CALL TO ORDER
Chair Hendricks called the meeting to order at 9:03 a.m.

APPROVAL OF AGENDA
Commissioner Paiva motioned to approve the agenda. Commissioner Carlson
seconded, and it carried unanimously.
STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS (None.)
APPROVAL OF MINUTES
April 20, 2018, regular and executive sessions: Commissioner Paiva motioned to
approve the regular and executive session minutes of April 20, 2018. Commissioner
Carlson seconded, and it carried unanimously.
UNFINISHED BUSINESS
• State of Hawaii Police Commissioners' Conference (update): Chair Hendricks
reported that everything for the conference is set, and the speakers are in place.
• Review of the Police Commission's Rules and Regulations for possible revisions: Ms.
Hall distributed the revision to Rule 6 which she patterned after the Maui Police
Commission's rules. She explained that she wanted to simplify it by keeping the 90 -
day deadline and not hearing anything after 90 days. Commissioners Paiva and Hu

liked having a definite deadline. Vice Chair De Luz wanted to be consistent with the
Police Department. Chief Ferreira stated that they do their reviews independent of
the commission. For the most part, they will investigate up to one year, and
sometimes later depending on the circumstances. Chair Hendricks stated that he
also likes having a definite timeline for filing the complaint. He wants to finalize it and
vote at the next meeting_
CHAIR'S REPORT ON OTHER COMMISSION ACTIVITIES AND INTERESTS
Chair Hendricks thanked the Police Department and all responders for their work with
Madame Pele.
POLICE CHIEF'S REPORT ON DEPARTMENT ACTIVITIES
Including, but not limited to:
• Crime Report: AC O'Connor reported that up through April 30, 2018, they had 6,805
serious crimes. The Criminal Investigation Units investigated 1,209 of those cases.
There were no crime trends. For the month of April, the department received 8,186
calls for service, fiscal year-to-date it was 84,725. Commissioner Paiva asked for a
comparison with the previous year.
• Traffic Report: AC O'Connor reported that fiscal year-to-date, they had 20 traffic
fatalities, 10 were DUIs. They had 101 DUI arrests. For the month of April, 5,044
citations were issued: 3,750 moving/regulatory, 257 seat belt, 18 child restraint, and
1,019 speeding.
Commissioner Paiva asked if the situation in Puna is taking away from patrol. AC
O'Connor stated that if you are assigned to patrol, that's what you do, you enforce
traffic laws. Deputy Chief Bugado stated that traffic enforcement is still continuing
with what they need to do. They have been called to assist with calls for speeding
and traffic problems as a result of the lava.
• Personnel Report: Deputy Chief Bugado stated that with the latest recruit class on
the road, they have 7 vacancies. 31 officers are eligible for retirement. They have
two ongoing recruit classes. On June 16, Captain Jelsma will be promoted to Major of
Area I Operations and Captain Burian to Major of Technical Services. They will open
a new recruitment at the end of May. They have a lot of applicants, but finding the
right person is difficult. At the end of June, they will be testing to establish a list for
lieutenants_ Testing for sergeants will follow.
• Finance Report: Deputy Chief Bugado stated that their budget is targeted at 87%.
They were already over their budget in overtime before the lava event.
Communication and equipment is important. They do not yet have masks, but they
are on order. They had complaints a few days ago of three officers experiencing
chest tightness due to the air quality at a roadblock. The National Guard is there to

assist with evacuation and patrol. They are a supplement for the police department.
Police officers answer to the police department. The National Guard responds to their
commander. At the EOC (Emergency Operations Center), each agency has their own
table, and they are able to communicate directly with each other.
Commissioner Carlson asked how they would make up for the budget shortfall if this
event continues. Chief Ferreira stated that they could go to the county to adjust their
overtime budget. The county could look to FEMA for reimbursement.
Reimbursements would go to the county's general fund. Emergency funding will
come from the County Council. The Legislature is looking at a special session to
address this. Hilo and Puna Patrols are working 12 hours on, 12 hours off. They will
maintain this schedule for as long as needed. The dynamics of this eruption is
different from Kalapana which they watched come down the hill. In this case, they are
dealing with the actual lava itself, the SO2 gases, the ground cracking; it's constantly
changing. The role of the National Guard is support, not law enforcement.
• Commendations of Sworn and Civilian Employees: Chief Ferreira reported receiving
four commendations since the last meeting.
• Other Department Activities: Chief Ferreira reported that the 87th recruit class of 17
members will have its graduation ceremonies on August 15. Councilman Richardson
has recommended an increase in police salaries and wages. Management staff gets
an increase whenever SHOPO gets an increase. The Chief and Deputy get an
increase only from the Salary Commission.
EXECUTIVE SESSION (Closed session.)
Commissioner Hu motioned to meet in executive session to consider discipline and
charges against officers or employees of the Hawai'l Police Department where matters
affecting privacy will be involved, to consider sensitive matters relating to public safety,
and may consult with Corporation Counsel on questions and issues pertaining to the
commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92-5
(a) (2) (4) (6) and the Hawaii County Charter Section 13-20 (b). Commissioner Carlson
seconded, and it carried unanimously. Executive session convened at 9:50 a.m.
Regular session reconvened at 11:02 a.m.
ACTION ON EXECUTIVE SESSION MATTERS
Investigation of Complaint HPC 18-10: Complainant alleged that during an investigation,
officers questioned her at work which made her feel humiliated and defamed.
Commissioner Carlson motioned to refer the complaint to the Chief for further
investigation and also for customer service, procedural, and operational concerns.
Commissioner Hu seconded, and it carried unanimously.

ANNOUNCEMENTS
Chair Hendricks announced that the Police Commission's next monthly meeting is
scheduled for June 15, 2018, at 9:00 a.m. However, due to a lack of quorum, the
meeting will be changed to June 8, 2018, at 9:00 a.m., in the Aupuni Center Conference
Room, 101 Pauahi St., Hilo, Hawaii.
ADJOURNMENT
The meeting was adjourned at 11:10 a.m.
