Replacing Existing Charter Provisions in their Entirety Clearly indicate the article(s), chapter(s), and/or section(s) of the Charter to be proposed to be deleted, and provide the text of any provisions proposed to replace the deleted material. New Charter Provisions Provide the text of the new provision(s) and, if possible, indicate where in the Charter the new material should be inserted. forrn CA -1 Revised 8/t5 2 of 2 Hawaii County Charter Proposal --text "Section 10-15. Public Access, Open Space, and Natural Resources Preservation and Maintenance Funds. In adopting each fiscal year's operating budget, the council shall appropriate: (1) A minimum of two percent of certified real property tax revenues into a fund known as the public access, open space, and natural resources preservation fund; and f2) An additional 0.25% of certified real property tax revenues into a fund known as the public access, open space, and natural resources preservation maintenance fund. Q Moneys in public access, open space, and natural resources preservation fund shall be utilized for purchasing or otherwise acquiring lands or property entitlements for land conservation purposes in the County of Hawai`i for: Public outdoor recreation and education; Access to beaches and mountains; W Preserving historic or culturally important land areas; fzil Protecting natural resources, significant habitats, or ecosystems, including buffer zones; Preserving forests, beaches, coastal areas, agricultural lands; Protecting watershed lands to preserve water quality and water supply; 121 Conserving land for the purpose of reducing erosion, floods, landslides, and runoff, and Improving disabled and public access to, and enjoyment of, public land, open space, and recreational facilities. Moneys in the public access, open space, and natural resources preservation fund may be awarded as grants to federal and state agencies and eligible 501(c)(3) nonprofit organizations for the acquisition of lands or property entitlements, provided the purpose of acquisition is as described in subsection (b). Moneys in the public access, open space, and natural resources preservation maintenance fund shall be utilized to maintain and improve land or property entitlements for land conservation purposes in the County of Hawai`i acquired pursuant to this section. The moneys in each fund may also be used for the payment of principal, interest, and premium, if any, due with respect to bonds issued for the purpose of this fund and for the payment of costs associated with the purchase, redemption or refunding of such bonds. The moneys in these funds may be used to pay for the salary, wages and benefits of staff dedicated to advancing the activities contained within this section. Any balance remaining in these funds at the end of the fiscal year shall not lapse, but shall remain in the funds, accumulating from year to year.
