everyone to put their phones on vibrate or silent. We appreciate it. Let's start off with
introductions.

Yvonne Rocco, Manager, was present.
Taniguchi: Good morning.
Rocco: Good morning.
Taniguchi: Can you identify yourself and your relationship to the business please?
Rocco: Yes, my name is Yvonne Rocco and I'm Owner/Operator of Rocco's Pizza
Pub.
Taniguchi: Can you briefly describe your business?
Rocco: Yes. We're a family-owned pizzeria. We primarily do pizza and salads and a
little bit of pasta and fresh-baked bread. We've been operating almost three years here
on the Big Island.
Taniguchi: Are there any changes to your report?
Rocco: (nodded indicating there are no changes).
Taniguchi: Director, any protests? Well, we have one that we just received.
Takase: Mr. Chairman, the applicant submitted two out of two notices within 100 feet,
and 15 out of 22 within 500 feet. There were 17 properties entitled to protest, and we
did received one protest application. I believe copies were provided to the
Commissioners.
Taniguchi: Is there any public testimony regarding this application?
There was no public testimony.
Taniguchi: Since none, Commissioners, any questions? Mr. Greenwell?
Greenwell: Gerald, could you explain a bit about this procedure that they have or the
ownership of the property versus a lease?
Takase: Right now, the property is a leasehold property. However, she is in the
process of acquiring the leasehold as well. At the end of the day, she will be the fee
owner of the property.

Greenwell: But according to this, they have to have a lease in place for a year before
we can issue a license?
Takase: What we require is either ownership or a lease. We treat a lease, one year or
more, as a permanent lease. She could proceed with just a lease, but in this case,
she's doing both. She has a lease but she is in the process of also acquiring the fee
under the lease.
Greenwell: But her lease is currently month-to-month?
Rocco: The easiest way for the current owner and when I met with Ashley at Bishop,
100 percent of the lease is going to the purchase of the property right now. They have
six more years left on the leasehold that we are going to be taking over. It's going to
take some time to transition that over and renegotiate, so the best way that everybody
could (inaudible) was to do the lease in that form since we are purchasing the property
at the same time.
Greenwell: You said there are six years left on the lease?
Rocco: On the current lease, but we are able to take it over. Yes.
Taniguchi: Any other questions?
Lopez: In looking at the protest and your hours. You're only open Wednesday through
Sunday to 9:00 P.M.?
Rocco: Correct.
Lopez: So would this individual potentially be impacted three nights per week?
Rocco: Yes.
Lopez: Have you talked to them? Or do you know this (person)?
Rocco: This is the first that I've seen of this.
Lopez: Thank you.
Taniguchi: Mr. Onizuka?
Onizuka: I have a question on a point that was brought up on this protest which is
about parking. Where is your parking?
Rocco: We have our own parking lot that we built specifically for that building. There is
adequate parking. There's basically one property that is close to the pizzeria and I'm
suspecting this might be the property at hand with this letter of protest. But the property
incline goes straight up to the property which no one could easily go up there to park or

mistake that for the pizzeria. Obviously, we can put a cone or a "no parking" sign or
whatever it takes to prevent anybody from driving up that incline, that driveway. But,
really don't see that happening easily. Unless of course, to turn around, but it's pretty
distinct that it's a residential driveway.
Onizuka: How many parking stalls do you have?
Rocco: We have our handicapped, and about 10 parallel. I'm going to say we have
about 20.
Onizuka: Twenty parking stalls?
Rocco: Twenty.
Onizuka: This is the old Morihara Store, right?
Rocco: Yes. There's also parking in the front (parallel).
Taniguchi: Any other questions, Commissioners? In reading this complaint, it seems
as though the music is affecting them now.
Rocco: Right. Now we're shutting down the music at 7:00 P.M.
Taniguchi: At 7:00? Is that live?
Rocco: Yes. It's live music. We have Hawaiian music, Country.
Taniguchi: Is it amplified music or just acoustic guitar type?
Rocco: Acoustic, they do plug in.
Taniguchi: So this 8:30 matter is moot now since you don't have music past 7:00?
Rocco: Right now I don't. I obviously want to go to 8:30 and close at 9:00. But right
now, I'm currently ending music at 7:00. I see that they have it (in the protest) as 8:30.
Their 8:30 time that they put in the protest should work fine with what we're doing
because we close at 9:00. I always shut down the music at 8:30. At our previous
location, we closed at 10:00 and I always closed down the music at 9:00. We'll need to
work with them. I'm okay with that 8:30 time. I completely understand that she has
children and we have no problem with that. We always try to be courteous to people
that are around us when the music gets loud. Plus the patrons love the music, the
atmosphere, so we're trying to balance it all. I have no problem with 8:30.
Taniguchi: I guess the difference between now and your request is dancing? If you're
closing at 9:00 and it's a family pizza place, so you're okay with ending and closing at
9:00? Dancing?

