HomeMy WebLinkAbout2018-07-05 Windward Planning Commission MinutesWINDWARD PLANNING COMMISSION COUNTY OF HAWAII MINUTES JULY 5, 2018 The Windward Planning Commission met in regular session at 9:00 a.m. in the County of Hawaii, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii, with Chairman Joseph Clarkson presiding. COMMISSIONERS PRESENT: Gilbert Aguinaldo, Joseph Clarkson, Donn Dela Cruz, Donald Ikeda, Thomas Raffipiy, John Replogle. ALSO PRESENT: Michael Yee (Planning Director), Malia Ho Hall (Deputy Corporation Counsel for the Windward Planning Commission), Jeff Darrow (Planning Program Manager), Maija Jackson (Planner), Christian Kay (Planner), Shancy Watanabe (Planner), and Sarah Hata-Finley (Commission Secretary). A quorum was present. Chairman Clarkson introduced Windward Planning Commissioners and staff to members of the public and went over the procedures for public testimony. STATEMENTS FROM THE PUBLIC — No statements were presented under this section of the agenda. APPLICANTS: CHARLES AND KITURA ANDRUS (REZ 18-000227) Application for a Change of Zone from an Agricultural -20 acres (A -20a) to an Agricultural -5 acres (A -5a) zoning district for approximately 11.06 acres of land. The subject property is located on the southeast side of Kihalani Homestead Road, about 0.90 miles from its intersection with Hawaii Belt Road (Highway 19), Kihalani Homesteads, North Hilo, Hawaii, TMK: (3) 3-5-004:023. The Commission took this item up at 9:02 a.m. with 11 people from the public in attendance. (SEE EXHIBIT A) This item ended at 9:17 a.m. 2. APPLICANT: MICHELLE A. MITCHELL (AMEND REZ 06-000047) Application for a 5 -year time extension to comply with Condition C (Complete Construction) of Ordinance No. 07 166, which reclassified approximately 1.278 acres from the Agricultural -1 acre (A -la) district to the Multiple -Family Residential -5,500 square feet (RM -5.5) zoning district in 2007. The subject property is located on the south side of Ponahawai Street, approximately 650 feet east of its intersection with Komohana Street, Ponahawai, South Hilo, Hawaii, TMK: (3) 2-3-037:015. MITCHELL (AMEND USE 13-000042) Application for a 5 -year time extension to comply with Condition No. 4 (Complete Construction) of Use Permit No. 13-000042, issued in 2013 to allow the establishment of a medical clinic and accessory uses on 1.278 acres of land. The subject property is located on the south side of Ponahawai Street, approximately 650 feet east of its intersection with Komohana Street, Ponahawai, South Hilo, Hawaii, TMK: (3) 2-3-037:015. [Note: Item Nos. 2 and 3 were consolidated into one hearing.] The Commission took this item up at 9:17 a.m. with 4 people from the public in attendance. (SEE EXHIBIT B) This item ended at 9:31 a.m. 4. APPLICANT: DIEN-JUNG LIN (FORMERLY DIEN-JUNG LIN NEKOBA) (AMEND REZ 07-000071) Application for an 18 -month time extension of time to comply with Condition B (Payment of Water Commitment Fee) and a 5 -year time extension to comply with Condition C (Conversion of Dwelling into Office Uses) of Ordinance No. 08 20, which reclassified approximately 39,771 square feet of land from a Single -Family Residential - 10,000 square feet (RS -10) zoning district to a Neighborhood Commercial -10,000 square feet (CN -10) zoning district. The properties are located at 610 Kekuanao`a Street and 622 Hinano Street, between Manono Street and Hinano Street, Waiakea House Lots, Waiakea, South Hilo, Hawaii, TMKs: (3) 2-2-036:025 and 026. The Commission took this item up at 9:31 a.m. with 3 people from the public in attendance. (SEE EXHIBIT C) This item ended at 9:56 a.m. 5. APPLICANT: CELLCO PARTNERSHIP DBA VERIZON WIRELESS (USE 17-000074) Consideration and Adoption of Proposed Findings of Fact, Conclusions of Law and Decision and Order of the Commission for denial of a Use Permit to allow the construction of a new, non -manned telecommunication facility, consisting of a 155 -foot tall steel monopine tower, retaining wall, 6 -foot tall fencing and related facilities within a 1,050 -square foot lease area on a 33,106 -square foot parcel, situated in the County's Agricultural 1 -acre (A -la) zoning district. The subject property is located at 15-1463 21st Avenue, approximately 1,700 feet north of the Kaloli Drive — 21st Avenue intersection, Hawaiian Paradise Park, Kea`au, Puna, Hawaii, TMK: (3) 1-5-038:013. The Commission took this item up at 9:56 a.m. with no one from the public in attendance. Page 2 of 4 Windward Planning Commission July 5, 2018 Minutes (SEE EXHIBIT D) This item ended at 9:59 a.m. MINUTES — The Commission took this item up at 9:59 a.m. Approval of Minutes of the April 12, 2018 Meeting_— It was moved by Commissioner Raffipiy, and seconded by Commissioner Replogle, that the Minutes of April 12, 2018, be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. Approval of Minutes of the June 7, 2018 Meeting_— It was moved by Commissioner Raffipiy, and seconded by Commissioner Ikeda, that the Minutes of June 7, 2018, be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE MATTERS — The Commission took up the following at 10:00 a.m. Review and discussion of recent Special Management Area (SMA) determinations and minor permits issued by the Planning Director Ms. Jackson gave the Commission a copy of the SMA monthly report. She informed the Commission that the report did not contain any SMA violations because the Department had not received any since the last report. Mr. Darrow stated that there had been a number of appeals of the Department's SMA Minor determinations and exemptions. He specifically mentioned the petitions by Mauna Kea Community Association [BOA 18-197], Leleiwi Community Association [BOA 18-196], and Hakalau Point Preservation Association [BOA 18-187]. Mr. Darrow said that the SMA Rules were going to be amended in the future, and one of the considerations was that an appeal of an SMA decision would be heard before the Planning Commissions instead of the Board of Appeals. Upon inquiry by Chair Clarkson, Mr. Darrow gave a brief background on the appeal by Leleiwi Community Association. ANNOUNCEMENTS — The Commission took up the following at 10:08 a.m. Ms. Jackson informed the Commission that the August 13th meeting was on a Monday, and not the usual Thursday, with three to four items tentatively on the agenda. Motion was unanimously carried by a voice vote of all Commissioners in attendance.
