CaII To Order The meeting was called to order by Chair Art Taniguchi at 10:02 A.M., in the Meeting Room, Department of Liquor Control, West Hawaii Civic Center, 74-5044 Ane Keohokalole Highway, Building B, 2nd Floor, Kailua-Kona, Hawai'i. Approval of Addendum and/or Supplemental Agenda Taniguchi: We have an addendum to the agenda. Pursuant to Section 92-7, of the Hawaii Revised Statutes, as amended, Item 1 is the proposed amendment to the agenda and has been determined not to be of reasonably major significance nor does it affect a significant number of persons, and is proposed for placement on the agenda by two-thirds vote of the Commission. 1. New Business, Item No. 17, ADD new paragraph to read: 17. Kohanaiki Shores LLC, dba Kohanaiki Club, Inc. (Brewery), pursuant to Rule 4-2-M of the Rules and Regulations of the Liquor Commission of the Department of Liquor Control of the County of Hawaii, State of Hawai'i, requests approval to extend the time issuance of its Small Craft Producer Pub liquor license, Category A, for an additional six months from March 2, 2018, to and including September 2, 2018, by letter dated April 2, 2018. Taniguchi: Can you please identify yourself and your relationship to the business? Wigzell: Yes, I'm Terry Wigzell the President. Taniguchi: Thank you. Have you read the report? Wigzell: Yes. Taniguchi: Are there any changes to the report? Wigzell: No. Taniguchi: Can you briefly describe your business? Wigzell: We're a Mexican, full service restaurant and we serve liquor. We have a license for music entertainment which we use very sparingly. We do full service and take-out. Taniguchi: I know we had one late protest that came in, but, Director, do we have any other protests? Takase: Mr. Chairman, the Applicant mailed 74 out of 92 notices within 100 feet; 87 out of 100 within 500 feet and 1 notice to a condominium cooperative property owner. There were 112 properties entitled to protest and we did receive one protest to this application. Taniguchi: Is there any public testimony on this? There was no public testimony. Taniguchi: Commissioners, questions? Onizuka: In this location, in the past we've had problems? Takase: Yes. This was the old Amethyst location. Amethyst was a nightclub and that was (kind of) their problem. Terry's restaurant has been in operation...he's just really moving across the alley. I spoke with him about what kind of operation he has. He's basically going to run the same operation as he has now. APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 5 They won't have a nightclub restaurant. We will allow them to use the deck area, but only until 7:00 P.M. Wigzell: For any kind of entertainment, you mean? Takase: Yes, out on the deck. Wigzell: Yes. Nothing like that. Takase: So they have a pretty good size deck out in the front and that was creating a problem with the past licensee because (patrons) would smoke out there and the noise going in and out was escaping. We don't anticipate the same types of problems with this Licensee. Onizuka: So, you'd be serving on the deck until 7:00? Correction, no entertainment after 7:00 P.M. on the deck? Wigzell: Right. Well, whatever time it'd get dark, it'd be after sunset. Takase: Yes, because there's no light out there. Wigzell: And any kind of entertainment wouldn't be a band. It'd be like one guy playing out there—acoustic guitar, ukulele, or something like that. Onizuka: And that 7:00 hour is operational for you? You can function within that 7:00 hour? Wigzell: Yes. But I'm not sure what time...in the summertime, I think sunset might be 7:00 or 7:30, so maybe it'd be easier to say 8:00 instead of 7:00. Greenwell: Gerald, I have a question. This here references the old location or the new location? Takase: They were complaining about the old location and they had complaints from the condo about their air conditioner... Wigzell: The chiller which was for the shops downstairs, not us. They've since taken it off and now they just have individual units for the downstairs shops. Greenwell: So, moving your location, does that negate this (protest)? Takase: It actually makes it better for them, because now he's not in... Greenwell: Yes, so this goes away with them moving their location. Is that correct? Takase: Well, I think he's saying that it already went away. APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 6 Wigzell: It already went away because the Landlords took the cooler off. They were very old, so they took that down and put those new individual units that goes into Crazy Shirts, (inaudible), and goes into the deli down there. Takase: So, it seemed he was being blamed for things that didn't really apply to him. Wigzell: Right. Taniguchi: Any questions? Mr. Lopez? Lopez: Yes. Is the front deck area limited to facing the street or does it wrap around at all? Wigzell: Wraps around. From the front, it goes around along the alleyway. Lopez: The full length