I hope my letter will address your concerns as well as the concerns you have in a similar letter the Finance Director received. Milolii Beach Lots have private roads. County tax maps (also known as plat maps) do not indicate whether the roads are paved, unpaved or what the type of access there is. The areas listed on the plat map reflect the parcel areas and represent what was designated as area for roadways and in this case by the developer as these roads are private. The Milolii Beach Club Association II owns the roads in the subdivision. Attached is an older image of approximately where the roadway you mentioned ends, however, the association does have the area available in case someone or the association wants to construct the road. At the time when assessment notices are prepared (in February) and mailed in March, we do not know what the tax rates will be as the Hawai'i County Council has up to June 20 to change it. The assessment notice does not indicate the actual tax amount. The minimum tax was at that time $100, however, it was changed to $200 on June 5, 2017 (second reading of the Hawai'i County Council, copy attached) with an immediate effective date which began on the July 1, 2017, tax year. You also indicated you did not appeal as you believed taxes would be $100 for minimum tax. The current basis for appeals are: 1) the assessed land or building value; 2) exemption; 3) property classification (which would be the applicable tax rate); or 4) other County of Hawaii's an Equal Opportunity Provider and Employer May 18, 2018 Page 2 Typically we do not see the actual tax amount as one of the areas as the basis to submit an appeal, however, when you receive your assessment notice in March, you are given the opportunity to submit an appeal to the Board of Review by April 9 of that same year. Last noted on your letter was your request to have the Hawai'i County Council allow you to pay property taxes at the same rate that is charged to agricultural rated parcels. Parcels with the agricultural rate also have the same minimum tax of $200. There are no parcels with the agricultural rate paying less than $200 per parcel. The County Council of flawai`i County, in seeking to create a more equitable distribution of County revenue collections amongst all property owners, increases the minimum tax and the minimum tax of graduated scale based assessments. SECTION 2. Chapter 19, Article 11, Section 19-90, Hawaii County Code 1983 (2016 edition, as amended), is amended by amending subsection(e) to read as follows: (e) Notwithstanding any provision to the contrary, there shall be levied upon each individual parcel of real property taxable under this chapter, a minimum real property tax of$[-1-00-] 200 per year, except under the following conditions: (1) If the property owner receives a home exemption or totally disabled veteran exemption resulting in the minimum tax, and the assessed value of improvements is less than or equal to $75,000, then, the minimum tax for this property shall be as follows: (i) Property with improvements assessed at $50,001 to $75,000 the minimum tax shall be $[75]150. (ii) Property with improvements assessed at $25,001 to $50,000 the minimum tax shall be $F5-01100. (iii) Property with improvements assessed up to $25,000 the minimum tax shall be $[25]50. (2) If the property is assessed at a market value of less than or equal to $500, it shall be-taxed-at-a-minimum-tax-of—$[2-5] no tax shall be applied. SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. I I, SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the provision or application, and, to the end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon approval.
