Dear Commission Members:
An article in the Hawaii Tribune-Herald of April 12, 1979 states
that your group has been advised that the two-year residency require-
ment to `run for county offices is likely unconstitutional.
There is. a sound basis for requiring a person to have lived in an
area he will be representing in public 'office. It occurred to me the
Commission may wish to look .into the case of Sununu vs. Stark in which
the constitutionality of the seven (7) yearsresidencerequirement
established by the State of New Hampshire for eligibility to run for the
State's Senate was challenged. The Federal District Court upheld the
constitutionality of the seven years residence requirement on October 24,
1974. This decision was appealed and on-March 3, 1975, the U. S. Supreme
Court affirmed the District Court's decision as contained in 383- Federal
Supplement 1287.
