To: County of Hawaii Charter Review Commission

Due to business commitments, I am unable to attend your hearing as scheduled.
However, pursuant to your request for comment on the Code of Ethics, Article
8, Chapter 2 of the Hawaii County Code, the following are matters which have
been brought to the Board's attention and should be given your due consideration:
1. Transmittal from Corporation Counsel regarding amendments to
comply with the decision rendered by the Third Circuit Court
on the constitutionality of Sections 5-C, 8A, 8B, 8C and 9.
It is recommended that Sections 5-C and 9 be deleted and that
Sections 8A, 8B and 8C be amended to include a provision as
follows:
"This section shall be construed together with
Section 13-20(b) of the Charter of the County of
Hawaii. The Board shall make an affirmative or
negative finding that the subject involves personal
matters affecting the privacy of an individual."

Should this provision be acceptable, references to confidential
proceedings in these sections should be deleted.
2. County Council's acceptance of County Clerk's recommendation to
delete the words "without proper consent" at the end of the sentence
in Section 7A.
3. Councilwoman Lai's recommendation as follows:
a. Section 6 be amended by deleting the words "hiring, appointment
or election" and inserting in its place, "assumption of duties
and responsibilities."
b. Section 6A be amended by inserting at the end of the first
sentence, the words "in the performance of his duties and
responsibilities."
