CHARTER AMENDMENT NO. 14 <br />LIQUOR COMMISSION MEMBERSHIP <br />BE IT ENACTED BY TIE PEOPLE OF THE COUNTY OF HAWAII: <br />Section 1. Section 7-3.2 of the Hawaii County Charter is amended to read as follows: <br />"Section 7-3.2. Liquor Commission. There shall be a liquor commission <br />consisting of [seven] nine members who shall be appointed by the mayor and confirmed <br />by the council in the manner prescribed in Section 13-4. [Commission membership shall <br />be representative of the community and of the county geographical areas of Puna, Ka' u, <br />Kona, Kohala, Hamakua, and Hilo.] One member shall be a resident of each council <br />district. The liquor commission shall: <br />(a) Adopt rules and regulations having the force and effect of law for the <br />administration of liquor control in the county and to carry out provisions of the liquor <br />control laws of the state. <br />(b) Grant, renew or refuse applications for licenses of the manufacture, <br />importation and sale of liquor in the county under applicable laws and regulations. <br />(c) Have such other powers and duties as may be provided by law, not in <br />conflict with the provisions of this section." <br />Section 2. Article 16 of the Hawaii County Charter is amended by adding a new <br />section to be appropriately numbered and to read as follows: <br />"Section . Boards and Commissions with District Residency <br />Requirements. Any commission member serving at the time of the adoption of a council <br />district residency requirement in the year 2000 may serve the remainder of the term., <br />regardless of residency. Any vacancy must be filled by a resident of a council district not <br />represented on the commission." <br />Section 3. To allow for the staggering of terms, one of the two new commissioners <br />shall be appointed to a five year term. The other shall be appointed to a one-year term, <br />and shall be eligible for a second term under section 13-4(c). <br />Section 4. <br />underscored. <br />Charter material to be repealed is bracketed.
