HomeMy WebLinkAbout2018-06-08 Police Commission Regular Minutes H REGULAR SESSION MINUTES JUNE 8, 2018 AUPUNI CENTER CONFERENCE ROOM 101 PAUAHI ST., HILO, HAWAII CALL TO ORDER Chair Hendricks called the meeting to order at 9:03 a.m. ROLL CALL Present: Peter Hendricks, Chair Wayne De Luz, Vice Chair Arthur Buckman, Commissioner Carl Carlson, Commissioner Jak Hu, Commissioner Paul Paiva, Commissioner Colleen Pasco, Commissioner (A quorum was present.) Also present: Paul Ferreira, Police Chief Kenneth Bugado, Deputy Chief J Burt Shimabukuro, Captain Malia Hall, Deputy Corporation Counsel Josie Pelayo, Secretary APPROVAL OF AGENDA Vice Chair De Luz motioned to approve the agenda. Commissioner Paiva seconded, and it carried unanimously. STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS (None.) APPROVAL OF MINUTES May 18, 2018, regular and executive sessions Commissioner Paiva motioned to approve the minutes with a non-substantive correction on the fourth page of the executive session minutes. Commissioner Buckman seconded, and it carried unanimously. UNFINISHED BUSINESS Review draft of changes to ulations: Ms. Hall distributed the latest revisions. They will have a public hearing on the revised rules and will give a 30-day notice of the hearing. Chair Hendricks stated that he had some thoughts about anonymous complaints. that her thoughts are that if it is against an officer, it should be notarized. Regular Session Minutes June 8, 2018 Page 2 Commissioner Carlson stated that if it is anonymous, it comes to the commission as correspondence. The Chair and Vice Chair should decide how to handle it. Ms. Hall stated that it would be part of the administrative duties of the Chair and Vice Chair. No one wanted to add this into the rules. HER COMMISSION ACTIVITIES AND INTERESTS Chair Hendricks thanked Commissioner Hu and the staff of the Courtyard Marriott King Kamehameha Beach Hotel for their help with the State of H REPORT ON DEPARTMENT ACTIVITIES Written reports were distributed and items highlighted: Crime Report: Assistant Chief Mitchell Kanehailua reported that up through May 31, 2018, there were 8,323 serious crimes. The Criminal Investigation Units investigated 1,325 of those cases. Hilo had a decrease in auto thefts. Puna had an increase in burglaries. There were a few arrests for looting in lower Puna, but not the chaotic numbers seen on social media. Kona had an increase in auto thefts and a decrease in burglaries. Hawaiian Ocean View Estates had an increase in burglaries. Suspects have been identified, and they actively patrol the area. For the month of May, they had 8,605 calls for services which was a 10% increase since the start of the lava flow. Commissioner Pasco stated that she has seen an increase in people in Kohala and asked if they are lava evacuees. AC Kanehailua stated that according to the Captain in Puna, evacuees have moved to Ko Traffic Report: for the month of May, 5,019 citations were issued: 3,574 moving/regulatory, 344 seatbelt, 25 child restraint, and 1,076 speeding. Year-to-date, there was a decrease in traffic fatalities over the previous year. Personnel Report: Deputy Chief Bugado reported that by the end of the month, they will have 12 sworn vacancies. Captain Ishii will be retiring. They anticipate more thth retirements in the next three months. The 87 and 88 recruitment classes are ongoing. They have a target date of November 1 to start another class. Dispatch has 5 vacancies. Two dispatchers are on extended leave, one is on intermittent leave, and one took a downgrade to clerk in CALEA. Dispatch is a difficult job. They are in an enclosed room dealing with irate people. They are waiting for improvements to the dispatch center. Captains Burian and Jelsma will be promoted made a conditional offer for a school crossing guard. Chief Ferreira reported that improvements to the dispatch center is a capital improvement project that has been identified by the administration. They are waiting Regular Session Minutes June 8, 2018 Page 3 for funding sources. Getting people to work in 911 is a nationwide problem. Repricing to a higher pay might help. Maui County has incentive pay for dispatchers. Deputy Chief Bugado stated that they have had preliminary talks with the community college to prepare applicants with skills for the job. th Chief Ferreira stated that the recognition ceremony for the 87 recruit class will be on August 15. Finance Report: Chief Ferreira reported that almost 87% of their budget have been expended. They had $635,000 extra expenditures due to the lava flow. Budget cuts are being discussed. They will look at contract services. Autopsies are required for unattended deaths, and this is a large expense. If furloughs are considered, it would affect civilian staff, not sworn personnel. Puna officers are working 12-hour shifts due to the lava flow. They have a supplemental budget that requests additional personnel in dispatch, records, and patrol. Commendations of Sworn and Civilian Employees: They received four commendations since the last meeting. Other Department Activities: The will be on June 20 in EXECUTIVE SESSION (Closed session.) Commissioner Carlson motioned to meet in executive session to consider discipline and charges against officers or employees o where matters affecting privacy will be involved, to consider sensitive matters relating to public safety, and may consult with Corporation Counsel on questions and issues pertaining to the to HRS 92- 5 (a) (2) (4) (6) and the Hawa-20 (b). Commissioner Hu seconded, and it carried unanimously. Executive session convened at 9:50 a.m. Regular session reconvened at 10:11 a.m. ACTION ON EXECUTIVE SESSION MATTERS Complaint HPC 18-13: Complainant alleged that he was arrested for no reason and Tased. He also complained about how the officers conducted the arrest. Commissioner Carlson motioned that there was insufficient evidence to prove the complaina. Commissioner Hu seconded, and it carried unanimously. Commissioner Carlson stated that he wants a letter sent to the Chief strongly asking officers to respond to the commission on whether or not they received notification of the complaint. This is a matter of training and professional conduct. Regular Session Minutes June 8, 2018 Page 4 Complaint HPC 18-14: Complainant alleged that when an officer responded to a call about her son not returning home, the officer made a comment about corrective action which she felt was child abuse. Commissioner Paiva motioned that there was insufficient evidence of misconduct. Commissioner Buckman seconded, and it carried unanimously.
