So the food truck isn't in the picture?
Roberts: The picture was taken long before we were ever there but the food truck is
parked where that coconut stand is, yes. When we saw the place, we thought it was
built for a food truck.
Lopez: Interesting.

Greenwell: Mr. Chairman, do they still have to apply for every venue that they have?
Or is this giving them a free pass to do it once or twice a month, whenever they choose?
Takase: It will be a permanent increase to their property.
Greenwell: But do they still come before us to get the individual venue (approved)?
Takase: No, they won't because this will become part of their premises, permanently.
Greenwell: So we don't care how often they do it?
Takase: That's the question to the Commission, whether you want to allow it or not. If
you want to have them come in and explain what they're doing, we can do that. But if

approved, it will become a permanent increase to their area and they will be allowed to
use that area.
Greenwell: Are they going to be policed every other month? Down the road they may
say, "Well, we're getting by every month, it's real profitable, we're going to do it every
month."
Takase: Potentially they could do it every month, every day. The location is the parking
lot along the south side of the property. It's might be about 15 feet wide and about 60
feet deep, right outside of their roll-out doors. They've had events inside their brewery
area and that spilled out into the parking lot area. They are located in the industrial area
across from My Bar, so as far as noise or anything in the area, it's not really a problem.
They usually have these events in the evening, so there's lots of street parking as well.
We haven't really had any problems with the events they've had so far.
Greenwell: As long as we're not setting a precedence and there's isn't any erosion of
what they're doing here, it's okay. But I just don't want to see this go down the road of
someone else saying, "Well, he can do it, why can't we do it?"
Takase: Well, they can. That's part of their license. They have a Small Craft Producer
license so they have manufacturing, actually all four parts to their license. They can
manufacture, they can wholesale, they can sell, and they can dispense. That's within the
rights of their license. We can still dictate when and where we want them to do it. They
are asking to increase that area to be able to use it as well. The Commission will decide
whether you want to allow it or not. It's certainly within their rights as a Small Craft
Producer Licensee to allow these types of events.
Taniguchi: Mr. Onizuka had a question.
Onizuka: Where is this located?
Takase: It's on Luhia Street where My Bar is. Right across the street. I think it used to
be a furniture store. They have their administrative offices upstairs and in the back is the
warehouse where they're brewing.
Onizuka: Knowing the composition of the kind of bars that we have in that area, I'd like
to see them submit an application each time they use it as a beer garden. Otherwise we
may be opening a can of worms for the rest of the bars in that area that want to use their
parking lots as beer gardens. I think they should submit a request each time they have a
beer garden so that we would have control over that.
Lopez: You said that it's in the evening, so parking shouldn't be a problem and they'd
park on the street. But, is there parking permitted on Luhia Street?
Takase: Yes.

Lopez: There is? Okay. I thought it may be an issue depending on the size of the
crowd.
Takase: Where they're going to be located is actually about half of their parking during
the day. That's where they run their trucks in and out of because that's the warehousing
side. They will have reduced capacity for parking during these events.
Onizuka: I feel that if it's within the building or the space that they're renting, asking for
an increase of licensed premises like a lanai or something, I can see. But to include a
parking lot; I disagree with that.
Lopez: I understand Director Takase made a point. We could ask them to come back to
explain the nature of these events. Personally, I would like to have more information.
We could talk about the impacts at the same time.
Taniguchi: Are they the only tenant in that warehouse?
Takase: Building? Yes, they're the only tenant on that property. They don't share it
with anyone else.
Taniguchi: They won't be taking anybody else's spot, right?
Takase: No.
Taniguchi: But wouldn't they have to get their landlord's approval?
Takase: They are the landlords. They have the lease for that property.
Taniguchi: For the whole parking lot?
Takase: Yes, and when they originally came in, they Noticed the whole parcel.
Taniguchi: So that's a little different.
Takase: Yes.
Taniguchi: Is that the same as the one we approved before? The restaurant in Pahoa?
Takase: Luquin's?
Taniguchi: Not Luquin's. The restaurant that had the other building across their
parking lot but they owned the whole thing.
Takase: Kaleo's.
Taniguchi: Is that the same principle as this?