of your occupancy? Wigzell: Yes. Lopez: And how about on the other side? Wigzell: No, just one side. Lopez: So, you would have guests on the alley side and on the Ali`i Drive side? Wigzell: Yes. Lopez: And you would cease at about 7:00 or at sunset? Wigzell: Yes. Lopez: And it's not a covered lanai that you have now, right? Wigzell: No. It's half covered. There's an awning that comes out. Lopez: Okay, thank you. Greenwell: Not questioning your business, but you're moving because of a better location or because of this complaint? Wigzell: No, we're moving because the building is about 45 years old and it has to be re -done. The Landlords are rebuilding the whole (building). Greenwell: So, it's not because of the complaint? Wigzell: No. APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 7 Onizuka: Getting back to that deck, you're going to have no entertainment after 8:00? Wigzell: Correct. Onizuka: Or no amplified music after 8:00? Wigzell: Correct. There'll be no music outside after 8:00. Onizuka: No music after 8:00? Wigzell: No. Taniguchi: Anyone else? Lopez: Does that call for a modification to the application that says 7:00? Since he'd have to shut down at 7:00. Takase: That was just a suggestion, so the Commission can set a time in the motion. Taniguchi: Instead of a time, maybe "sunset" might be better. Wigzell: Yeah, by the time he breaks down his equipment, it would generally stop by then (sunset). Lopez: I understand. We just don't want someone to hassle you because it says 7:00 and you didn't shut down then. Wigzell: We really try to be good neighbors, respectful to the condos and the people. They're also our customers as well. Taniguchi: Brandon, any suggestion as far as the time matter? Takase: Why don't we just say 8:00? Wigzell: That's fine. Takase: And he's always subject to noise complaints, so we can adjust where we have to. He's been in operation for (inaudible) year and it's not like it's unknown. Taniguchi: We don't have to do anything as far as that? Takase: If you want to set a time, just go to 8:00. Taniguchi: Let's close the public hearing first. Nahale-a: Move to close public hearing. Paul Anderson, Facilities Manager, was present. Taniguchi: Good morning. Anderson: Good morning. Taniguchi: Can you identify yourself and your relation to the business please? Anderson: Yes, my name is Paul Anderson and I'm the Facilities Manager. Taniguchi: Have you seen the report? Anderson: I have. Taniguchi: Any changes? Anderson: No. Taniguchi: Thank you very much. Can you briefly describe the business? APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 10 Anderson: Basically it's going to be either a restaurant or bar with the added, what we call, pilot brewery inside the premises as well. It's a very small brewery that we'll be operating in conjunction with the commercial kitchen which will be, depending upon what the owners end up deciding what their food will be, bar food or more restaurant food. Taniguchi: Any protests? Takase: Mr. Chairman, the Applicant mailed 10 out of 10 notices within 100 feet, 18 out of 19 within 500 feet. There were 14 properties entitled to protest. There were no protests to this application. Taniguchi: Is there any public testimony? There was no public testimony. Taniguchi: Commissioners, questions? Onizuka: Will you be having entertainment? Anderson: Yes. I believe there will be live entertainment similar to what's happened there in the past on the same premises. Onizuka: Have you had any complaints? Anderson: The restaurant itself has been closed for a year and prior to that I wasn't involved directly, in a position that would allow me to know about complaints at that location. Onizuka: For your information, the Department has had complaints previously and we visited the site. The site is open-air, right? Anderson: Correct. Onizuka: The music goes out and a neighbor next door, I guess, (complained). That was a few years back. Anderson: Yes, right. I heard something about that, but didn't know that it was a formal complaint. From what I understand, they've been following the guidelines and I believe they were mailed a notice of this as well. I'm sure if they had wanted to complain, they would have. Takase: Yes, there were previous complaints. As far as we know, they've all been satisfied. Before they closed, we weren't getting anymore complaints about the noise. Ironically, the Oliophonics were the ones being complained about, not the rock and roll. So we haven't had any problems. This is the first one you're going to see like this. They have the Hub Pub in Kohala, but haven't started brewing up there yet. They're trying to APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 11 construct a new building, but as a Class 18 Small Craft Producer, they are entitled to open a second location. That's what this is, and it's the first one we're seeing and it might be the first one in the State to do it. We