1979 HAWAII COUNTY CHARTER COMMISSION

Rules of Procedure
I. OFFICERS
•
The officers of the Commission shall consist of
•
a Chairman and a Vice-Chairman to be elected
from among the membership of the Commission.
•
II. DUTIES AND POWERS OF. THE CHAIRMAN
A. To preside at each meeting of the Commission.
B. To preside at all public hearings.
C. When necessary or required, to sign and
certify to all official acts of the
• Commission and all vouchers, purchase orders,
etc. , for payment of expenditures of the
Commission.
D. To appoint staff members, committees and
• consultants when authorized by the
Commission, in accordance with applicable
' laws.
E. All official information shall be released •
through the Chairman of the Charter
Commission.

.... III. • DUTIES AND POWERS OF VICE-CHAIRP4AN
The Vice-Chairman shall exercise and perform the
duties of the Chairman in the absence or •
•
inability of the Chairman to act.
IV. MEETINGS
A. The place of the meetings shall be in the
• Councilroom, Hawaii County Building, or
such other public place as the Commission
may, designate.
B. Special meetings may be called by the
• Chairman or by a majority of the Commission,
in accordance with applicable laws.
. C. General or regular meetings will be held on
Tuesdays at 3:30 p.m. unless otherwise
specified.
D. Each member shall be given an oral or .
written notice at least one day and not
more than five days prior to a special
meeting.

E. All meetings and journal of proceedings of
the Commission shall be open to the public.

V. ATTENDANCE •
All Commission members shall attend all meetings
. unless excused by the Chairman.
VI. QUORUM AND TRANSACTION OF BUSINESS
The majority of the members of -the Commission
• shall constitute a quorum for the transaction of
' business. The concurrence of the majority of the
members of the Commission present shall establish
• an official decision.
VII. VOTING •
• No member shall refrain from voting unless
excused by the• Chairman for good cause.

The order of business may be altered by the
• Chairman by majority -vote of the Commission.
IX. . PUBLIC STATEMENTS . WRITTEN/ORAL
• A. All persons desiring to speak before the
Commission shall register with the secretary
• prior to the convening of the meeting, and
shall provide the Commission with their
name, address, and organization they
• .represent, if applicable. . No person, who
fails to register, shall be heard.
• • H. The Chairman shall call the name of the
• person desiring to speak, and all persons
shall speak before a microphone, and be
informed that their statements will be
. recorded.

C. All statements before the Commission shall
be in reference to provisions in. the Charter •
of the County of Hawaii or those that may
be proposed as amendments or additions
thereto. Statements not relevant, at the
• - discretion of the Chairman, shall not be
• heard or considered. Whenever requested
• - or appropriate, the speaker shall specify
the charter provision referred to so that
members may be familiar with its provisions.
D. All statements are to be made to the
Commission in general, and not to any
• specific member, unless in response to a
question by the said member.

E. At any time, the Chairman or any Commission
member may interrupt any person making a
statement for a clarification or answer.
F. At the discretion of the Chairman, each
person may be allotted a specific number
of minutes to speak.
G. Written proposals regarding any amendments
or additions to the Charter may be submitted
• at the time of the hearing, or thereafter.
H. Written statements on issues before the
Commission may be deferred until such time
as the subject matter referred to in the
. statement appears on the Commission's
agenda. If deferred, the writer shall be
• informed when the issue will be on the
agenda to allow the writer the opportunity
. to address the Commission and elaborate
• and/or clarify his statement, should he
so desire.
• I. Oral statements. before the Commission will
• be heard at scheduled public hearings to
be held by the Commission.
• X. PARLIAMENTARY PRACTICE
The rules of parliamentary authority where not
inconsistent' with the rules adopted shall be
Robert' s Rules of Order, Revised.
XI. EXPENSES •
• .No member of the Commission shall incur any
expense, except with the consent of the Chairman.
XII. DECISIONS
A. With respect to proposed charter amendments
or additions, decisions on each section (s)

shall be tentative until a final draft is
• agreed upon.

B. Tentative decisions. may be reconsidered only
in accordance with Robert's Rules of Order.
C. The decision of the majority of the
Commission members shall be the decision
• of the Commission. •
•
XIII. OTHER PAYMENTS
The compensation for the secretary shall be paid
semi-monthly; monthly for the Commission
attorney; mileage reimbursements and other
incidental expenses shall be paid on a monthly .
• basis.
XIV. PUBLIC ACCESS
Any person may obtain information, or make
• • submittals or requests by contacting the Office
• of the County Clerk, County of Hawaii.,. 25 Aupuni
Street, Hilo, Hawaii 96720. Copies of all •
official minutes, documents, agenda, procedures,
•statements, or decisions. shall be available at
the said office at such cost as may be authorized
by law.
• XV. These rules may be amended. at •any meeting by a •
majority of the Commission members if the said
amendment affects only the internal management
• of the Commission; otherwise, the amendment shall
�._.... be va-lid only if made pursuant to the
• requirements of law.
