KAWAHARA Page 1 PROPOSED CHANGES TO THE COUNTY CHARTER Article III. . .Section 3-1. -Powers and Functions. The legislative powers of the county shall be vested in the the county council. Its primary function shall be legislation and public policy formulation , Cas distinct and separate from the executive administration of county government.) and its activities and functions shall be closely coordinatedd uTh the executive branch. Section 3-2. Composition and Terms. Delete entire section. Add: There shall be a county council composed of seven members who shall be elected at-large, one from each of the repre- sentative districts and two at-large, for terms of four years. The terms of councilmen shall begin in at 12 o 'clock meridian on the first Monday of December after their election. Of the seven members elected to the county council , one shall . be a resident of each of the representative districts and two members shall be elected at-large. The person charged with the duty of conducting elections in the county shall prepare the nomination papers in such a manner that candidates desiring to file for the office of councilman shall be able to specify whether they are seeking the seat with a district residence requirement or the seat with no district residence requirement as the case may be. The ballots of the primary and general election shall be prepared to give every voter in the county the opportunity to vote for each and every council seat. Candidates shall be nominated and elected in accordance with the election laws of the state. Section 3-3. Qualifications. Chapter 4. (Planning Departments Department of Planning and Economic Development Section 5-4. 1. Organization There shall be a deputy director in charge of planning and a deputy director in charge of economic development. Section 5-4. 2. Planning Director Duties of the Research and Development Division ( a) Collect and develop data necessary for managerial and legislative decision-making, and program and policy-making.. (b) Provide staff leadership for public and private development programs , enterprises and plans , including economic, social and cultural proposals , which enhance improvement of the county community. (c) Coordinate informational and regulatory knowledge of all federal and state grant-aid participation programs which affect the county. Chapter 5 . Department of Research and Development. Delete entire chapter. (Switching subsections a,b,c above) Article VII Chapter 2. . .Police Department Section 7-2. 1. Organization. The police (commission] department shall adopt such rules as it may consider necessary for the conduct of its business and regulation of the matters committed to its charge by law. (Except for purposes of inquiry, neither the comm- ission or its members shall interfere in any way with the administrative affairs of the department. Section 7-2.4. Chief of Police and Deputy. The chief of policy shall be appointed by the (police commission) mayor with the approval of the council and may be removed by the [police commission] mayor with the con- currence of the council . The deputy shall be appointed by the chief of police (with the confirmation of the police commission] and may be removed by the chief (with the approval of the police commission./ Article VIII Department of Water Supply Section 8-1. Organization. There shall be a (semi-autonomous) department of water supply (consisting of a water commission) with a manager and the necessary staff. Section 8-3. Manager and Deputy. The manager of the department of water supply shall be appointed by the [water commission) mayor with the confirm- ation of the council and may be removed by the (water commission) mayor with concurrence of the council . The deputy shall be appointed by the manager with the confirmation of the water commission) and may be removed by the manager (with the approval of the water commission.] The manager shall be a registered engineer. Article IX. Prosecuting Attorney. Section 9-7. Removal of Prosecuting Attorney. The prosecuting attorney may be removed by impeachment proceedings as provided by law. The prosecuting attorney shall be accountable to the mayor and the council . Article XVI . Transitional Provisions. Delete entirely. Note: Deletions are bracketed. Additions are underscored.