may see more in the future. We still require them to notice to open. That will be the tactic we're going to take with all of these licensees. They won't have to go through the whole process because they'll have a license, really, from the Hub Pub. And if they go to the second location, we'll have them follow the same process of notifying the neighborhood. Lopez: I'm not sure of the sequence of events. If they've not yet received their approval... Takase: From the TTB? Lopez: Yes. Is that the "cart before the horse" kind of thing here? Takase: In order to brew and sell, they need to get TTB approval. Part of that is they need to know that they have a location. They won't be able to brew until they actually get TTB approval. Lopez: So we could approve it pending the approval? Takase: Yes. Like you'll see with Kohanaiki that comes up later (on the Agenda), it's the same thing. They're still waiting their approvals. Taniguchi: Good morning. Identify yourselves and your relationships to the business. Wong: Hi, good morning. My name is Spencer Wong and I'm the Chief Financial Officer for Kukio Golf and Beach Club. Knable: And my name is Jason Knable. I work as a Paralegal for Carlsmith Ball and I'm working as a Consultant for Kukio Golf and Beach Club. Taniguchi: Have you read the report? Wong: Yes. Knable: We read the report and we have no change. Taniguchi: Can you briefly describe your business? Wong: It's a private equity country club established in 2002, located in the Kona Coast area. It has a membership capacity of 339 members and currently the Club has 278 memberships. Knable: We're here today to ask for your support on the retail component that we're seeking. We've had a club liquor license in effect since 2002 and we understand it's been in good standing. I just want to add this retail component on to a retail shop on premises at the Kukio Beach Club. The additional component that we'd also like to add; we'll be submitting all the proper paperwork before the next hearing in June, is for delivery services to the members' homes and we would like to get your support for that. Wong: If I could add? The membership is composed of very high networth individuals, predominately West Coast based and the average member spends about two weeks per year on property and that's split into two or three visits. They're typically in anywhere from four days or a long weekend to a full week with their family members, and the request for this application is really to just enable them to purchase a bottle of wine or some beer from this 480 square foot retail location to take to their residence. Unfinished Business Taniguchi: Hawaiian Ola Brewing Corporation, dba Ola Brew Co., submits Application for Increase in Licensed Premises, to its parking area fronting the building, for a Beer Garden to be used for special events, and may include a craft market every other month. 1. Na`ehalani Breeland, Director of Marketing/CEO, Ola Brew Co., was present. Breeland: Good morning, how are you? Gonzalez: Good morning. Brandon Gonzalez, Administrative Officer. This matter was continued from the last meeting because the Commission had questions and requested a representative for the Applicant/Licensee present. A representative is here today, but before she answers questions for you, the Department would like to provide you some background information to assist you in your decision-making today. There are no paper handouts because we are trying to be green. Presentation will cover: 1) the current request; 2) a general overview of the Licensee's history; 3) the area the Licensee is located at; 4) and a conclusion. In a nutshell, why are we here? The Licensee is requesting to increase their licensed premises. The nature of their request on the Application is that they want to have a brew yard in the parking lot area. The increased area consists of approximately 3,600 square feet. They already have approximately 10,380 square feet of licensed premises. They indicate the area will not be open to the public everyday. It would be blockaded and only used for special events up to 18 times a year. Examples of the events are music events and APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 16 other special events such as the New Year's Eve party, their anniversary party, and to do craft markets. The Licensee's name is Hawaiian Ola Brewing Corporation, their trade name is dba Ola Brew Co. They are a Class 18, Small Craft Producer Pub liquor license (we call it a super license). They are located on Luhia Street in Kailua-Kona. Their license was approved by the Liquor Commission on January 5, 2017, and it was issued on December 15, 2017. What does a Class 18 enable them to do? They can not only manufacture on premises, they can sell what they manufacture on the premises. They can also provide it to wholesalers to distribute. They can also sell additional products for consumption on the