RE: Transmitting CA -13; Proposed Amendment to Article X; Adds a New Section
Relating to the Use of Special Funds in Times of Declared Emergency; Submitted
by Commissioner Leithead Todd
Please find attached CA -13, which proposes an amendment to Article X of the Hawai`i
County Charter (2018 Edition), by adding a new section that would permit the mayor to
use funds in times of a declared emergency from any special fund of the County, unless
prohibited by State law, to preserve the peace, life, property, health or safety of the
County and its inhabitants.
CA -13 will be placed on the next regularly scheduled meeting agenda for its initial
consideration and approval prior to first reading.

CHARTER AMENDMENT PROPOSAL FORM
1. GENERAL INFORMATION

2. If applicable, list the Section number(s) of the charter provision(s) to be deleted or amended:
Adds a new Section to Article X (Financial Procedures)
3. Provide a brief description of the purpose of the proposed charter amendment; include
a description of the issue the proposal would address:
Provide the County with a mechanism to borrow funds at zero interest from its
own special funds in times of emergency. Federal and State financial support is often not
provided immediately. This amendment would allow for the County to expend money in
a timely manner to provide immediate relief, with the requirement that monies expended
are replenished within five years.
4. If the proposal is based on a provision(s) in the charter or law of another jurisdiction,
name the jurisdiction and, if possible, attach a copy of the relevant provision(s).
5. If the proposal is based on any written materials you have, please attach a copy with a
citation to its source.

Amendments to Existing Charter Provisions
Any language being proposed to be added to the Charter shall be underscored.
Any language being proposed to be deleted from the Charter shall be [bracketed and
stricken] .
Replacing Existing Charter Provisions in their Entirety
Clearly indicate the article(s), chapter(s), and/or section(s) of the Charter to be proposed
to be deleted, and provide the text of any provisions proposed to replace the deleted
material.
New Charter Provisions
Provide the text of the new provision(s) and, if possible, indicate where in the Charter the
new material should be inserted.

Full Text — proposal — Amend Article X by adding a new section that would authorize the Mayor
to use funds from Special Funds in the County budget during times of a declared
emergency/disaster:
"Section 10- . Use of Special Funds in a Time of Declared Emergency.
Upon any official declaration of emergency made pursuant to Section 13-23 of this Charter,
unless prohibited by State law, the mayor may appropriate and expend funds from any
special fund of the county in order to preserve the peace, life, property, health or safety of
the county and its inhabitants.
Any funds appropriated and expended from a special fund for the purposes of this section
shall be replenished in full to that special fund within five years from the expiration of the
declared emergency, with the exception of any interest that would have accrued if the funds
had remained unused in the special fund."
