PUBLIC HEARING MINUTES

CALL TO ORDER
Chair Hendricks called the meeting to order at 9:05 a.m.
ROLL CALL
Present: Peter Hendricks, Chair

Paul Paiva, Commissioner
Colleen Pasco, Commissioner
Absent: Arthur Buckman, Commissioner
A quorum was present.
Also present: Malia Hall, Deputy Corporation Counsel
Josie Pelayo, Secretary
The police commission held a public hearing on proposed amendments to its rules that
included, but were not limited to the following:
• Amends rule on committees.
• Amends rule on location of monthly meetings.
• Repeals rule on use of an official seal.
• Repeals rule on commission inquiries.
• Amends rule on filing, processing, and considering complaints.
• Repeals classification guidelines for standards of conduct.
• Amends rule on classification of case findings.
PUBLIC STATEMENTS
KITTRENA MORGAN came before the commission. She stated that she doesn't agree
with removing the police commission seal and classification guidelines, and that the public
is not able to access police reports within the 90 -day time for filing a complaint.
ABEL LUI came before the commission. He stated that he opposes all this. He talked
about Kamehameha I and bringing back the Hawaiian Kingdom
SHELLEY S. MAHI came before the commission and read her written statement which she
distributed and is on file. She didn't want pages 6-9 of the rules removed and talked about

those sections. She went on to talk about police training and banning neck strikes. She
wants the commission to do medical review of the police training manual.
Deputy Corporation Counsel Hall stated that training is the Chief's decision.
Commissioners are here to listen to complaints, and could refer it to the Chief.
Recess was called at 9:35 a.m. The meeting reconvened at 9:42 a.m.
Ms. Pelayo suggested changes:
• Page 7 (h) Burden of Proof, change the wording to "refer to the Chief for further
investigation" to be consistent with the wording in Rule 6.
• Page 9, Rule13, change 10 days to 20 to allow more time to obtain records.
• Suggested that non -substantive changes such as correcting formats, typos,
punctuation, and grammatical errors be allowed.
Ms. Hall stated that the seal has never been used. The commission does not use the
classification guidelines. They don't determine the misconduct (police department does).
Commissioner Paiva motioned to allow the changes that Ms. Pelayo suggested.
Commissioner Hu seconded, and it carried unanimously.
Chair Hendricks stated that these rule changes will be brought forward to the Police
Commission's meeting which will follow this hearing.
The hearing was adjourned at 9:47 a.m.