premises. They can also sell, not only to distributors, but to individual consumers for off - premises. They can come in to fill a growler and take it with them. It wraps an alcohol and malt beverages and wine into one (license). You will note within 500 feet of the premises, there are several other bars; Club Korea Barbeque, My Bar across the street, Island Naturals Market is also a licensee. Down Luhia Street, there's also the Mad Marlin and Barcode. There are several licensees in the area. Photos were taken from five different locations; this is in lieu of a site visit. The first photo was taken from Luhia Street looking south. Further south, from the street you would be able to see a big sign that says Ola Brew Company. There is parking along the shoulders. The bike lane is 5 feet, the shoulders are more than 12 feet each, so there is adequate parking along the shoulders for businesses in the area. Looking from across the premises, there is a front parking lot with 5 stalls; 2 of the stalls are dedicated for handicapped parking; they have a bicycle rack; they also have shoulder parking. There is a "No Parking" sign limiting parking along Luhia Street to between 2:00 and 5:00 A.M. to discourage people living in their vehicles on the street overnight. Standing in front of the premises, looking across the street at what type of businesses are located in the vicinity; there is a gym, a guns and ammo store, a ju jitsu place, a pool supply place and toward the south is My Bar, a licensee in another complex. There is Club Korea which is on the second floor, another licensee across the street. On the day I was there, there was a large container truck parked on the shoulder. It's not parked there all the time. Looking down the driveway (of the premises) toward the area of the increase, you will note that the area of increase is below grade, like in a bowl next to the four bays of the operation for Ola Brew Company. There are string lights outside. I noticed the employees park here the majority of the time. They also have deliveries made here. The whole area itself is zoned general industrial. There are no residences in the area. Looking at the businesses directly next to the area of increase, there are several warehouses. There is a physical therapy analysis office, Kapoho Kine Zipline, a APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 17 beachwear company which doesn't appear to be an active storefront rather than a warehouse. Further down there is a church that utilizes the area for gatherings. Down the driveway there's an upholstery shop and behind to the left is more warehouse space for loading and unloading materials. To the left (of Ola Brew Co.) is a vacant lot. The information that they provided on their Application from the beginning is consistent with their request now. They had asked for, initially on the pre -final inspection in October 2017, for the beer garden area on the left to be part of the premises. But, when final inspection was completed, we only approved what was within the four walls. Now they are coming back again to be consistent with their initial plans to have the beer garden as part of their premises. For your information, the Department has historically approved at least three other permanent increases to property for licensed premises; one was Hilo Town and Tavern's tent area that led to their game room outside of their bar; Coqui's Hideaway Restaurant and Sports Bar did a renovation and created an area that extended into their parking lot, approved in 2015; and the most recent one we found was Aulani Asian Cuisine and Cafe's waiting area in front of their front door where they wanted people to be able to consume while they waited for their tables, approved in 2016. This information was compiled by Gail (Fujimoto). Thank you, Gail. In conclusion, we started with an increase of 3,600 square feet outside. Applicant says it won't be open everyday, only for special events 12 to 18 times per year. Taniguchi: Any questions? Lopez: This is in my front yard, so I have a few questions. Taniguchi: Mr. Lopez? Onizuka: Where are the restroom facilities? What kind of restroom facilities do you have? Gonzalez: Maybe the applicant can describe where they are? Breeland: Yes. (Referred to photo) In the middle of the yellow block, there's two squares on the building side, those are two permanent restrooms. We can either make them male and female or unisex. We have two bathrooms there and we also have the two in the tasting room, the taproom. Taniguchi: Okay, Mr. Lopez? Onizuka: Where's the other two? Breeland: Inside the taproom, the already permanent space for consumption. APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 18 Onizuka: So, you would allow people to go into your taproom facility to use the restroom? Breeland: Yes, because it would be on premise. Really, what we're looking for is to be able to hold private events for