Saquing Donna Mae Springer RE: Transmitting CA -26; Proposed Amendment to Section 6-2.2 — Relating to Qualifications for the Director of Public Works; Submitted by Commissioner Adams Please find attached CA -26, which proposes to amend Section 6-2.2 of the Hawai`i County Charter (2018 Edition) to delete the requirement that the Director of the Department of Public Works be a registered professional engineer. CA -26 will be placed on the next available meeting agenda for its initial consideration and approval prior to first reading. CA -26 (For Commission Use Only) 2018-2020 HAWAII COUNTY CHARTER COMMISSION CHARTER AMENDMENT PROPOSAL FORM 1. GENERAL INFORMATION Name of Commission Member: ADAMS 2. If applicable, list the charter provision(s) to be deleted or amended: Amend Section 6-2.2. 3. Provide a brief description of the purpose of the proposed charter amendment; include a description of the issue the proposal would address: The amendment deletes the requirement for the director to be a registered professional engineer. 4. If the proposal is based on a provision(s) in the charter or law of another jurisdiction, name the jurisdiction and, if possible, attach a copy of the relevant provision(s). Maui County Charter, Section 8-5.2. 5. If the proposal is based on any written materials you have, please attach a copy with a citation to its source. Ramseyer Format, if proposing: Amendments to Existing Charter Provisions Any language being proposed to be added to the Charter shall be underscored. Any language being proposed to be deleted from the Charter shall be [bracketed and stricken] . Replacing Existing Charter Provisions in their Entirety Clearly indicate the article(s), chapter(s), and/or section(s) of the Charter to be proposed to be deleted, and provide the text of any provisions proposed to replace the deleted material. New Charter Provisions Provide the text of the new provision(s) and, if possible, indicate where in the Charter the new material should be inserted. Form CA -1 Revised 8/29/18 2 of 2 CHAPTER 5 DEPARTMENT OF PUBLIC WORKS Section 8-5.1. Organization. There shall be a department of public works consisting of a director and the necessary staff. (Amended 2006, 2002, 1996, 1992) Section 8-5.2. Director of Public Works. The director of public works shall be appointed by the mayor with the approval of the council and may be removed by the mayor. The director of public works shall have had a minimum of five years of experience in an administrative capacity, either in public service or private business, or both. (Amended 2016, 2006, 2002, 1992) Section 8-5.3. Powers, Duties, and Functions. The director of public works shall: 1. Administer the building, housing, and subdivision ordinances and rules adopted thereunder. 2. Approve proposed subdivision plans, which are in conformity with the subdivision ordinance. 3. Plan, design, build, and maintain the county's highways, and drainage and flood control systems. 4. Perform such other duties and functions as shall be assigned by the mayor. (Amended 2006, 2002, 1996, 1992) CHAPTER 6 DEPARTMENT OF PARKS AND RECREATION Section 8-6.1. Organization. There shall be a department of parks and recreation consisting of a director of parks and recreation and the necessary staff. Section 8-6.2. Director of Parks and Recreation. The director of parks and recreation shall be appointed by the mayor with the approval of the council and may be removed by the mayor. The director of parks and recreation shall have had a minimum of five years of experience in an administrative capacity, either in public service or private business, or both. (Amended 2016) 23 Hawaii County Charter Proposal --text Section 6-2.2. Director. The director of public works shall be appointed by the mayor, confirmed by the council and may be removed by the mayor. [The director shall be a registered professional engineer.] The director shall have had a minimum of five years of experience in an administrative capacity.
