Dear Chair Haitsuka and Members of the Hawai‘i County Charter Commission,
There does not appear to be any legal issues with the above referenced proposals. The
only significant thing to mention relates to CA-17. CA-17 requires that the redistricting1
commission be appointed by July 1 of the year immediately prior to the redistricting year. The
next redistricting year is 2011. If CA-17 were to become effective upon approval by the
electorate, it would be impossible for the commission to be appointed by July 1 of the year
immediately prior since that date would have already passed. Therefore, I recommend that a
transition provision be included in this amendment that indicates when the July 1 provision takes
effect and how the passage of this amendment will impact the work of the upcoming redistricting
commission.
