Beretania Street, Suite 406 Honolulu, Hawai`i 96813 Re: Continued Hearing on the Land Use Commission's Order to Show Cause In the Matter of the Petition of Waikoloa Mauka LLC. Docket No. A-06-767 Dear Chair Scheuer and State Land Use Commissioners, The official position of the County of Hawaii ("County") is that Waikoloa Mauka LLC ("Petitioner") has not yet fulfilled Condition 9 (Affordable Housing) of the State Land Use Commission's Findings of Fact, Conclusions of Law, and Decision and Order For A State Land Use District Boundary Amendment, dated June 10, 2008. At the present time, Petitioner is engaging in negotiations with the County towards fulfilling this condition, and the County will require Petitioner to fulfill its affordable housing requirements under the law. Please be advised that Mr. Ronald N.W. Kim, Esq., is the County's duly authorized attorney in this proceeding before the State Land Use Commission, and that Mr. Kim accordingly has authority to represent and speak on behalf of the County at this proceeding.