instance this weekend I hold a permit to have a private event for ninety people. We'd like to hold those permits for larger events like our grand opening event or an anniversary event. Basically, there's different community events such as non -profits that want to hold film screenings or volunteer appreciation and events like that that we're getting requests for and we'd like to be able to accommodate those. Taniguchi: Okay. Lopez: I have a few questions, if you'll bear with me. Where do you put the music? And to your point about what the license proves, I didn't see music on there, but I guess (inaudible). Where would you put the band? Breeland: Yes, depending on the event, we'd either put it in the back where it looks like there are kegs that are stacked at the top (referring to photo) with a huge stage, or what we'll be doing this weekend is actually having it right in the center, parallel to those two boxes (restrooms), we'd have it on the other side of that, and have everything centered around there. Lopez: I understand a food truck is also available. Is that part of your operation at all? Is it independent? How does he know when to come? Breeland: Yes. That's independent of us, but we contract different food trucks to come nightly. The food trucks are actually parking in front of our establishment. Lopez: In the lot or on the street? Breeland: On the street, in that parking area. Lopez: It says in the Application, "Application for Increase in Licensed Premises to its parking area fronting the building..." That threw me, because that's a small space. Breeland: Yes. That's not correct. It's fronting all of our bays. Taniguchi: Your warehouse? Breeland: Yes. Sorry about that. Lopez: So the application has to be modified, right? Because it's not the parking area in front of your building. Breeland: No. Yes, I guess you're right. It's fronting all of our production. APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 19 Breeland: It would be on the weekends, Friday or Saturday. We are thinking that it may be monthly and not every month that we'll have an event. But based on the requests for space... Lopez: But for hours, is it an evening thing? Breeland: Evening probably, but for the craft fair that's in there as well, that would be a daytime thing. The craft would probably be from 10:00 A.M. to 2:00 P.M. or something. But all the other events would be (maybe) 4:00 P.M. to 10:00 P.M. Lopez: With the craft fair, that wouldn't include entertainment, would it? Breeland: Yes, it would have a small band, maybe just one person. Lopez: You said Fridays and Saturdays. So, it would not be on Sundays? Breeland: Oh, I'm sorry, Saturdays and Sundays. Excuse me. Lopez: Because maybe the church group might object? Breeland: Yes. So we could talk with the church about that. But again, if it were Saturday or Sunday evenings, then the church probably wouldn't be in session at that point. Lopez: When I did drive by the parking lot, when I thought it was the front, I wondered how many people... I've not been there, but I understand it is very popular and a lot of people go to these events. So, how many people could you cram in that alleyway? Breeland: For our opening event, we had about 600 people at a time. It was a good size, but then there was our New Year's event with about 450 people. It was very spacious. For these events that I'm talking about, we're looking for 100 people, even 40 people. I would rather not pull a permit every time, since we have six permits per year for those. Lopez: Thank you very much. I believe that answered my questions. Taniguchi: Question? Raymond: Yes. You talked about food trucks in the front. Is someone controlling or watching over purchasing of alcohol and then getting the food from the food truck and then walking? Breeland: Absolutely, yes. And are they licensed and the revenue streams (inaudible)? Takase: We wouldn't really look at the food operation since it's not part of theirs. The only time that we do get involved with the food is if it's a restaurant license because they have to meet certain minimums. Outside of that, we wouldn't get involved in who she brings as a food truck. Lopez: Even though they're contracting the service? Takase: Yes. Because their license was not dependent upon food. Lopez: Okay, thank you. Onizuka: Question to the Department. Is there any of Board of Health regulation as to how many restroom facilities you need for a certain amount of people? Takase: Not that I know of. Onizuka: You're talking like, she said 600 people and you only have two male and two female restrooms. Breeland: During those events, we actually rented six lua for those occasions from Kona Lua. Lopez: And they were also in that space? Breeland: Yes. And (inaudible). Nahale-a: Are you looking to permanently cordon off this area, or still utilize it for your staff parking? Breeland: We'II utilize it for staff parking during the