1. Please provide a brief description of: The Proposed Charter amendment, the purpose of the proposed
Charter amendment, the issue or problem to be addressed by the proposal, and how the proposal would
address the issue or problem.
2. If applicable, list the Charter provision(s) affected by the proposal:
The purpose of this proposed Charter Amendment is to allow Hawai'i Police Department Chief of Police
(HPD) and the Office of the Prosecuting Attorney elected Prosecutor (OPA) to operate, coordinate and
oversee the operations of their respective, Management Information Systems (MIS) sections.
Due to security requirements mandated by FBI/CJIS that both departments must follow, HPD and OPA
need to be able to implement policies, procedures, rules and regulations as well as be able to freely
procure any equipment needed to meet the Powers, Duties and Functions of each department.
As HPD and OPA are both law enforcement agencies, they share confidential and restricted information
vital to successful arrest and prosecution of law breakers.
Due to these requirements, not all technological resources can be freely shared or managed by County
DIT, HPD and OPA. Every effort will be made to pool resources amongst departments to achieve
economy of scale when purchasing bulk items.
Under the current charter, responsibility falls upon the County Director of Information Technology.
Since the DIT Director falls under the Mayor, their priorities may not align with the Prosecutor or Chief
of Police. Also, HPD and OPA receive Federal and State grants that can only be spent on Law
Enforcement and must be accepted by either the Chief of Police or Prosecuting Attorney.
By having the HPD and OPA MIS/IT overseen by their respective department heads, law enforcement
focused technology can be implemented as needed or deemed essential. This also alleviates the
responsibility of overseeing OPA and HPD MIS/IT sections by the County Director of IT. Ultimately the
Chief of Police and the Prosecuting Attorney will be responsible for the security, planning, maintenance,
implementation of their own MIS/IT systems.

The director of information technology shall:
(a) Operate the central data processing system, and coordinate and oversee the
operations of departmental data processing systems, except for those systems