Resources could be approved to meet their requirements. Part of the renaming of the
entities is now transferring the liquor inventory from the old entity to the new entity.
Taniguchi: It's the same thing, just different name?
Takase: Yes, it's basically the same thing. Their mooring permit was in a different name
so they had to update it, consequently changing the liquor license. But it's basically the
same entity.

Onizuka: I think this is a good example of what we're talking about compared to the one
that we deferred. This is at the Muni and they keep coming back and there's no licensed
premises, there's a patio area, and they could very well apply for a permanent.
Taniguchi: But they have to get the County's approval.
Takase: They don't own that patio area.
Onizuka: But what I'm saying is that at least this way, we have control. We know when
they're using it. With the other one, we don't. This is just a comment.
Takase: To explain this situation, they are actually a Restaurant Licensee and they
probably won't be coming to the Commission anymore because they will just cater there
which doesn't require Commission approval.
Taniguchi: Because they don't serve liquor outside?
Takase: No, they will serve liquor. They are allowed six temporary increases, so they're
going to run out pretty soon. But as a restaurant, they can cater into that area anyway.

On the Mauka side, they have a new County multi-purpose room and they've been given
sole authority to serve liquor in that room. That will all be done under catering permits.
Onizuka: So that patio area will not be used for golf tournaments?
Takase: Actually, the lower and upper one will be used next week for the Hilo Open.
Onizuka: What I'm saying is once they run out of their six ...
Takase: No, what I'm saying is they actually didn't have to keep coming in for a
Temporary Increases because they could just cater out into that area since they are a
Restaurant Licensee. Part of their authorization is to cater off site. It's next door, but
technically it's off site. What I'm saying is you probably won't be seeing them coming in
anymore.
Arakaki: So, technically, they could serve or "cater" outside every day?
Takase: Correct. They would just have to notify the Department that they are.
Arakaki: Your Department?
Takase: Yes.
Takase: And the Department of Parks and Recreation as well, because they need
permission from them. For the upper multi-purpose room the Department of Parks and
Recreation has already signed the lease with them allowing them to be the exclusive
dispenser for that area. For that area they will have to let us know (whenever they are
catering) but they won't have to come back to get the Department of Parks and
Recreation's approval.

IX. Announcements
Taniguchi: Are there any announcements? Director?
Takase: Next month the Mauna Lani Hotel and Resort is coming up for a transfer of the
golf cart operation on the Mauna Lani Golf Course. Shiono's is running the cart
operation on the golf course but they're going to give that up and it's going to go back to
the hotel. I wanted to find out ahead of time if the Commission would waive the Notice
requirements. We actually did it (albeit backwards) with Naniloa. Naniloa is going to go
out for Notice to all the property owners because there was no previous alcohol service
on the golf course. But for Mauna Lani, since they already have beverage service on the
course and it's just transferring from Shiono's back to the landlord, Mauna Lani, I'm
asking if the Commission is willing to waive Notice requirements for them to do this

transfer. Basically, it's been in place. Previously, Mauna Lani was running the
concession; they gave it to Shiono; Shiono can't do it, so they're going to take it back.
It's the same operation; just different owners. If it's okay, I will let Mauna Lani know.
Taniguchi: Commissioners?
Lopez: I personally don't see an issue because it's an existing situation, just changing
hands.
Greenwell: I feel the same way.
Arakaki: I don't have a problem with it.
The Commission was in agreement to waive the Notice requirement.
Takase: We don't have to take a vote. I'll notify them.
Taniguchi: Didn't we just approve Shiono?
Masuda: About three meetings ago.
Taniguchi: It's just going back to what it was before?
Takase: Shiono will still keep the Clubhouse restaurant. They're just going to give up
the carts.
Taniguchi: To the public, there's no change?
Takase: Good question. I don't know.
Taniguchi: Any other announcements?