week and when we do events, which is very temporary, we'll actually... For past events, we put barricades at the very top which indicated that's the premises where you can consume alcohol. For different sizes of events, we may barricade lower in the parking lot so that there is still area for people to come. Nahale-a: And there's no exit or entry from the lower part? APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 21 Breeland: There's a drive -around. Nahale-a: Oh, there is a drive -around. But you have used barricades? Breeland: Yes. Nahale-a: Okay, thank you. Taniguchi: Mr. Greenwell? Greenwell: I want to commend Brandon on the slide presentation. He did a good job. The Commissioners agreed. Greenwell: I'm glad you had all the answers. But what concerns me a little bit is with these large groups of people, how is it controlled and kept in control? As Mr. Onizuka brought up, you have two bathrooms or four bathrooms for...how many people are you allowed in the building vs. how many you're going to have outside? Is there control of a large group of people like this? Breeland: Yes. Greenwell: You absolutely have control? Breeland: Yes. During our larger events, we hire security. For instance for our grand opening event and for our New Year's Eve event, we hired ten security from Viking Security until we make sure it was all regulated and that everything was supported and then again, for the lua, we had Kona Lua, we got four different restrooms, no sorry, six different restrooms that we rented for those occasions. Nahale-a: But that's only a couple times a year that type of event...you're saying generally, it's twice a year. Breeland: Yes, exactly. For those large events, we'd like to have our anniversary party. I don't anticipate that our anniversary party this next year is going to be as large as the opening. We were surprised that many people came. But we were definitely prepared with security. For the events that I'm requesting to increase premises for, it's going to be 45 people or 100 people. We just want to be able to offer the space to the community. Greenwell: I hear what you're saying, but we as a Commission, are giving you a very broad license. You can tell me it's 45 people. You told me it's 600 people. Now you've got a crowd there, and what if there's a problem with enforcement? Then you tell me you have security to help you. I just don't want this to mushroom into something else if your neighbor, My Bar, asks for the same thing. APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 22 Breeland: Right. So, (referring to photo) this is all of our business. Every single bay here, we occupy. With the My Bar parking lot, there's multiple businesses in that one area. Greenwell: I'm using My Bar as an example. But you're asking for an extension of...does it pass the fire code with the number of people that you have in this confined area? I don't know. I just don't want this Commission to give you a very broad permit. Breeland: If I could make a suggestion? On our larger events, the ones that might happen once or twice a year, I would be happy to still run it by the Commission every time. If we're getting this permanent increase, then I know that I'm able to do these smaller events of 45 or 100 people, and with those larger events I'm able to come back and speak with you about those. Taniguchi: I think Mr. Greenwell had a good question. I have a question for the Director. For previous big events she had to come in for a license, right? Takase: Yes. Taniguchi: Did they tell you how many people they anticipated? Takase: I think it was on there, yes. Breeland: Yes. Taniguchi: So, let's say if it was like you said, 400, do we have any requirements of the Licensee? In other words, if they're going to have a big event, 400, do you have a (inaudible) list of things that they have to follow like hire so many security or whatever? Takase: Nothing permanent. The investigators will usually work with the licensee to give them ideas of what they want to do. But we don't say, "for every hundred you have to have..." Taniguchi: So if we were to approve it, and you find all kinds of problems, we can still pull it, right? Takase: Yes. Taniguchi: That's my question, because I think what she's suggesting, if it turns out to be not what she's saying, we would have the ability to readdress it? Takase: Yes. And it's something that's always in flux. Any time she has an event, investigators usually go by to check it out. APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 23 Breeland: And it is also in our best interest to have the right security on premises, too. So we definitely are not trying to cut corners. We want to make sure that everybody's safe in our area. Taniguchi: Mr. Lopez? Lopez: Mr. Greenwell hit on something that I'm going to ask about, and it's about the safety issue. I know fire marshalls have a real handle on how many you can jam into a