Haitsuka and Members of the Hawai‘i County Charter Commission From: Levi K. Hookano, Attorney Date: January 13, 2010 RE: Relating to CA-17: Reapportionment to Redistricting Relating to CA-23: Electronic Notices with Newspaper Notices Relating to CA-26: Conservation Relating to CA-29: Prosecuting Attorney Powers Relating to CA-30: Board and Commission Websites Relating to CA-36: Housekeeping Amendments Dear Chair Haitsuka and Members of the Hawai‘i County Charter Commission, There does not appear to be any legal issues with the above referenced proposals. The only significant thing to mention relates to CA-17. CA-17 requires that the redistricting1 commission be appointed by July 1 of the year immediately prior to the redistricting year. The next redistricting year is 2011. If CA-17 were to become effective upon approval by the electorate, it would be impossible for the commission to be appointed by July 1 of the year immediately prior since that date would have already passed. Therefore, I recommend that a transition provision be included in this amendment that indicates when the July 1 provision takes effect and how the passage of this amendment will impact the work of the upcoming redistricting commission. If you have any questions regarding these matters, please do not hesitate to contact me. Levi K. Hookano Commission Attorney 1 The term “redistricting” will be used in this memo instead of “reapportionment” since that is the purpose of the proposed amendment.
