HomeMy WebLinkAbout2018-03-16 Police Commission Regular MinutesHAWAII POLICE COMMISSION REGULAR SESSION MINUTES MARCH 16, 2018 WEST HAWAII CIVIC CENTER The meeting was scheduled for 9:00 a.m. However, due to the late arrival of Commissioner Carlson, the commission did not have quorum. While waiting, they heard reports from the police department since no action was needed by the commission. Present: Peter Hendricks, Chair Jak Hu, Commissioner Keith Morioka, Commissioner Colleen Pasco, Commissioner Also present: Kenneth Bugado, Deputy Police Chief Marshall Kanehailua, Assistant Chief Mitchell Kanehailua, Assistant Chief James O'Connor, Assistant Chief Burt Shimabukuro, Captain Malia Hall, Deputy Corporation Counsel Josie Pelayo, Secretary POLICE CHIEF'S REPORT ON DEPARTMENT ACTIVITIES Crime Report: Assistant Chief Mitchell Kanehailua reported that up through February 28th, there were 5,532 serious crimes. The Criminal Investigation Units investigated 969 of those cases. There were two shootings of police officers. One did not hit the officer. The suspect was identified but not arrested. In the other shooting, the officer was hit on the leg, and the suspect was arrested. Domestic calls remain consistent every year. There were no crime trends. For the month of February, the department received 8,166 calls for service. Traffic Report: Assistant Chief O'Connor reported having 4 fatal crashes for the calendar year. In February, 4,710 citations were issued: 3,229 moving/regulatory, 268 seat belt, 17 child restraint, and 1,196 for speeding. There were no traffic trends. Personnel Report: Assistant Chief Marshall Kanehailua reported that the 87th recruit class started with 22. It's now down to 18. Eleven members of the 86th recruit class started solo beat last night. They are on target to start the 88th recruit class in April. There were two lieutenant promotions. They have vacancies for majors, PO II, and PO III. A sergeant in traffic services was moved to records, and he will be in charge of body -worn cameras. They will start a new dispatch class with 4 people. The number of applicants is small. Dispatchers work a lot of overtime, and the work is not attractive. They are working on a new dispatch center which they hope will be more conducive for the job. They will run a public service announcement for school crossing guards. Hawaii Police Commission Regular Session Minutes March 16, 2018 Page 2 Finance Report: Assistant Chief Marshall Kanehailua reported that they didn't submit any new CIP projects because last year's list is good for two years. In additional to the budget cuts already made, they were told to cut an additional $130,000 out of the budget. In the last series of cuts, they told Finance they couldn't make any more cuts, but County Finance made cuts. They cannot stop police services. Commissioner Hu requested an updated CIP report. • Commendations of Sworn and Civilian Employees: Deputy Chief Bugado reported received 9 commendations involving 27 personnel since the last meeting. Other Department Activities: Deputy Chief Bugado reported that Chief Ferreira was at a meeting in Honolulu. He reported that he represented the Police Department at a Chamber of Commerce luncheon the day before. In discussions about the homeless, people said they could see the difference in the old airport area and were satisfied. He commended officers island -wide for handling the homeless issue. He was asked why the county wasn't supplying officers with bullet proof vests and long rifles. He agreed with the man, but this is a funding issue. Assistant Chief Marshall Kanehailua stated that their vests meet the minimum standards, has sufficient protection, and it has to be comfortable to wear 6-8 hours in a vehicle. Deputy Chief Bugado stated that the State's 911 Board is responsible for all dispatchers in the state. They are looking at a statewide curriculum for training at the college. The Mayor said the new dispatch center is a priority for him. He recently attended a workshop on counter terrorism which came out of the false missile alert. Homeland is providing a 3 -year grant for government agencies to conduct mock exercises. Chair Hendricks asked Deputy Chief Bugado if he could comment on the missing evidence case that was reported in the news. Deputy Bugado stated that he cannot comment on it because it is an on-going investigation. Commissioner Pasco asked if the police have concerns about the number of semi- automatic firearms on this island. Deputy Bugado stated that they are concerned about any weapon. It's out there and has to be registered. They have been doing active shooter presentations for a while. The police department's website has a link to the most current active shooter information. Most gun owners are law abiding. Commissioner Morioka asked what the police department's position is on the President's position on having armed personnel in the schools. Deputy Bugado stated that they are not in favor of it. School Resource Officers (SRO) are in schools for mentoring, not for security. AC O'Connor stated that with armed teachers, officers wouldn't know that person is a teacher. They cannot take someone's word. Commissioner Pasco stated that the National Teacher's Association is against it. Hawaii Police Commission Regular Session Minutes March 16, 2018 Page 3 Chair Hendricks recognized Commissioner Keith Morioka for his five years on the commission. His term has ended, and this was his last meeting. Recess was called at 10:00 a.m. Commissioner Carl Carlson entered the meeting at 10:15 a.m., and a quorum was present. CALL TO ORDER Chair Hendricks called the meeting to order at 10:18 a.m. ROLL CALL A quorum was present with Commissioners Hendricks, Carlson, Hu, Morioka, and Pasco. Absent were Commissioners Buckman, De Luz, and Paiva. APPROVAL OF AGENDA Commissioner Morioka motioned to approve the agenda. Commissioner Carlson seconded, and it carried unanimously. STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS (None.) APPROVAL OF MINUTES February 16, 2018, regular and executive sessions: Commissioner Pasco motioned to approve the minutes. Commissioner Morioka seconded, and it carried unanimously. UNFINISHED BUSINESS • State of Hawaii Police Commissioners' Conference hosted by Hawaii County (update): Chair Hendricks stated that the conference will be held May 21-22 at King Kamehameha Beach Hotel in Kona. Mr. Callery from the DEA will be the keynote speaker on the first day. Mayor Kim will give opening remarks. Review of the Police Commission's Rules and Regulations for possible revisions: Deputy Corporation Hall distributed another revision. She explained the changes. The commissioners agreed on the 60 -day deadline for filing a complaint with a consideration for late filing between 60 and 90 days. Ms. Pelayo stated that many years ago when the filing deadline was extended, there was concern that the longer a person waits, the less a person will remember. Commissioner Carlson stated that filing a complaint should be urgent. Additional suggestions are to be sent to Ms. Hall. CHAIR'S REPORT ON OTHER POLICE COMMISSION ACTIVITIES (None EXECUTIVE SESSION Commissioner Morioka motioned to meet in executive session to consider discipline and charges against officers or employees of the Hawaii Police Department, to consider sensitive matters relating to public safety, and may consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, Hawaii Police Commission Regular Session Minutes March 16, 2018 Page 4 and liabilities pursuant to HRS 92-5 (a) (2) (4) (6) and the Hawaii County Charter Section 13-20 (b). Commissioner Hu seconded, and it carried unanimously. Executive session convened at 10:32 a.m. Open session reconvened at 11:06 a.m. ACTION ON EXECUTIVE SESSION MATTERS Complaint HPC 18-02: Complainant alleged that during her arrest, officers used force and wouldn't handcuff her in front as she requested. Commissioner Hu motioned that there was insufficient evidence of misconduct, and that the officers' actions were lawful and proper. Commissioner Morioka seconded, and it carried unanimously. ANNOUNCEMENTS Chair Hendricks announced that the commission's next monthly meeting is scheduled for April 20, 2018, at 9:00 a.m. in the Aupuni Center Conference Room, 101 Pauahi St., Hilo, Hawaii.
