Section 13-27. County Election.
(a) No person shall be a candidate for more than one elective office in the same election. If no person is
elected to a county office, the county council shall appoint a person to fill such office. County elections
shall be conducted in accordance with the election laws of the state insofar as applicable.
(b) All county elective officers—mayor, council members, and prosecuting attorney—shall be elected in
nonpartisan a special elections. Such spccial cicctionschall to be held with the primary and general
elections of the applicable year.
(c) First spccial cicction. The first spccial cicction shall bc hcld with thc rcgularly schcdulcd primary
cicction. Any candidatc for mayor, prosccuting attorncy or council rccciving a majority of all votcs
validly cast for candidatcs for that officc, cxcluding blank and spoilcd ballots, shall bc dccmcd cicctcd.
If thcrc is only one candidatc for thc officc, that candidatc shall bc dccmcd cicctcd rcgardlcss of the
numbcr of votcs rcccivcd.
(d) Sccond special election. The sccond special election shall be held with the regularly scheduled
general election. Unlcss a candidatc has bccn cicctcd in thc first spccial cicction, thc two candidatcs
rccciving thc highcst numbcr of votcs for thc officc in qucstion in thc first spccial cicction shall be
placcd on thc ballot for thc sccond spccial cicction. At thc sccond spccial cicction thc candidate
rccciving thc highcst numbcr of votcs for each rcspcctivc officc shall bc dccmcd cicctcd.
First, every vote counts for its first choice. If a candidate has more than half of the
vote based on first -choices, that candidate wins. If no candidate has more than half
of those votes, then the candidate with the fewest first choices is eliminated. The
voters who selected the defeated candidate as a first choice will then have their
votes added to the totals of their next choice. This process continues until a
candidate has more than half of the active votes or only two candidates remain. The
candidate with a majority among the active candidates is declared the winner.
