NOTICE IS HEREBY GIVEN of the following matters to be considered by the Windward
Planning Commission of the County of Hawaii in accordance with the provisions of Chapters 91
and 92, Hawaii Revised Statutes, Section 6-7.5(a) of the Charter of the County of Hawaii, and
the Planning Commission's Rules of Practice and Procedure.

APPLICANT: FRIENDS OF THE VOLCANO SCHOOL OF ARTS AND
SCIENCES (USE 18-000077)
Application for a Use Permit to allow the establishment of a public charter school and
related improvements for grades pre -K to 8 for up to 250 students, and to provide
afternoon and evening adult education and post -secondary classes on 3.15 acres of land,
known as the historic Keakealani School property, within the Single -Family Residential -
20,000 square foot (RS -20) zoning district. The property address is 19-4024 Haunani
Road, which is about 500 feet northeast of its intersection with the Old Volcano Road in
Volcano Village, Puna District, Hawaii, TMK: (3) 1-9-004:019.
2. APPLICANT: CELLCO PARTNERSHIP DBA VERIZON WIRELESS
(USE 18-000076)
Application for a Use Permit to allow the construction of a new, non -manned
telecommunication facility, consisting of a 198 -foot tall self-supporting tower and related
facilities within a 1,600 -square foot lease area on a 3 -acre parcel of land situated in the
County's Agricultural 3 -acre (A -3a) zoning district. The location of the subject property
is 16-1806 Moho Road, approximately 920 feet south of the Kio`ele and Moho Road
intersection, Hawaiian Acres Subdivision, Kea`au, Puna, Hawaii,
TMK: (3) 1-6-047: portion of 062.
3. APPLICANT: HAWAII ISLAND VETERANS MEMORIAL, INC.
(AMEND REZ 06-000051)
Application to amend Condition B (Water Commitment), Condition C (Complete
Construction), and Condition F (Install Street Lights and Traffic Controls) of Change of
Zone Ordinance No. 07 26, which reclassified 4.888 acres from an Open (0) to a
Multiple Family Residential — 1,000 square feet (RM -1) zoning district in 2006. The
property is located at the north corner of the Kawili Street and Kapi`olani Street
intersection, Waiakea, South Hilo, Hawaii, TMK: (3) 2-4-057:029, portion of 030 and
portion of 031.
4. APPLICANT: KURTISTOWN ASSEMBLY OF GOD CHURCH (USE 18-000078)
Application for a Use Permit to allow the construction of a 3,040 square -foot community
outreach center and related improvements on a portion of 1.944 acres of land situated
within the Single -Family Residential 20,000 -square feet (RS -20) zoned district. The
property is northeast and adjacent to the site of the Kurtistown Assembly of God Church,
which is located on the mauka (northwest) side of Highway 11 directly across the
Highway 11- Kuauli Road Junction, Kurtistown, Puna, Hawaii,
TMK: (3) 1-7-006: portion of 005.

Application for a Special Permit to allow the development of a 3,600 square -foot farm
and garden retail store and related improvements on 32,670 square feet of land in the
State Land Use Agricultural District. The property is located on the mauka (west) side of
the Pahoa Bypass Road, approximately 1,800 feet southwest of its intersection with Post
Office Road, Pahoa, Puna, Hawaii, TMK: (3) 1-5-005:024.
6. APPLICANT: HILO ONE INCORPORATED (REZ 18-000228)
Application for a Change of Zone from an Agricultural 3 -acre (A -3a) to a Single -Family
Residential -15,000 square feet (RS -15) zoning district for approximately 12.728 acres of
land. The property is located along the south side of Haihai Street, approximately 930
feet east from the Haihai Street — Ainaola Drive intersection and across from Lei Lehua
Street, Waiakea Homesteads 2nd Series, South Hilo, Hawaii, TMK: 2-4-039:026.

