HomeMy WebLinkAbout2019-01-17 Leeward Exh A - Hoxsie (AMEND SMA 07-000020) LEEWARD PLANNING COMMISSION COUNTY OF HAWAI‘I HEARING TRANSCRIPT JANUARY 17, 2019 The following is public testimony provided by BOB HOXSIE on the application of KILOHANA MAKAI LLC (AMEND SMA 07-000020) at 9:36 a.m. in the West Hawai‘i Civic Center, Community Center, Building G, 74-5044 Ane Keohokālole Highway, Kailua-Kona, Hawai‘i, with Chairman Keith F. Unger presiding. COMMISSIONERS PRESENT: Keith F. Unger, Scott Church, Perry Kealoha, Sonny Shimaoka and Michael Vitousek ABSENT AND EXCUSED: Nancy Carr Smith and Faye Yates ALSO PRESENT: Malia Hall, Esq. (Counsel for the Commission), Michael Yee (Planning Director), Jeff Darrow (Planning Program Manager), Christian Kay (Planner), Alex Roy (Planner) and Noriko Sauer (Commission Secretary) And approximately eleven people from the public in attendance. APPLICANT: KILOHANA MAKAI LLC (AMEND SMA 07-000020) Application for a 5-year time extension to comply with Condition No. 3 (Complete Construction) of SMA Permit No. 07-000020, which was issued in 2007 to allow the development of a 5-story, 11-unit residential condominium on 14,450 square feet of land. The property is located along the makai side of Ali‘i Drive, adjacent to and south of the Kona Banyan Tree Condominium, Hōlualoa stnd 1 and 2, North Kona, Hawai‘i, TMK: (3) 7-6-014:013. UNGER: Please raise your right hand. Do you swear or affirm to tell the truth before the Planning Commission? HOXSIE: Yes. UNGER: Please state your name and your area of residence. HOXSIE: Bob Hoxsie. I live in Kailua-Kona. UNGER: Thank you. HOXSIE: And I actually own a property right next door to this proposed building. UNGER: Great, wonderful, you can begin your testimony, thank you. HOXSIE: Okay, so, I’m going to just restrict my comments just to two points now because we can have further discussions at the time. But my two main points are, this is something that was 1 EXHIBIT A originally approved in 2007, and things have changed since 2007. One, the shoreline has changed, so whether or not you could actually build something where they proposed may have changed. And what was acceptable to be building in such a location has changed. I was, again, I’m an owner at the Banyan Tree Condominiums, and we just tried to replace our seawall that was eroding and we were told, we actually had to move the seawall when we repaired it after the tsunami, and, you know, one, we had to move it because they said the shoreline had changed, and, two, I mean, they were, there was a lot of push to not even allow us to replace the seawall. So, so I just want to make sure that when we are making decisions about this property – they have a right to develop this property – but when we make decisions about what goes on this property, that we should be looking at what’s acceptable today, not what was acceptable in 2007.
