RM. 74-5044 ANE KEOHOKALOLE HWY, KAILUA-KONA, HI CALL TO ORDER Chair Hendricks called the meeting to order at 9:06 a.m. ROLL CALL Present: Peter Hendricks, Chair Arthur Buckman, Commissioner Jak Hu, Commissioner Paul Paiva, Commissioner Colleen Pasco, Commissioner Absent: Wayne De Luz, Vice Chair Carl Carlson, Commissioner A quorum was present Also Present: Kenneth Bugado, Deputy Police Chief James O'Connor, Assistant Chief Mitchell Kanehailua, Assistant Chief Brian Prudencio, Detective Malia Hall, Deputy Corporation Counsel Josie Pelayo, Secretary APPROVAL OF AGENDA Commissioner Paiva motioned to approve the agenda. Commissioner Pasco seconded, and it carried unanimously. STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS (None.) APPROVAL OF MINUTES Commissioner Paiva motioned to approve the minutes of October 19, 2018, regular and executive session minutes. Commissioner Pasco seconded, and it carried unanimously. POLICE CHIEF'S REPORT ON DEPARTMENT ACTIVITIES Items from the written reports were briefly highlighted: • Crime Report: Assistant Chief O'Connor reported that up through October 31, there were 2,352 serious crimes. The Criminal Investigation Unit investigated 409 of those cases. There were no crime trends. For the month of October, they received 6,881 calls for service. • Traffic Report: Assistant Chief O'Connor reported that 3,884 citations were issued in October: Moving/regulatory 2,741, seatbelt 262, child restraint 17, and speeding 864. Hawaii Police Commission Regular Session Minutes November 16, 2018 Page 2 Personnel Report: Deputy Chief Bugado reported that Major Thomas will be replacing Assistant Chief Marshall Kanehailua in Administration. The 88th recruit class is in field training. The 89th recruit class will start work on December 3. Ten officers will be promoted to sergeant on December 1. The North Hilo and Hamakua stations will merge on December 1. The beats will remain the same, and the supervisor will be responsible for both North Hilo and Hamakua. They will be doing mock assessments for CALEA accreditation. Assessors are coming over for several days and will interview personnel. They ordered 10 blue and white vehicles but only received a couple. The rest are on back order. Finance Report: Deputy Chief Bugado reported that their target expenditure for October 31 is 37.5%; they are at 39.56%. Cash -in -lieu payments for retirees as of November 1 was $239,558. This is unbudgeted and comes out of Salaries & Wages. • Commendations of Sworn and Civilian Employees: Deputy Chief Bugado reported receiving 3 commendations involving 4 personnel since the last meeting. UNFINISHED BUSINESS Correspondence No. 18-04, from the Hawaii County Charter Commission requesting input as to how the Charter affects its role and operations within the county and any proposals it may have to amend the Charter. There were no recommendations for changes, and the Charter Commission will be notified of this. CHAIR'S REPORT ON OTHER COMMISSION ACTIVITIES AND INTERESTS Chair Hendricks reported that the commission will vote on a Chair and Vice Chair for 2019 at the next meeting. EXECUTIVE SESSION (Closed session.) Commissioner Buckman motioned to meet in executive session to consider charges against officers or employees of the Hawaii Police Department, to consider sensitive matters relating to public safety, and may consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92-5 (a) (2) (4) (6) and the Hawaii County Charter Section 13- 20 (b). Commissioner Paiva seconded, and it carried unanimously. Executive session convened at 9:33 a.m. Regular session reconvened at 10:53 a.m. ACTION ON INVESTIGATION OF COMPLAINTS • HPC 18-22: Complainant alleged that an officer's report of his assault was incomplete. Commissioner Paiva motioned that there was insufficient evidence to prove the complainant's allegations. Commissioner Pasco seconded, and it carried unanimously. Hawaii Police Commission Regular Session Minutes November 16, 2018 Page 3 HPC 18-26: Complainant alleged that an officer gave her citations for moving violations for her vehicle that was parked on her property. Commissioner Paiva motioned that there was insufficient evidence to prove the complainant's allegations. Commissioner Buckman seconded, and it carried unanimously. HPC 18-29: Complainant alleged that when she went to make a complaint at the police station, her baby was taken away from her, and she was not allowed to feed the baby. Commissioner Paiva motioned that there was insufficient evidence to prove the complainant's allegations. Commissioner Pasco seconded, and it carried unanimously. HPC 18-30: Complainant alleged that an officer tried to antagonize him into an altercation by insulting him. Commissioner Paiva motioned that there was insufficient evidence to prove the complainant's allegations. Commissioner Hu seconded, and it carried unanimously. ANNOUNCEMENTS Chair Hendricks announced that the next monthly meeting is scheduled for December 21, 2018, 9:00 a.m., Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii. He will schedule a meeting with Chief Ferreira to discuss the commission's secretary position.
