SUBJECT: Sewerage System Jurisdiction
The Charter Commission at its July 3, 1979 meeting approved the structure of
the Department of Water Supply which included the assignment of all sanitary
sewerage systems in the County to be under the control of that department.
Presently, such systems fall within the jurisdiction of the Department of
Public Works.
Reading of the minutes indicates that your Commission's action relative to
sewerage system control was based on your understanding that Maui County
provided a similar structure in its Charter. Although such a provision exists
in the Maui Charter, the Maui County Council, by Ordinance No, 860 adopted
on January 21, 1977 reversed that designation and returned the sewer activity
to the Department of Public Works. Authority to restructure departments was
granted to the County Council by Section 6-2 of the Charter. A copy of
Ordinance No. 860 is attached for your information.
I agree with the Maui structure and support the retention of the sewer
operation under the Department of Public Works. Specific sub-division .
categories such as sewers, roads, purchsing, etc, , should be left undesignated
in the Char er to allow for re-structuring by the mayor and County Council as
