Saquing Donna Mae Springer RE: Transmitting CA -1; Proposed Amendment to Various Sections of Charter to Rephrase District Residency Requirement Language Please find attached CA -1, which proposes amendments to various sections of the Charter to rephrase district residency requirement language. CA -1 will be placed on the October 12, 2018, meeting agenda for its initial consideration and approval prior to first reading. CA -1 (For Commission Use Only) 2018-2020 HAWAII COUNTY CHARTER COMMISSION CHARTER AMENDMENT PROPOSAL FORM 1. GENERAL INFORMATION Name of Commission Member: ADAMS 2. If applicable, list the charter provision(s) to be deleted or amended: Secs. 3-2, 3-17, 5-2.2; 6-9.3; 6-10.5; 7-2.2; 7-3.2; 7-4.5; 8-2; and 13-28 3. Provide a brief description of the purpose of the proposed charter amendment; include a description of the issue the proposal would address: The current phrasing is non-sensical. The proposed amendment fixes the phrasing to clarify that each district shall elect and be represented by one of the nine council members, with similar rephrasing of language for boards and commissions that use district residency requirements. 4. If the proposal is based on a provision(s) in the charter or law of another jurisdiction, name the jurisdiction and, if possible, attach a copy of the relevant provision(s). N/A 5. Attach the text of the proposed charter amendment in Ramseyer format (see below). Ramseyer Format, if proposing: Amendments to Existing Charter Provisions Any language being proposed to be added to the Charter shall be underscored. Any language being proposed to be deleted from the Charter shall be [bracketed and stricken] . Replacing Existing Charter Provisions in their Entirety Clearly indicate the article(s), chapter(s), and/or section(s) of the Charter to be proposed to be deleted, and provide the text of any provisions proposed to replace the deleted material. New Charter Provisions Provide the text of the new provision(s) and, if possible, indicate where in the Charter the new material should be inserted. Form CA -1 Revised 8/29/18 2 of 2 Hawaii County Charter Proposal --text 1. Amend Section 3-2 to read: "Section 3-2. Composition and Terms. There shall be a county council composed of nine members. [One member shall be elected from each of nine districts.] There shall be nine council districts, each of which shall be represented by a member. The terms of the council members shall be two years and shall begin at twelve o'clock meridian on the first Monday of December after their election. The terms of the council members shall not exceed four consecutive two year terms. Candidates shall be elected in accordance with the election laws of the state, insofar as applicable." 2. Amend Section 3-17(c) to read: "(c) Each subsequent redistricting commission shall consist of nine members. [One member shall be a resident of each] Each member shall be a resident of a separate council district as established by the previous redistricting commission. The members shall be appointed by the mayor and confirmed by the council in the manner prescribed in Section 13-4." 3. Amend Sections 5-2.2; 6-9.3; 6-10.5; 7-2.2; 7-3.2; 7-4.5; 8-2; 13-28: To replace each instance of: [One member shall be a resident of each council district.] With: Each member shall be a resident of a separate council district.
