DISCUSSION OF ARTICLES III -IV, HAWAII COUNTY CHARTER ARTICLE III: LEGISLATIVE BRANCH/COUNTY COUNCIL ARTICLE IV: EXECUTIVE BRANCH/GENERAL PROVISIONS 2009 -10 Charter Commission — 3 Page 2 May 8, 2009 NEW BUSINESS CREATION OF AD -HOC COMMITTEE TO REVIEW ARTICLE III, Section 3 -2 Composition and Terms COMM. 4: Memo from Commission Attorney Levi Hookano, dated April 28, 2009, regarding the creation on an Ad -Hoc Committee to investigate and review issues related to the Composition and Term Limits of the Hawaii County Council. 2. CREATION OF AD -HOC COMMITTEE TO REVIEW ARTICLE III, Section 3 -17 County Reapportionment Commission COMM. 5: Memo from Commission Attorney Levi Hookano, dated April 28, 2009, regarding the creation on an Ad -Hoc Committee to investigate and review issues related to the County Reapportionment Commission. AMENDMENT TO ARTICLE IX OF THE COMMISSION RULES OF PROCEDURE COMM. 6: Memo from Commission Attorney Levi Hookano, dated April 28, 2009, proposing an amendment to the 2009 -2010 Commission Rules of Procedure which provides the procedure by which Charter Amendments may by proposed, approved, and adopted by the Charter Commission. 4. DISCUSSION OF ARTICLES V -IV, HAWAII COUNTY CHARTER ARTICLE V: EXECUTIVE BRANCH/THE MAYOR AND STAFF AGENCIES ARTICLE VI: EXECUTIVE BRANCH/THE MANAGING DIRECTOR AND AGENCIES UNDER THE MANAGING DIRECTOR REPORTS REFERRALS FOR EXECUTIVE SESSION The Commission anticipates convening an executive meeting regarding the following matter, pursuant to Section 92- 5(a)(4), for the purpose of consulting with the Commission's attorney on questions and issues pertaining to the Commission's powers, duties, privileges, immunities, and liabilities. A 2/3 vote of the members present, pursuant to HRS § 92 -4 and Commission Rule I -d, is necessary to hold an executive meeting. 1. REQUEST FOR EXECUTIVE SESSION COMM. 7: Memo from Commission Attorney Levi Hookano, dated April 28, 2009, requesting an Executive Session to discuss the legal effect of previous Charter Amendments on this Commission's work. Those submitting written testimony at the meeting should bring fourteen (14) copies for distribution. Testimony may also be submitted (1) by mail to Karen Eoff, County Council Office in Kona at 75 -5706 Hanama Place, Suite 109, Kailua -Kona Hawaii 96740; (2) by facsimile to (808) 329 -4786; or (3) by e -mail to keoff @co.hawaii.hi.us. Please submit separate testimony for each item. Copies will be distributed at the meeting only if they are received before 12:00 noon on the business day prior to the meeting. All oral and written testimony will be made a part of the public record. Notice to Lobbyists: If you are a lobbyist, you must register with the Hawaii County Clerk within five days of becoming a lobbyist. {Article 15, Section 2- 91.3(b), Hawaii County Code} A lobbyist means "any individual engaged for pay or other consideration who spends more than five hours in any month or $275 in any six -month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials." {Article 15, Section 2- 91.3(a)(6), Hawaii County Code} Registration forms and expenditure report documents are available at the Office of the County Clerk- Council, 333 Kilauea Avenue, Hilo, Hawaii 96720.