given space for reasons of emergency. Have you cleared that? Breeland: Yes. Lopez: You have a permit or something? How many people is that limited to, for this expanded area? Breeland: I don't have that information on me right now, but I do know that we have it. The amount of people that we've had in that area was always approved by Fire, or we wouldn't get a building... Lopez: But you said you were surprised when 600 came. Nobody anticipated that, right? Breeland: Right. Well, no. On our increase for temporary permit application, I think I put 800 and it was approved. Lopez: So the Fire Marshall has approved the 800? Breeland: Yes. Yes. It's a lot of people, but yes. Lopez: In this application, did the neighboring businesses have opportunity to...were they notified? I'm thinking of the church, again, and on Sundays. Takase: No. They were notified on the original application. They had applied for their entire parcel. There was no need to go back out to them. Churches really shouldn't be in an industrial area either, and they have to go in for special permits to get approved. It's been a problem but I think they're enclosed, too, so even if they had an event outside, I don't know that it would create a problem. Lopez: But part of our mission, and we've done it consistently, is to try to promote being good neighbors. So it may behoove you to go and talk to them. Breeland: Talk to them? Okay. Takase: Yes. They know that they're there and they've had events but I guess not a Sunday event. APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 24 Nahale-a: I have one more question. It sounds like your smaller events are going to be related to other businesses? Not public? Breeland: Yes. Not public. Nahale-a: So the people who attend would be part of a company or something like that? Breeland: Yes, exactly. For instance this weekend we got approved for a temporary increase for 95 people. I might've put 100 on the application. It's a company party, so it's a private event. Nahale-a: Thank you. Takase: We're starting to see more and more of these brewery tours and things and them holding special events at their property. It's a different venue and especially for organizations who are always looking for someplace new and different to hold their events at, so that's what they're providing in this instance. Kona Brew has it now and they're actually going to expand, although I don't think they're going to run events out of their new facility because they can still increase the size of the old facility once they move out. But it's something that's coming. Same with the license. Gonzalez: I'm not sure if the representative officially got to introduce herself before she started talking. Breeland: Sorry. Taniguchi: Moved and seconded. Discussion? Taniguchi: Any good reason why? Onizuka: Yes. I think the purpose of the Commission and the Department of Liquor is to control the consumption and the liquor laws. If it is within a structure, I can see. But when you're trying to ask for a permanent increase in premises of a parking lot to hold special functions, I don't think that works in my mind. We have a lot of bars in Kona that occupy small spaces and they'd love to have their parking lot as a licensed premises. But I would agree to having special permits maybe on a quarterly basis at the most, but nothing on a permanent basis as a licensed premises for a parking lot to hold functions. think the Department has to hold control over all of these functions and know what's going on and the Commission should be kept aware. I strongly feel that that doesn't work in Kona. I realize that we approved some things in the past, but that was like a waiting area inside of a restaurant. It wasn't giving them the free run of a parking lot to hold functions. I strongly believe that here in Kona, we have a lot of problems if we give them a free run on the parking lot as a licensed premises. So, I strongly oppose giving this increase in licensed premises of a parking lot on a permanent basis. Taniguchi: Anybody else? Nahale-a: If they have to come in for permits every time, they're limited to...? Takase: Six. Nahale-a: So that would cut the intended activities in half, at least. Takase: They can come in and ask for further ones if they wanted to. But past six would come before the Commission. Greenwell: I'd like to second everything that Mr. Onizuka said. I have no problem with them coming in and asking for permits. I don't really think that the size of the function is our responsibility. If it's a very large function, then the Fire Marshall should step in or Planning should step in. But, I still do not feel that we should give them a free permit to have an unlimited amount of functions with an unlimited amount of people. Taniguchi: Anybody else? Nahale-a: Is it within our purview to put a limit? So we could approve a license for them up to 100 or something like that? Onizuka: That would