HomeMy WebLinkAbout2018-08-16 Leeward Planning Commission Minutes LEEWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES AUGUST 16, 2018 The Leeward Planning Commission met in regular session at 9:30 a.m. in the West Hawai‘i Civic Center, Community Center, Building G, 74-5044 Ane Keohokālole Highway, Kailua-Kona, Hawai‘i, with Chairman Keith F. Unger presiding. COMMISSIONERS PRESENT: Keith F. Unger, Nancy Carr Smith, Perry Kealoha, Michael Vitousek and Faye Yates ABSENT AND EXCUSED: Scott Church and Sonny Shimaoka ALSO PRESENT: Malia Hall, Esq. (Counsel for the Commission), Jeff Darrow (Planning Program Manager), Christian Kay (Planner), Shancy Watanabe (Planner) and Noriko Sauer (Commission Secretary) And seven people from the public in attendance. A quorum was present. Chairman Unger called the meeting to order, and introduced the Commissioners and staff to members of the public. He explained the procedure for the meeting and public testimony. Chairman Unger welcomed Commissioners Vitousek and Yates. Chairman Unger also announced that Commissioner Carr Smith would be recusing herself from Agenda Item No. 2 due to a conflict of interest. STATEMENTS FROM THE PUBLIC No statements were presented under this section of the agenda. NEW BUSINESS 1. APPLICANT: GOODFELLOW BROTHERS, INC. (AMEND SPP 08-000064) Application to amend Condition No. 3 (Life of the Permit) of Special Permit No. 08-64 and add the use and operation of a concrete/asphalt batching plant on a 5-acre portion within the previously approved 14.77-acre special permit area on the 243.794-acre property within the State Land Use Agricultural District. In 2008, Special Permit No. 08-64 granted the establishment of a baseyard to provide equipment and motor vehicle maintenance, repair services and related uses within the 14.77-acre portion of the property. The subject property is located adjacent to the existing Waikoloa Quarry and south of Waikoloa Road, halfway between Waikoloa Village and Queen Ka‘ahumanu Highway, Waikoloa, South Kohala, Hawai‘i, TMK: (3) 6-8-001: por. 066. 1 The Commission took up this item at 9:33 a.m., with seven people from the public in attendance. Action: It was moved by Commissioner Kealoha and seconded by Commissioner Carr Smith that the application to amend Special Permit No. 08-064 be approved based on the Planning Director’s recommendation and proposed conditions, including amended Conditions 3 and 8, which shall be adopted. A roll call vote was taken and motion carried with four ayes (Kealoha, Carr Smith, Vitousek and Unger), one no (Yates) and two absent and excused (Church and Shimaoka). \[SEE HEARING TRANSCRIPT – EXHIBIT A\] 2. APPLICANT: WEST HAWAI‘I BUSINESS PARK, LLC (AMEND REZ 1049) Application to amend Condition K (Roadway Improvements) of Ordinance No. 04-110, which reclassified approximately 196.634 acres of land from an Open (O) to an Industrial-Commercial Mixed-20,000 square feet (MCX-20) zoning district and reclassified approximately 85.733 acres of land from an Open (O) to a General Industrial- 1-acre (MG-1a) zoning district. The property is located along the east (mauka) side of Queen stnd Kaʻahumanu Highway (State Highway 19), Honokōhau 1 and 2, North Kona, Hawaiʻi, TMKs (3) 7-4-008:013, 030, 074, 076-78 inclusive, 084 and 085. The Commission took up this item at 10:11 a.m., with three people from the public in attendance. RECESSED Chairman Unger called a recess at 10:59 a.m. RECONVENED The meeting reconvened at 11:08 a.m. Action: It was moved by Commissioner Kealoha and seconded by Commissioner Yates that a favorable recommendation be forwarded to the County Council on the request to amend Change of Zone Ordinance No. 04 110, based on the Planning Director’s recommendation, findings and proposed amended conditions, which shall be adopted, including changes to Conditions D, E, F, K in the Director’s August 15, 2018, memo and the applicant’s final changes to Condition G as proposed at the August 16, 2018, hearing as follows: “An updated Traffic Impact Analysis Report (TIAR) certified by a licensed engineer shall be submitted for review and approval by the Planning Director in consultation with the Department of Public Works and the State Department of Transportation, if warranted by a significant change in circumstances or as may be required by the Department of Public Works during the design review of construction plans for future road segments. The improvements identified in the updated TIAR shall be provided in an appropriate design year or phased with the needed right-of-way provided. Mitigation measures called for in the revised TIAR that are reasonably related to the project impacts shall be implemented meeting with the approval of the Planning Director in consultation with the Department of Public Works and the State Department of Transportation.” A roll call vote was taken and motion carried with four ayes (Kealoha, Yates, Vitousek and Unger), one recusal (Carr Smith) and two absent and excused (Shimaoka and Church). \[SEE HEARING TRANSCRIPT – EXHIBIT B\] MINUTES Approval of the Minutes of the June 21, 2018, Leeward Planning Commission meeting. 2 At 11:12.m. it was moved by Commissioner Kealoha and seconded by Commissioner Vitousek that the minutes be approved as submitted. The motion was unanimously passed by a voice vote. ADMINISTRATIVE MATTERS Discussion of recent Special Management Area (SMA) determinations and minor permits issued by the Planning Director. The Commission took up this item at 11:12 a.m., with five people from the public in attendance. Mr. Darrow drew the Commissioners’ attention to the latest log that had been distributed, and explained that the entries with no highlight were for the Leeward Planning Commission whereas the ones highlighted in yellow were located within the jurisdiction of the Windward Planning Commission. He noted that there were five pending applications on the Leeward side, one of which, involving a property on the makai side of Ali‘i Drive, had just been returned to the applicant due to a pending violation. He further noted that the property had a lot of issues to be worked out and might have to come before the Commission for a particular permit. There were no questions from the Commissioners regarding this matter. ANNOUNCEMENTS Mr. Darrow informed the Commission that the September 20, 2018, meeting agenda would include a County Council initiated Bill 108 relating to short-term vacation rentals, which had been going through the Council for several months, with a lot of public participation. He said that the Windward Planning Commission would consider the bill at its September 6, 2018, meeting, and that the Planning Director was currently preparing his recommendation to both Commissions. ADJOURNMENT It was moved by Commissioner Vitousek and seconded by Commissioner Kealoha that the meeting be adjourned.