Rocco: Yes. And the reason for the dancing was two-part. I've had private parties,
Christmas parties, birthday parties, and people like to get up and dance. When we
have our Hawaiian music, typically a couple will just get up and start dancing. I just
don't want to be in any violation in our liquor license. These are the reasons for the
dancing. It's not a club scene, just basically couples that will get up sometimes and
dance.
Taniguchi: Okay. Mr. Greenwell?
Greenwell: I can't read this fellow's signature or woman's signature on the bottom
here, but I see at the top it's Vanessa M. Puou. Are you familiar with them? Have you
ever spoken to them?
Rocco: I don't, and no one has come in to make any complaints or called. I'm really
surprised to see this. Like I said, I don't know her and I suspect most of the residents
and neighbors came in and are enjoying the pizza and just being there. I suspect it
might be that house at the top, but I'm not sure.
Greenwell: Okay.
Taniguchi: Gerald?
Takase: Yvonne, is your place air conditioned or is it just open air?
Rocco: It's open air.
Takase: I ask you to reach out to this person. She must be close (in proximity) to you.
Rocco: I think it might be that one particular house.
Takase: At the far end of the property?
Rocco: Yes. I can talk to her.
Takase: Looking at our map, it seems she's one property away from your parcel to the
north. But reading her letter, it seems she's right next to you. So, it's one of those two
properties.
Rocco: I'II just have to go and look up her name and parcel number and find out if
that's really where she's at.
Takase: If you rather not, then we will start negotiating for you. But I implore you to do
it.
Rocco: Yes, absolutely. I can speak with her. I just want to say, when I call her about
anybody driving on the property, I will make sure that it won't happen and that most of

our customers are families so I don't see that happening. But I want to make sure
address that with them.
Takase: Finally, are you going to do something with Planning?
Rocco: Yes, I'm working with them now. Yes, I'm already that far.
Takase: Okay, that's all the questions I have.
Taniguchi: Mr. Onizuka?
Onizuka: This is going to be a new location?
Taniguchi: They're moving to Captain Cook.
Takase: Yes. She was in Kealakekua before.
Onizuka: Mango Court?
Takase: Yes, used to be.
Onizuka: So you moved to this other location?
Rocco: Yes.
Onizuka: Question to the Department, this B2, Class 5 license goes until what time?
What is the maximum?
Takase: The maximum is 2:00 (A.M.).
Onizuka: If you're agreeing to 9:00, is that a restriction that would be put on the
license?
Takase: If you want to enforce it, you would put that on it.
Onizuka: I think we could do that if we have another complaint.
Takase: Yes.
Rocco: In the previous location, I always welcomed the (noise level checks). We've
always passed that.
Takase: I don't recall any complaints in their other location and they had people in back
of them.
Taniguchi: When you reach out to this person, also address the littering problem.

Rocco: Yes, I saw that (addressed in the protest).
Taniguchi: Looking at the picture, there is a house directly behind you. Is that the one
you're thinking of?
Rocco: That's the one I'm thinking of. It's behind and up.
Taniguchi: Where's the driveway?
Takase: I don't think that's the house. It's at the end of your parking lot.
Rocco: On the other side?
Takase: Yes.
Rocco: Okay.
Taniguchi: Any other questions, Commissioners?

Ota: Yes. We are a tonkatsu ramen place. We specialize in ramen.
Taniguchi: Director, any report of protests?
Takase: Mr. Chairman, the applicant mailed three out of three notices within 100 feet,
and 46 out of 52 within 500 feet. There were 55 properties entitled to protest, and there
were no protests to this application.

Newton Chu, representing the applicant; Marcus Bender, Manager;
and Scott Thompson, Master Brewer, were present.
Taniguchi: Good morning.
Chu: Good morning, Chair Taniguchi and members of the Commission. Newton Chu
on behalf of the applicant, Pacific Aqua Beverages, LLC. To my left is Marcus Bender
who is Manager and Member of Pacific Aqua Beverages. I do have one change to the
investigator's report. If I can direct your attention to the first page of the report under
Applicant, John Molina and Kevin Davis as Managers. There's been a slight change in
transaction. It changed from an equity, from them taking an equity position in Pacific
Aqua Beverages from financing positions so there would be one manager, and that
would be Marcus Bender. We are in the process where the Corporate Attorney is on
Oahu making those changes now.
Taniguchi: Thank you. Can you briefly describe the business?
Chu: The finest beer brewed in Hilo with some new products to come, hopefully, and
continuation of a brewery started by the Shindo family back in ...
Bender: Dustin Shindo and his father, Cal; I can't even remember, it's been so long,
but they started it.
Taniguchi: It was in the 90's.
Chu: For the Commission's information, Scott Thompson who is the current
Brewmaster for DeMare will stay on as will virtually all of the employees. Hilo will still be
represented well. We're looking forward to Marcus bringing new energy to the
business.
Taniguchi: Is there any public testimony?
There was no public testimony.
Taniguchi: Commissioners, any questions?
Hughes: You'll still have the tasting room? Are there future plans for anything more
than that, like a restaurant? Anything?
Bender: Right now, I'm talking to some different individuals that have restaurants here
in Hilo that we might be able to collaborate with.
Hughes: Also, what are the restroom facilities in your tasting room? Is there a
restroom facility available?
Bender: There is, yes.

