Dwight Vicente: Mr. Vicente, representing the Hawaiian Kingdom, testified in opposition to Bill 161, Mr. Vicente questioned the background and credentials of Michael Yee, Planning Director. Mr. Vicente stated that the Hamakua CDP does not mention native tenant rights or crown and government lands and claimed the document is incomplete. He stated the document does not include any history or table of authority and that people claiming to own lands in Hamakua are fraudulent. 2. Gregory Smith: Mr. Smith testified in support of Bill 161. He stated that he would like to see more transparency on native rights within the document, but urged the County Council to adopt Bill 161. 3. Ms. Mendoza stated that she is a lifelong resident of Hakalau and Pepe'ekeo areas. She attested to the countless hours of meetings and discussion with the Steering Committee and the community that informed the Hamakua CDP. Ms. Mendoza expressed her belief that the Hamakua CDP encapsulates the wants and needs of the constituents, the practicality of development in the area, and the preservation of culture and resources while leaving a healthy and mindful legacy for the generations of the future. 4. Brad Kurokawa: Mr. Kurokawa, representing the Hamakua CDP Steering Committee, testified in support of Bill 161. Mr. Kurokawa expressed his support for the Hamakua CDP and urged the County Council to pass Bill 161 onto the second reading and the adoption of Bill 161 by ordinance. 5. Farrah -Marie Gomes: Ms. Gomes, representing the Hamakua CDP Steering Committee, testified in support of Bill 161. She attested to the inclusive nature of the Hamakua CDP development process. Ms. Gomes urged the County Council to pass Bill 161 through the first reading and onto the second reading and finally the adoption of the Hamakua CDP (Bill 161). 6. John Kaye: Mr. Kaye testified in support of Bill 161. He expressed how impressed he was with the inclusion of the public in the development of the plan. He attested that the Hamakua CDP was informed and shaped by input from the community, and urged the County Council to adopt Bill 161. 7. June Kaye: Ms. Kaye testified in support of Bill 161. She urged the County Council to recognize the hard work and commitment of the people of Hamakua and adopt Bill 161. 8. Shelley Mahi-Hanai: Ms. Mahi-Hanai testified in support of Bill 161. She asked that the County please keep native tenants in mind within the policies and goals of the Hamakua CDP. 9. Robert Nishimoto: Mr. Nishimoto, a lifelong resident of Ninole, testified in support of Bill 161. He stated his belief that the Hamakua CDP was a representation of the community's wishes and urged the County Council to adopt Bill 161. I%hk I BUSINESS: 1. County Council Public Meeting Regarding the Hamakua Community Development Plan (Bill 161): This meeting was a concurrent County Council meeting and Hamakua Community Development Plan Steering Committee meeting to comply with the Sunshine Law (HRS Chapter 92) and enable the CDP Steering Committee members to attend and provide comments to County Council Members. The purpose was to determine passage of the Hamakua Community Development Plan onto the second reading. (Bill 161: Adopts the County of Hawai'i Hamakua Community Development Plan). Prior to this meeting, the Windward Planning Commission as well as the County Council Committee on Planning forwarded their favorable recommendation for the www.hiplanningdept.com planningahawaiicounty.gov Page 2 75 adoption of the Hamakua CDP to the County Council. Members of the Hamakua Community 76 Development Plan Steering Committee attended this County Council meeting and were able to 77 testify and answer questions from the County Council Members during the public meeting. 78 Ms. Poindexter moved to pass Bill 161 on first reading. Seconded by Mr. Kanuha. 79 Planning Director, Michael Yee, stated that he was not from Hawai'i but that what is important is 80 that he is a lifelong learner of the island. He says that his goal is to afford all future generations 81 the opportunity to stay on the island and live and grow and raise their children here. 82 CoH planners, LeAna Gloor and Bethany Morrison, came forward to address the members of the 83 Council. Ms. Gloor addressed the Council and introduced the presentation stating that the brief 84 presentation was intended to clarify some of the questions that were raised during the meeting 85 of the Council Committee on Planning. She presented a brief presentation outlining the CDP 86 development process and structure. She addressed several questions raised previously, including 87 the purpose of the land use guide maps, the policy on shoreline setbacks, and the authoritative 88 scope of the CDP document. InWhIr ,® 89 Following the presentation from the Planning Department, a discussion was opened between 90 the County Council members and Planning Staff to address any questions or concerns the 91 Council Members had. 92 Tl%hhh' V 93 Councilmember Tim Richards called Planning Director Yee and Corporation Counsel Joe 94 Kamelamela forward. Mr. Richards asked if the CDP was mandating anything. Additionally he 95 asked if the CDP mandates and assigns any potential liabilities to the County. 96 97 Mr. Kamelamela responded that no, it does not. 98 99 Mr. Yee concurred with Mr. Kamelamela also stating that it does not assign any potential 100 liabilities to the County. 101 102 Mr. Richards also askedif the purpose of the CDP was advisory going forward and asked if there 103 if the CDP changed any codes. 104 105 Mr. Kamelamela confirmed that the CDP is advisory moving forward and does not change any 106 code. 107 Imler 108 Mr. Yee concurred with Mr. Kamelamela. 109 110 Councilmember Aaron Chung asked if the CDP required the County Council to act on the 111 recommended code amendments in the CDP. 112 113 Mr. Kamelamela answered that the CDP would not create required actions by the County 114 Council. www.hiplanningdept.com planningahawaiicounty.gov Page 3 115 116 Chair Eoff asked the Council if there were any further questions regarding Bill 161.
