Hookano, Attorney Date: January 13, 2010 RE: Relating to CA-12: Initiation of Amendments or Revisions Dear Chair Haitsuka and Members of the Hawai‘i County Charter Commission, Regarding CA-12, which proposes to amend the requirements of voter initiated charter amendments or revisions, appears to be legally sufficient. There may, however, be an issue with removing the requirement that signers of a petition for an amendment or revision include their address on the petition and the date of signing of the petition. I suggest that the commission solicit input from the county clerk as the chief elections officer of the county as well as from the county office of elections to determine the effect this would have on verification of signatures on a petition. Additionally, this proposal conflicts with CA-16, which also deals with the initiation of amendments or revisions to the charter.