Arakaki: Is the brewery going to keep doing the same kind of beers, or doing
something different?
Bender: We have some other recipes that we're looking at investing, and try to
consolidate and do some things that we know from the sales and our distribution
partner, Johnson Brothers. I've met with them and they've given me some good
feedback about what really is well-received and what is sort of not above the 80-20 rule.
We're going to focus on the winners and try to introduce some seasonal beers and
things that will re -invigorate the public's interest in what we're doing as well as re-
address the packaging and try to brand it so it's not so confusing. There's some
Mehana beers, there's Hawaii Nui beers, so what is it? We want to bring it all together
in some new packaging and what I'II call a re -launch in the community in terms of re-
invigorating people's interest and being able to identify what it is.
Chu: Mr. Bender was involved in creating the Hawaiian Springs water on the map and
to the public in the 90's.
Bender: In 1997 I took it public on the NASDAQ, but I started in 1994. Before that I
had hands in sodas and so on. I've been in the beverage business since 1981, with
Hinano beer in Tahiti. I was the importer for many years for the Martin family. I sort of
got baptized in the beverage business in beer and my exit will be in beer, so to speak.
Taniguchi: When you were under Hawaii Nui, that was on Kauai, right?
Bender: My understanding of it, the history of it, it was a brewery on Kauai that merged
together with Mehana. Then they went bankrupt.
Taniguchi: They were brewing everything up there or still doing everything here?
Bender: I think it was all here, just under different labels. I think there was even one
called Keoki, if I'm not mistaken, back in the day. So, there was Hawaii Nui, Keoki,
Mehana, everybody was trying to figure out who's going to succeed in being the primary
name and I don't think anyone really came to any conclusion.
Taniguchi: Getting back to Mr. Hughes' question about the restrooms, somebody
mentioned that they were at Mehana's tasting room and tourists asked to use the
restroom and was told there was no public restroom. You might want to check with your
employee on that, because I heard the same thing. It was a good question.
Thompson: There are two public restrooms.
Bender: I've used the restroom there, that's why I said yes.
Taniguchi: But they said no public (restrooms). You're an employee. Maybe it was
just a miscommunication type of thing.

Chu: We'll address that. Thank you for bringing it to our attention. We will check on
that.
Bender: Definitely. That's a very important point if you're drinking beer.

Takase: I get varying reports. When I went through Customs, they said you could bring
back one bottle. Others say you can bring back two or three. Anything above that,

Masuda: Gerald, when you bring it back, is there a limit on the quantity? Like 1.9 liters.
Takase: No, they just go by the bottle.
Greenwell: There used to be a limitation of one gallon was duty free. I don't know if it's
changed.
Taniguchi: I think it's less than that for sake. I think it's like that 720 milliliters. It's not
one gallon. I was wondering, because with this amount, (referring to HRS 281-33.1, as
stated on the application), not to exceed five gallons, it's a lot.
Takase: Well, nine bottles. I hear the duty is not that high on it.
Taniguchi: That's a good question, Mr. Greenwell. I didn't know you had to do this.
How much before you need approval for? Not even one gallon?
Takase: Usually, they're going to bring back a big amount. The only times we actually
see these are when people are moving. Especially military, because the military
movers will require that you get a permit.

Greenwell: Gerald, there's an awful lot of drinking at Kahilu Theatre. They've got
about six applications here. There's a lot of liquor being sold in Waimea.
Takase: There's a lot of events. There might actually be even more because this past
Legislature changed the rules so that now special permits are free. We used to charge

twenty dollars if you had a three -event permit and if you went over four or six. Now, all
special permits are free. We'II see what's going to happen if it catches on.
Greenwell: Wait. You say all special permits are free?
Takase: Yes.
Greenwell: That doesn't make sense. Why do you have to pay for a permit, but when
it becomes a special permit, it's free?
Takase: Previously, special permits are restricted to non -profits, and secondly to
political candidates. Previously under our rules, you could have up to four free and after
that, you used to pay twenty dollars to try and keep it down. Because of the uproar on
Maui, the Legislature stepped in and cancelled all fees, so they could come in everyday
and apply for a special permit.
Masuda: You also had actions going on in Maui where a non-profit (would apply) and
Maui was saying you need to have a criminal history check and you need this and that,
so this was the push -back.
Takase: We, as a State couldn't get together. Kauai was fighting Maui, but Honolulu
didn't take a position. That was the Legislature's response to Maui. If you remember,
Maui was getting very strict with special permits. All of the Board of Directors for a non-
profit would have to come in and get fingerprinted prior to any event. There were a lot
of cancellations of fundraisers and events of that nature. The Maui Commission was
unrelenting. If they didn't get full compliance, your event was cancelled. We were
victims of the backlash from it as well. Since they couldn't get anything done through
Maui, they went to the Legislature and they're passing legislation for the whole State.
Taniguchi: We still haven't voted on this. We had a motion and second. All those in