Application for a 5 -year time extension to comply with Condition C (Secure Final Plan

No. 92 122, which reclassified approximately 2.5712 acres from Resort -Hotel -Safety -
7,500 square feet (V -S-7.5) district to the Limited Industrial- 20,000 square feet (ML -20)
zoning district in 1992. The subject property is located at 525 Pi`ilani Street, at the
northeastern corner of the Pi`ilani Street-Mililani Street intersection, Waiakea, South
Hilo, Hawaii, TMK: (3) 2-2-033:011.

northeastern corner of the Pi`ilani Street-Mililani Street intersection, Waiakea, South
Hilo, Hawaii, TMK: (3) 2-2-033:011.

Request to revoke Special Management Area Use Permit No. 334, which was granted in
1992 to allow the construction of a warehouse, fish processing plant, accessory office
use, parking and related improvements on a 2.5712 -acre parcel within the Special
Management Area. The subject property is located at 525 Pi`ilani Street, at the
northeastern corner of the Pi`ilani Street-Mililani Street intersection, Waiakea, South
Hilo, Hawaii, TMK: (3) 2-2-033:011.

enforcement action issued by the Planning Director.

The purpose of the public hearings is to afford all interested persons a reasonable
opportunity to be heard on the above matters.
Submitting Testimon. According to Rule 1 (General Rules) of the Planning Commission, a
person desiring to submit oral or written testimony shall indicate her/his name; address; and
whether the testimony is on her/his behalf or as a representative of an organization or individual.
If testimony is being submitted on behalf of an organization, documentation showing
membership ratification should accompany the testimony. Public testimony can be submitted by
mail or email. Those submitting written testimony at the meeting or by mail should provide
fifteen (15) copies for distribution. Public testimony submitted by mail, should be mailed to the
Windward Planning Commission at the Planning Department office addresses in Hilo and Kona
listed below. Mailed testimony should be provided at least one week prior to the hearing date to
allow for mailing and thorough Commission review. Public testimony that is submitted by email
to planning@hawaiicounty.gov, should be submitted before 4:30 p.m. two days prior to the
Commission meeting. Testimony that is irrelevant or unduly repetitious may be limited by the
Chairperson pursuant to Rule 1.
Pursuant to Rule 4, Contested Case Procedure, of the County of Hawaii Planning
Commission Rules of Practice and Procedure, any person seeking to intervene as a party to a
contested case hearing on Agenda Item Nos. 1, 2, 4 and 5 above is required to file a written
request which must be received in the office of the Planning Department no later than seven (7)
calendar days prior to the Planning Commission's first public meeting on the matter. Such
written request shall be in conformity with Rule 4, in a form as provided by the Planning
Department entitled "Petition for Standing in a Contested Case Hearing." The written
petition/request shall be filed with the Planning Commission at Aupuni Center, 101 Pauahi
Street, Suite 3, Hilo, Hawaii 96720, and accompanied by a filing fee of $200 payable to the
Director of Finance. Any party may retain counsel if that person so desires. Rule 4 may be
inspected or purchased ($2.50) at the above-cited location. Rule 4 may also be viewed at the
County of Hawaii Planning Department website under Resources and References
(http://www.hiplanningdept.com)
Notice to Lobbyists: If you are a lobbyist, you must register with the Hawaii County
Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawaii County
Code}. A lobbyist means "any individual engaged for pay or other consideration who spends
more than five hours in any month or $275 in any six-month period for the purpose of attempting
to influence legislative or administrative action by communicating or urging others to
communicate with public officials." {Article 15, Section 2-91.3(a)(6), Hawaii County Code}
Registration forms and expenditure report documents are available at the Office of the County
Clerk, 25 Aupuni Street, Room 1402, Hilo, Hawaii 96720.

Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii and at the Kona
office of the Planning Department, West Hawaii Civic Center, 74-5044 Ane Keohokalole
Highway, Building E, 2nd Floor, Kailua-Kona, Hawaii.
Anyone who requires an auxiliary aid or service, other reasonable modification, or

days prior to the meeting date, to arrange for accommodations. "Other reasonable modification"
