In anticipation of a special election to consider charter revisions,
we would like to advise your commission when the proposed amendments
should be presented to our Office for preparation and submission to
the electorate on Saturday, November 3, 1979.
Paragraph 2 of the Hawaii County Charter Section 15-3,
Mandatory Charter Review provides: "... The commission
shall publish not less than forty-five days before any
election, at least once in a daily newspaper of general
circulation within the county, a brief digest of the
amendments or charter and a notice to the electorate
that copies of.the amendments or charter are available
at the Office of the County Clerk."
Please note that as mandated in Section 15-3 as cited above, this
publication must be made no later than September 19, 1979.
Further note that the requirements of Section 11-91, Hawaii Revised
Statutes, must also be met. This section is entitled, "Proclamation,"
and requires the following:
"Not later than 4:30 p.m. of the tenth day prior to the close
of filing in elections ... the Chief Election Officer
(Lieutenant Governor) shall issue an election proclamation.
In elections involving only county offices the (County)
Clerk shall issue the proclamation ... The proclamation
shall contain a statement of the time and place where,
and the purpose for which, the election is to be held ..."

Therefore, pursuant to Section 11-91 cited above, the election
proclamation must not only be issued but published as well in a
newspaper of general circulation no later than August 25, 1979,
(ten days prior to the close of filing which is September 4, 1979,
HRS Section 12-6.
In addition we would like to request that the Commission submit in
writing, what exact issues will be placed on the ballot by
August 10, 1979, to provide us time sufficient to properly compose
the proclamation, and also allow the publisher to typeset, proof
and publish the proclamation on the mandated deadline of August 25,
1979.
In summation, the date of August 10, 1979, isthe deadline when the
charter amendments should be submitted to our office.