come in as a special request from them. APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 26 Takase: Well, they can... Taniguchi: They can do a blanket and then anything over, they can come in for a special. I have something to add, too. Contrary to what Mr. Onizuka said, when I look at a business, you don't want to strain a business. If they have a business model and they want to try something, try to be a good neighbor, provide an alternative for the public, I think if it goes overboard, we can shut it down immediately. But to restrict a building owner...My concern the last time we heard it was that, how is it going to affect the other people if you block off the whole parking lot. But in their case, they control the whole parking lot. I don't know if you own it or you're leasing it, but from my standpoint, you control that whole place, you control the activities within that place and that should be up to me as the business owner. If I'm irresponsible, I'm going to lose that right. But to have somebody saying this is how you have to run your business, and I would argue the fact that if they came in for the special permit each time, they'd probably get approved anyway. Let's not strangle anybody. I can see Mr. Onizuka's point. Coqui's built out, right? On the mainland, you walk down sidewalks and have restaurants serving beer and all that on the sidewalks and they can open it up during the night. If that's the trend that's coming, then we have to look at it. But how are we going to really know if it can work or not unless we try to see how it goes? If you control the whole place, and you're a responsible business in that area, you'll face the consequences if you don't follow the rules or you don't be a good neighbor. We deal a lot with businesses in my former career and you like to see them succeed. They come up with a novel idea and if we restrict them, fine. But if they came in for these special events this month, they'd probably get approved. It's just a hassle for the business to have to do it over and over again. That's just my two cents. Onizuka: I think we're not trying to restrict their business. I think we have a responsibility to be aware as a Commission and a Department as to what functions are going on with our licensees. Therefore I'm saying we cannot give somebody a free run of their business. I mean, they can do what they want, but they have to apply with us so that we know what functions are being held. We're not saying that we're not supporting their business. We are, but we want to be in control of that and that's our primary purpose as a Commission and a Department. We have to keep control of what's happening with our Licensees. Taniguchi: Anything else? Comments? Nahale-a: I would like to speak in support of Chairman siding more on the business supportive side. I see the point of Commissioners Onizuka and Greenwell. For me, the fact that this particular area is lower than street level and has a retaining wall on one side and the building on the other side, and they have procedures in place for containing the area, makes it more palatable for me. I would suggest that maybe as part of the license we put some restrictions on it to address the concerns of the other Commissioners. It could be limited to private functions and limit number? And for public functions or events larger than a specific number, they have to come before the Commission? APRIL 5, 2018 - LIQUOR COMMISSION MINUTES 27 Taniguchi: Okay. Comments? Hughes: First of all, I'm one of the newer members. Taniguchi: That doesn't matter (inaudible). Hughes: I just want to state a fact that I'm pro-business, and I applaud you to come and ask for permission to do something to expand your business. I think it's a great idea. I agree with all the Commissioners' comments. Listening to what Art said, followed by Shelby, I do agree that we should offer you something instead of coming here every two or three months and asking for permits or coming to Gerald asking for a quick temporary permit or whatever. I think it's a waste of time. I see that you're looking to bring in smaller groups of people. It is a contained area in an industrial area. No neighbors, shouldn't be any noise complaints if you do have somebody playing music. There is a trend coming and I think all the Commissioners need to realize that there's going to be some changes coming. This micro pub thing is huge. I'm originally from Michigan and we had maybe one or two brewers, now there's I think over a thousand in the state. Every little town has its own little brew pub now. They all want to have a beer garden or something outdoors. So, it's something that's a trend that's coming across the United States and it will be here. With the tourist industry and the locals as well, we need avenues for people to go and enjoy a beverage and be safe and this is, in my opinion, a safe and contained area and a good location.
